Szanowni Państwo,
Pragniemy Państwa poinformować, Ŝe w sprawie T-183/07, Rzeczpospolita Polska
przeciwko Komisji Europejskiej w przedmiocie krajowego planu rozdziału uprawnień do
emisji gazów cieplarnianych zgłoszonego przez Polskę na lata 2008–2012 zgodnie
z dyrektywą 2003/87/WE Parlamentu Europejskiego i Rady, Trybunał sprawiedliwości
Wspólnot Europejskich w pierwszej instancji wydał w dniu 23 września 2009 roku wyrok
stwierdzający niewaŜność decyzji Komisji Europejskiej zmniejszającej o 76,132937
MteqCO2 całkowitą roczną ilość uprawnień do emisji gazów cieplarnianych przewidzianą
w Krajowym Planie Rozdziału Uprawnień i ustalającej tę ilość na poziomie
208,515395 MteCO2.

We are pleased to inform you that in the case T-183/07, Republic of Poland against the
European Commission, in the subject of the national allocation plan for the allocation of
greenhouse gas emission allowances notified by Poland for the period from 2008 to 2012
in accordance with Directive 2003/87/EC of the European Parliament and of the Council,
the Court of Justice of the European Communities in the first instance gave a judgment
on the 23 September 2009 declaring the decision of the European Commission reducing
the total annual quantity of allowances by 76.132937 million tones of CO2 equivalent and
fixing the ceiling at 208.515395 million tones of CO2 equivalent invalid.

Nous avons le plaisir de vous informer que, dans l'affaire T-183/07 opposant la
République de Pologne à la Commission Européenne concernant les plans nationaux
d'allocations de quotas d'émission de gaz à effet de serre notifiés à la Commission par la
Pologne pour la période allant de 2008 à 2012, la Cour de Justice des Communautés
Européennes a rendu le 23 septembre 2009 un jugement en 1ère instance. Se
conformant aux dispositions de la Directive 2003/87/CE du Parlement Européen et du
Conseil, la Cour a annulé la décision de la Commission Européenne qui imposait la
réduction de la quantité totale de quotas d'émission de 76,132937 millions de tonnes
d'équivalent CO2, fixant ainsi le plafond d'émission d'aquivalent CO2 à 208,515395
millions de tonnes.
