Information on the Irish market Current as of August 2003 IRELAND Regulation Supervision and regulation of intermediaries is provided for in the "Insurance Act, 2000". Registration The Insurance Act 2000 requires all insurance intermediaries to be registered/authorised by IFSRA (Irish Financial Services Regulatory Authority). Qualifications Not legally required. Are required by IBA (Irish Brokers Association). Professional indemnity insurance Though IFSRA has the legal power to make PI compulsory it has not done so as yet. It has asked for and received details of the PI held by all intermediaries and will as required make it compulsory as it implements the provisions of the IMD (Insurance Mediation Directive). IBA requires members to have PI. Recommended minimum PI for IBA members is 1.5 million Euros. Financial guarantees The "Investor Compensation Act, 1998", transposed the Investor Compensation Directive into Irish Law. All insurance intermediaries, deposit agents, investment intermediaries, stockbrokers and fund managers are required to contribute to compensation funds established under the legislation which will provide a maximum of 20 000 Euros on 90% of the loss whichever is the lessor, to each "eligible investor". In addition to the above all members of the IBA are bonded for 200,000 Euros with an inner limit of 65,000 Euros per claimant. Future The IMD will be transposed into Irish law late in 2004. The current legislative requirements already fulfil nearly all of the requirements. IRELAND 2550 Insurance Intermediaries are "Registered with IFSRA", broken down as follows: 1660 Restricted Activity Investment Product Intermediaries (RAIPI) sometimes referred to as Multi Agency Intermediaries (MAI). 240 Credit Unions 650 Authorised Advisors (AA). Note: 1. Tied agents are not required to register if an insurance undertaking takes full and unconditional responsibility for their activities. 2. Gwarancje finansowe Dyrektywa Odszkodowań dla Inwestorów stała się Irlandzką Ustawą. Wszyscy pośrednicy ubezpieczeniowi, agenci depozytowi, pośrednicy inwestycyjni, maklerzy giełdowi i menedżerowie funduszy są zobowiązani do uczestniczenia w funduszu gwarancyjnym, ustanowionym prawnie, z możliwością uzyskania odszkodowania maksymalnie 20 000, ale nie więcej niż 90% straty, dla każdego wybranego inwestora. Co więcej, wszyscy członkowie IBA są zobowiązani do posiadania obligacji € 200 000, z wewnętrznym limitem € 65 000 na jednego zgłaszającego szkodę. IMD została wprowadzona 14 stycznia 2005 roku. Kodeks postępowania Dobrowolny kodeks postępowania został opracowany z akceptacją Departamentu Przedsiębiorstw, Handlu i Zatrudnienia. Kodeks reguluje zachowanie się pośredników zarówno w sektorze life, jak i non-life. IFSRA zarejestrowała 2550 pośredników ubezpieczeniowych, w następujący sposób : 1660 - RAIPI (multiagencje) 240 - Związki kredytowe 650 - Autoryzowani Doradcy (AA) (agenci zależni nie muszą się rejestrować, jeśli ubezpieczyciel bierze za nich odpowiedzialność. Dlatego RAIPI oraz doradcy AA praktycznie są brokerami). Brokerzy - udział w rynku : - non-life : 70%, life : 50% Agenci - non-life : 1% life : 24%
