INTRODUCTION
The sixth volume of Wrocławskie Studia Erazmiańskie is entitled Justice
and the Law. It contains thirteen articles, presenting the reader with the
subject matter of mutual relations between law and justice – the most
important categories for any lawyer. One may assume with a large degree of certainty that, today, in the age of complete post-deconstruction
(whatever this term may stand for), these categories are not synonymous.
Nonetheless, despite great confusion among terms every one of us is still
able to recognize when we are treated unfairly. Thus, the assumption that
the just nature of the law may continue to fascinate many readers seems
well-founded.
In light of the above, the undertaking of an ever-valid study on the
mutual relations between the law and justice does not lack merit. The
volume opens with an analysis of Ancient Greek reflections on power,
law, and justice according to Homer, reconstructed by Tomasz Scheffler.
Subsequently, Małgorzata and Artur Łuszczyńscy raise the question of
the perception of just law in medieval thought. Piotr Szymaniec, meanwhile, presents little known ways of perceiving justice in the law of nations at the turn of the nineteenth century, as espoused by Hieronim
Stroynowski and Feliks Słotwiński.
Afterward, Michał Rupniewski examines John Rawls’ theory of justice, which is already considered a classic. Paweł Sydor, on the other
hand, takes on the ideas of justice and law advocated by one of the intellectual celebrities at the turn of the century. Ted Lewandowski follows
with an analysis of retributive justice in Florida’s statutory law, while
Marek Niedużak makes matters of procedural justice the subject of his
examination. Next, Aleksandra Spychalska turns her attention to the

preference between justice and economic efficiency of the law in the
context of legal solutions adopted after the Rwandan genocide of 1994
– a sensitive subject from the point of view of justice and the law. The
conclusions she draws may be hard to accept, but their logical coherence
and consistency on the grounds of the accepted methodological assumptions cannot be denied. Iwona Sierpowska then conducts an analysis of
two fundamental principles of social assistance, namely social justice and
equality. The article by Monika Dimitrowa concerns the phenomenon
of migration in the context of integration and justice from the Italian
perspective. Her reflections correspond, at least geographically, to the
piece authored by Davide Artico, which presents the concept of justice
in Italian literature. Subsequently, Magdalena Buss’s article brings us to
the world of magical fairy tales in order to demonstrate their portrayal
of justice. The volume concludes with a personal essay penned by Artur
Ławniczak, who by means of rhetorical exposition attempts to convince
the reader that Justice of the Historical Law of Defeat can reach even the
greatest imperial projects.
