THE TARIFF, TERMS AND CONDITIONS OF HIRING THE
FLOATING CRANE “MAJA”
Dated 12.12.2014
I.VALIDITY
1. This “Tariff, Terms and Conditions of Hiring the Floating Crane “Maja”, hereinafter referred
to as the “Tariff” has been in force since 01.01.2015 till the time a new tariff is introduced,
however, not earlier than to 31.12.2015.
2. The tariff concerns hiring the floating crane at ports Gdynia and Gdańsk excluding port
roads
3. The tariff is valid for hiring the floating crane d/e Maja to do typical jobs, with cargo of weight
up to 330 tons. The Tariff does not apply to hiring for: cargo transport on board of the
crane, cooperation with other cranes, salvage, works on the sunken cargo, work outside the
ports of Gdańsk and Gdynia, or work in specific weather and ice conditions.
II.THE TARIFF
1. The charges included in this tariff are nett prices expressed in euro („€”)
2. The following charges are collected for the floating crane’s d/e “Maja” services:

2.2. Additional charges:
2.2.1. For usage of two hooks for lifting, rotating or other operation with cargo in
apart from the charges contained in the Table of Charges the additional
flat-rate fee is charged on each piece of cargo

2.2.2. A bonus is added for work on Sundays, bank holidays and holidays,
30% of the amount of the invoice.
2.2.3. € 800 is assessed for every hour started of crane’s awaiting longer than
an hour.

III. AGREEMENT
1. The basis of hiring the floating crane “Maja” is “The agreement for hiring the floating crane “Maja”
prepared by the Polskie Ratownictwo Okrętowe w prywatyzacji and signed by both parties.
2. Period of the crane’s work included in the agreement has to be fixed with a minimum advance of
24 hours.
3. Polskie Ratownictwo Okrętowe w prywatyzacji reserves right to refuse to accept an order without
giving a reason.
IV. METHOD FOR CALCULATING THE CHARGES
1. Period of the crane’s work is counted from raising the crane’s arm till it is placed down.
2. Charges for period of the crane’s work are assessed for every work hour started in
accordance with the tariff mentioned above.
3. The delivery of crane is taken to mean the totality of actions indispensable in order to reach the
workplace by the crane or a preparing it for work if before commencement of work crane was
situated at the same place.
4. Charges for every work hour started, for delivery of the crane and demurrage payment
cannot be divided into parts.
5. Period of the crane’s awaiting work begins at the moment of mooring of the crane on the
quay mentioned in the agreement, however not earlier than at the hour established in
the agreement.
6. All demurrage before commencement of work or at work not caused by Polskie Ratownictwo
Okrętowe w prywatyzacji will be regarded as work time or demurrage fee.
7. The weight of cargo is regarded as the gross weight i.e. the weight of cargo with a lift
equipment, package and other elements lifted with the cargo. The weight of
lifts is fixed according to indications of the counter installed on the crane.
8. The time necessary to install, change, taking off the lifting equipment is calculated as a
period of crane’s work.
9. In case of the crane’s work at weights from different weight sections mentioned in a Table of
Charges, the charges will be assessed in proportion to the time of involvement in cargoes from a
given weight limit (with regard to clauses 2 and 4 this part) and the moment of changing the
weight section will be regarded as the moment of removing a lifting sling from a crane hook or
disconnecting of shackles if slings stay unchanged.
V. INVOICE
1. the euro exchange rate included in the invoice for the service rendered is the average exchange

rate NBP current on the day preceding the date of service.
2. The basis for issuing an invoice for a service is “The agreement for hiring the floating crane
“Maja” or “The receipt for work done by the floating crane “Maja”.
VI. PAYMENTS
1. If the parties do not agree otherwise, a valid due date for services performed by Polskie
Ratownictwo Okrętowe w prywatyzacji is 14 calendar days from the date of issuing an invoice.
The due date is the day of money coming into the account of Polskie Ratownictwo Okrętowe w
prywatyzacji.
2. Arrears in the payment of duties resulting from an invoice Polskie Ratownictwo Okrętowe w
prywatyzacji will charge the statutory interest
3. In duly justified cases, the Polskie Ratownictwo Okrętowe w prywatyzacji may require the
Charterers prepayments on the ordered service.
VII. CONDITIONS OF HIRING THE CRANE
1. Polskie Ratownictwo Okrętowe w prywatyzacji hires the floating crane to do transshipment work
which the Charterer shall carry at its cost and its risk. The Charterer is responsible for all
damages, costs and expenses, caused by the crane.
2. The risk resulting from the possibility of adverse weather conditions, including the risk of incurring
additional costs caused directly or indirectly by these conditions shall be debited to the Charterer
3. Rates mentioned in the table include the charge for hiring the crane with a crew and fuel, oils and
equipment accessible on board.
4. The floating crane works according to a plan of transshipment works prepared by a Charterer. In
the case of its absence, the Charterer shall bear the risk of the execution of trans-shipment in a
manner inconsistent to his instructions.
5. Polskie Ratownictwo Okrętowe w prywatyzacji hires the crane to work with equipment accessible
on the crane’s deck and being his property. In case of necessity of using other or additional
equipment such as shackles, roped, sling, beams, dynamometers etc. a Charterer prepares it
himself and at his expense, and presents it to be accepted by the captain before transshipping
starts.
6. A Charterer prepares and incurs costs of getting permission and documents, fares indispensable
to perform transshipment activities such as: harbor charges (with the exception of tonnage dues in
Gdansk and Gdynia harbors), quay charges, charges for bridges, and other fares indispensable to
perform transshipment activities or the stoppage of the crane after carrying out work when a
departure of the crane from the quay is impossible for the reasons independent of Polskie
Ratownictwo Okrętowe w prywatyzacji.
7. The crane cannot work:
- if the sea state exceeds 3

- if the wind power exceeds 10m/s
- in the case of insufficient lighting of a workplace
- in a place in which icing occurs
- if cargo weights together with the outreach and height of lifting exceed safe parameters of the
crane.
With regard to people’s safety, cargo and the crane, the Captain has a right to impose additional
limitation and demands concerning crane’s work.
8. In case of icing occurring in a place where the crane works or in a way between a place where
the crane stays and the place where the crane works, a Charterer will provide tugboat services at
his expense if the Captain of the crane or Polskie Ratownictwo Okrętowe w prywatyzacji
demands it.
9. A Charterer is held responsible for work carried out outboard of the crane. Crane’s crew can work
only on board of the crane and must not carried out work on heights.
10. In case of exceeding safe parameters of the crane, transshipment will be immediately stopped.
VIII. SUPPLYING THE CRANE
1. In case of no possibilities of taking up work on the date fixed in the agreement, work will be taken
up on the first date of the crane’s accessibility making other records of this Tariff, Terms and
Conditions of Hiring the Floating Crane “Maja” applicable.
2. Polskie ratownictwo Okrętowe w prywatyzacji is not responsible for effects which may result from
not supplying the crane in a fixed date or place.
Any deviation from foregoing terms and conditions are possible only at the consent of Polskie
Ratownictwo Okrętowe w prywatyzacji and the Captain of the crane.
