Źródła prawa, arbitraŜ krajowy i międzynarodowy. 2. Zalety i wady arbitraŜu. 3. Jurysdykcja krajowa sądów państwowych w związku z postępowaniem przed sądem polubownym. 4. Zapis na sąd polubowny. 5. Arbitrzy i skład sądu polubownego. 6. Właściwość sądu polubownego. 7. Postępowanie przed sądem polubownym. 8. Zabezpieczenie roszczeń dochodzonych przed sądem polubownym. 9. Wyrok sądu polubownego. 10. Inne zakończenie postępowania przed sądem polubownym 11. Postępowania rektyfikacyjne. 12. Skarga o uchylenie wyroku sądu polubownego. 13. Postępowanie remisyjne. 14. Advantages and disadvantages of arbitration. 3. Domestic jurisdiction of the state courts in connection with the arbitration proceedings. 4. Arbitration clause. 5. Arbitrators and composition of the arbitral tribunal 6. Jurisdiction of an arbitral tribunal 7. Arbitration proceedings. 8. Securing the claims brought to the arbitral court. 9. Cele i efekty kształcenia: Zapoznanie uczestników zajęć z całokształtem postępowania arbitraŜowego i jego uwarunkowaniami, z tematyką skargi o uchylenie wyroku sądu polubownego oraz uznawania i stwierdzenia wykonalności krajowych i zagranicznych wyroków sądu polubownego i ugod przed nim zawartych. Nadto wykład obejmuje zagadnienie stałych sądów polubownych, w tym ICC oraz ogólne wprowadzenie do ADR a takŜe omówienie całokształtu regulacji obejmujących mediację cywilną, w tym dyrektywy UE 2008/52/Ec. Objectives and learning outcomes: Familiarize the participants with the totality of the arbitration and its determinants, with the subject of action for setting aside arbitration award, recognition and ascertainment concerning the possibility of execution of an arbitration award or a settlement concluded in arbitral tribunal. Moreover lecture covers the issue of permanent courts of conciliation including ICC and general introduction to the ADR and discussion of all regulations of civil mediation including Directive of the EU 2008/52/Ec.
