DESIGN MASCOT ZWM CARBONEX
§1
General Provisions
1. The competition is organized Dariusz Przestrzelski conducting business under the name Zakład Wyrobów
Metalowych CARBONEX, NIP 6330012877, ID 271976484 located in the Jastrzębie-Zdrój 44-336,
Pszczyńska street 420.
2. The aim of the competition is to select the best design mascot ZWM CARBONEX
3. The theme of the competition is to design a mascot for ZWM CARBONEX
4. The competition takes place from 01.01.2014 - 28.02.2014.
§2
Entrants
1. The competition is open, is addressed to all citizens of the Republic of Poland.
2. People taking part in the competition are required to attach the signed application form (Appendix 1). Minors
participating in the competition must attach the written consent of parents or guardians to participate in the
competition (Appendix 2 of the Regulations) and signed by the legal representative of the application form.
3. Participation in the competition is free and completely voluntary.
4. Taking part in the contest participants agree to the rules of the Competition and accept the Terms.
§3
Award
1. Organizer provides prizes for the first three places.
1.1. First place: Laptop 15.6 "ASUS i5-3317U/12GB/500/DVD RW/Win8
1.2. Second place: Tablet 8 "Apple iPad Mini 16GB
1.3. Third place: compact camera, the Nikon Coolpix L820
2. Prize is taxable under the general rules.
3. The organizer reserves the right not to award prizes due to the low level of work submitted to the competition.
§4
The Jury
1. Competition is a one-step.
2. The work will be assessed by the Selection Committee appointed by the Organizer.
3. The Competition Committee will decide on the winners.
4. The decision of the Competition Commission is final and is not entitled to right to appeal.
§5
The rules of participation in the contest
1. In the competition will not be taken into account the work of without a proposal.
2. Any technique of work (crayons, paint, markers, pastels, mock mascot, embroidery, project on computer).
3. Each participant has the right to submit one work done independently and individually (collective works will
not be taken into account).
4. The subject of work should be linked to the activities of ZWM CARBONEX.
5. Evaluation criteria:
- Mascot must be unique, original, easy to recognize and remember,
- An attractive souvenir - gift for both children and adults.
6. On the back of the project must be the information: Name and surname of author, address and phone number.
Minors participating in the competition must attach the written consent of parents or guardians to participate
in the competition. (Appendix 2 of the Regulations).
7. The organizer is not responsible for administration of for Participant wrong address, or other data that prevent
its identification.

8. Participant by sending the application form to the Competition confirms that the project is a original, is the
result of his personal creativity, does not affect the rights, property and dignity of third parties and that owns
the copyright and the rights are not limited or encumbered to third parties.
§6
Time and manner for submission of projects
1. Works can be submitted until 28.02.2014.
2. To draft must be accompanied by:
- An application form containing data participant: name, surname, and if necessary written consent of parents
or guardians to participate in the competition. (Attachments: 1 and 2 of the Regulations).
3. Projects with all documentation must be submitted or sent to:

§7
Announcement of the results of the Competition
1. The results will be announced on 10.03.2014.
2. Winner will be notified by mail and telephone.
3. The official award ceremony will be held on 24.03.2014.
4. The condition for the receipt by the Participant (Laureate) prizes is the conclusion of an agreement with the
organizer, the content of which is attached as Appendix 3 to these Rules.
§8
Ownership
1. Notification of work for the Competition means at the same time that the applicant declares that the work
does not infringe the rights of third parties, in particular without prejudice to their personal and property
rights. In the case of a third party claim arising from the violation of the rights mentioned above, project
applicant, is responsible for the violation and will compensate the incurred costs in connection with the
referral compensation claims against Organizer, freeing the Organizer from any obligations which arise in
this respect.
Participation in the competition is tantamount to consent by the Laureate to transfer on Zakład Wyrobów
Metalowych CARBONEX rights copyrights within the meaning of the Act of February 4th, 1994 on
Copyright and Related Rights ( consolidated text, Journal of 2006 No. 90, item . 631 , with amended) to
graphic design mascot in all fields of exploitation and on the exercise of rights dependent.
2. Contest Participant (Winner) transferred on the organizer, in terms of unlimited territorially and for an
indefinite period copyrights to his work in the following fields of exploitation:
- In terms of production - mascot production, and consolidate its image by any technique and any number of
copies,
- In terms of turnover of the original or copies of the mascot,
- Marketing, lending, rent the original or copies, licensing, mascot to the public in such a way that everyone
can have access to it in a place and at a time individually chosen by them.
Competition Participant (Winner) authorizes the Organizer to:
- Decide to first public dissemination notified project,
- Carried out the author's supervision before distributing.
3. Contest Participant (Winner), if you select by the Competition Commission performed by him work
undertakes not to exercise for an indefinite period in relation to the Organizer moral rights relating to the
work sent to the Organizer, including undertakes to not interfere in the way of using Labor by the Organizer,
who will be able to use the song in its entirety, as well as parts in the form of arbitrary fragments.
4. Contest Participant (Winner) agrees to make the possible modifications his work, respecting its original
form, in order to effectively use. In particular, Zakład Wyrobów Metalowych CARBONEX reserves the
right to change color or fine detail as to better match the materials to the mascot.
5. The project, winning in the competition become the property of the organizer.
6. The transfer of rights on Organizer to the winning projects will regulate a separate agreement. (Appendix 3).

§9
Final Provisions
1. The notification to the Competition work is tantamount to accepting the conditions of these Rules.
2. Participation in the competition is tantamount to consent to: the use of participant's personal data in
accordance with the provisions of the Act of August 29, 1997 on the protection of personal data unless such
data will be disclosed in the course of the competition.
3. In accordance with Art. 24 paragraph. 1 dated August 29, 1997. about Data Protection
(Journal of Laws of 2002. Nr101, poz.926 with later Amended). organizer competition announces that their
personal data will be stored and processed on the basis of freely expressed consent of the participant, at the
headquarters of the organizer, only in connection with implementation of these Regulations.
4. Each participant has the right to inspect their data and correct them.
5. The organizer reserves the right to disqualify if the work requirements do not meet the Regulations.
6. The organizer does not returns the work involved in the competition, work disqualified, as well as excluded
from it.
7. The organizer reserves the right to a free presentation and publication of all works submitted to the contest for
promotional purposes.
8. The organizer reserves that for the published the work may be accompanied by information about the author.
9. The organizer reserves the right to terminate, amend or extend the contest in the event of reasons beyond his
control.
10. Organizer shall have the right to cancel the contest for any reason.

Administrator is within the meaning of the Act on the Protection of Personal Data, a database

other publications or materials relating to the Contest, and otherwise making give publicly information

b) Undertakes to not exercise with respect to the Organizer moral rights with respect to drawn by the
Participant (Laureate) work.
c) Grant the authorization (license) to multiple, free and unlimited in time and to the territory of the use
of the project and its publication.

hereinafter referred to as: "Zakład Wyrobów Metalowych CARBONEX"
Together hereinafter referred to as "Party"
Given that:
Author participated in the contest "Design mascot ZWM CARBONEX" organized by the Zakład
Wyrobów Metalowych CARBONEX, as described in the Rules of the competition. The author, in
accordance with the Regulations, if you win the contest, promised to move to the Zakład Wyrobów
Metalowych CARBONEX, as the organizer, author's economic rights to the project.
The Parties agree to conclude the Agreement as follows:

§1
1. The author declares that at the time of signing the agreement give copyrights to the project on
Zakład Wyrobów Metalowych CARBONEX to those described in this agreement operational
fields.
2. The Parties confirm that the project is a work within the meaning of the Act of February 4, 1994.
about copyright and related rights (Journal of Laws of 2006 No. 90, item. 631, as amended.) and
shall be protected.
3. The transfer of copyright to the project occurs for each field exploitation, including the
remuneration for which the Parties recognize the prize described in § 3. 1.1 Regulations.
4. The author declares that the payment of remuneration referred to in paragraph 3 rids claims against
the Zakład Wyrobów Metalowych CARBONEX due to the transfer of property rights the copyright
to the project, and grant an exclusive license.
§2
1. The author declares that he is the sole creator of the project, and that performed him personally.
2. The author ensures that he is entitled to exclusive and unlimited personal and property rights to the
project.
3. The author declares that in relation to transferred on the Zakład Wyrobów Metalowych
CARBONEX copyright property rights to the project did not grant any license to use the project,
both in the form of the sent to the Zakład Wyrobów Metalowych CARBONEX as Organizer and
modified. The author agrees not to impose copyright property rights to the project.
4. The use by the Zakład Wyrobów Metalowych CARBONEX author's economic rights to the project
can not in any way infringe the personal rights author.
5. The author declares that the project and the associated copyrights are not encumbered with claim or
rights of third parties, in particular declares that they do not infringe the copyright of third parties.
The author confirms that from the date of this Agreement shall not be entitled to make statements
and making any regulations and burdens described above author's economic rights to the project.
§3
1. The author declares that under the conditions indicated in § 1 and 2 full copyrights to the project
entitled Zakład Wyrobów Metalowych CARBONEX, particularly on the following fields of
exploitation:
- fixation,
- use,
- distribution,
- modification,
- adjustment
- permanent duplication and permanent reproduction by any methods and techniques,
- marketing
- introduction to computer memory
- publish and publicly display,
- lease,
- lending,
- granting license to use,
- use in the publications in the form of a vision granted by any the media,
- sales.
2. Transfer of copyrights related to a project in the state in which was in day of its receipt by the
Zakład Wyrobów Metalowych CARBONEX, in accordance with the provisions of the Agreement
and the Regulations.
3. The parties agree that at the time of signing the Agreement the exclusive copyright to the project has
Zakład Wyrobów Metalowych CARBONEX.

4. With the conclusion of this Agreement, author loses the exclusive right to on authorize execution
rights to design, at the same time declares that only authorized to make such declarations of intent
is Zakład Wyrobów Metalowych CARBONEX.
5. The author undertakes not to execute indefinitely in relation to the Zakład Wyrobów Metalowych
CARBONEX moral rights relating to the project, including undertakes to no interfere in the way of
using the project by Zakład Wyrobów Metalowych CARBONEX, who will be able to use the song
in its entirety, as well as parts in the form of arbitrary fragments.
§4
The parties agree that the Zakład Wyrobów Metalowych CARBONEX in case of failure by the Author
conditions and obligations described in § 2 and § 3. 4 will be entitled to claim compensation.
§5
1. The contract shall be concluded in writing.
2. All changes and additions Contract can be made with the consent of the Parties in the form of
writing under pain of nullity.
3. The Agreement shall enter into force upon its signing by the Parties.
§6
For matters not covered by this Agreement, and concerns the object, regulate the provisions of the Act
of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 1994, No. 24, item. 83, as
amended). And the provisions of the Civil Code.
§7
Disputes arising in connection with the execution of this Agreement, the Parties shall settle amicably,
and in case no agreement is reached, they will be put to the settlement by common court competent for
the registered office of the Zakład Wyrobów Metalowych CARBONEX.
§8
The agreement was drawn up in two identical copies, one for each Party.
