WRÓBLEWSKI Uniwersytet Warszawski ŹRÓDŁA UPRAWNIEŃ PREZYDENTA STANÓW ZJEDNOCZONYCH W POLITYCE ZAGRANICZNEJ W ŚWIETLE KSZTAŁTOWANIA SIĘ INSTYTUCJI JUDICIAL REVIEW ABSTRACT The problems and controversies surrounding the role of the American president in foreign policy have accompanied the evolution of the political system in the United States from the very beginning. The purpose of this article is to identify the main factors (sources) responsible for the accumulation of presidential influence which resulted in accusations being voiced by a growing number of critics against the alleged threat of an imperial presidency. The first part of the paper focuses on the circumstances of the Constitutional Convention and, specifically, the nature of the ambiguity contained within article I of the Constitution as the source of the potentially wide powers of the president in the field of foreign affairs. The second part examines the traditional methods of constitutional interpretation and its impact upon the strengthening of the presidential position within the framework of the government’s foreign policy mechanisms. By evoking important facts from constitutional history, such as the bank debate of 1791 or a discourse between Helvidius and Pacificus of 1793, the author documents the emergence of two critical doctrines which played a pivotal role in an expansive interpretation of the constitution and subsequent justification of assertive power waging. The doctrine of implied powers and the doctrine of inherent powers, which received constitutional sanction from the Supreme Court, still serve as a prop for assertions of the extra-constitutional powers of American presidents. AR TYKUŁY ZAGADNIENIA USTROJOWE Marko HERNAIZ Uniwersytet Opolski KONSTYTUCYJNE PODSTAWY HISZPAŃSKIEGO SYSTEMU WSPÓLNOT AUTONOMICZNYCH ABSTRACT The establishment of democracy in Spain represented a long-waited conquest of freedom, after nearly 40 years of dictatorial rule under General Francisco Franco. The Spanish Constitution, born on 27 of December 1978, has designed an ambitious and complicated system of regional self-governance. Spanish autonomy level is one of the most developed in Europe, inscribing itself into the well known idea of the Europe of the Regions. The System of Autonomic Communities had also another important role to be played in the dramatic social and political history of Iberian Peninsula. The most important aim of the creators of the Spanish constitution was to establish a democratic, constitutional monarchy. A second objective was to facilitate Spain’s full engagement with the European Community. Those two aims were an interesting and necessary background to deal with the third one – the problem of the destabilizing and difficult to administrate Spanish regions and nationalities. This article examines the almost thirty year old Constitution and other elements of the Spanish political system, particularly the most interesting mechanism of Autonomous Regions and its competences in relation to the state, themselves and other levels of administration, like provinces and municipalities. The Last part of the work describes the financing system of the autonomies, which is generally contained in a law of 1980 (LOFCA) which has subsequently been modified. For the sake of their assignment, and because of their capabilities (in particular the application of violence) proper control over the military is required as well as suitable, long-term policy. This article examines the most significant issues affecting the role of military forces in the contemporary state, using the example of Poland. The basic aim of the article is to show that all the branches of power (especially the executive) are responsible for military affairs as the raison d’etat. The military forces’ underlying internal and external functions and requirements of civil, democratic control are considered. With reference to the Republic of Poland, the particular branches of the government’s power and responsibilities in military and defence policy (during peace, crisis and war) are described. A constitutional rank of these regulations and other legal solutions (including some weaknesses) are stressed. Furthermore, the issue of the General Staff as an institution between administration, military and politics is presented as an example of the difficulty of reforming Poland’s Military Forces. The author discusses these issues in an interdisciplinary way, including conflict management, history, political sciences and culture. The article begins with an historical and political analysis of the background in Palestine, and reveals factors that caused the conflict. The analysis examines predominant ideas (Zionism and Arab nationalism) and revolves the status of international documents and political statements, which strongly influenced the Middle East situation at the time. The author emphasizes Great Britain’s colonial policy, its mistakes and maladjustment. The cultural background of this conflict is also considered, in particular the clash of the hermetic Arabic and Jewish cultures which became one of the most important factors resulting in conflict development. This many-sided analysis should become a datum-point in searching for the best means of resolving the conflict, acceptable by both sides. However, the core of the article examines the new challenges faced by the labour movement in the system of the European Union. The legal paradigm of the EU and the new mechanisms in its decision-making process led to changes in legal competency, but also created new co-relations within the institutional frames, to which the trade unions are anchored. The European Union’s labour movement, according to the main thesis, will need to adjust itself to the new patterns of economic, technological, legislative and labour market’s changes. Its major premise is that the challenges can influence the shape of the decisions taken in the fields compatible to the interests to trade unions. Included in those are lobbying issues, social dialogue, or globalization. Particular to those issues are also the challenges coinciding with the process of EU enlargement. It is argued that the influences and the spectrum of actions of interested sides and organizations will be both: modified and modifying the political systems of the member states and candidate states to the EU. The Agency’s primary role is to provide substantive support in the field of fundamental rights to the EU’ institutions and the Member States in the implementation of the Community’s legislation. The Agency was set up in lieu of the European Monitoring Centre on Racism and Xenophobia (EUMC), and has taken over the majority of its competencies. Compared to the EUMC, the scope of the Agency’s responsibilities has been broadened; however, it shall obtain the full capacity to implement the responsibilities stemming from its mandate starting with 2008. The purpose of the article is to pinpoint the opportunities and the risks ahead of this newly established agency. The article is also considering whether the FRA has any chance of exerting any marked influence upon the observance of fundamental rights among the EU Members States. It attempts to answer the question whether the agency‘s limited mandate would not pose an obstacle in achieving its goals effectively. The article also analyses the history of the FRA’s establishment. The agency’s new responsibilities and institutional framework have also been presented and the agency’s tasks and scope of activity have been discussed. The article touches upon the issue of the FRA’s liaison with international organisations involved in the diverse aspects of human rights. Possible reforms are considered in the final part of the article that in long-run would have contributed to streamlining the FRA’s working and could become a significant and effective policy instrument for respecting the EU’s fundamental rights. AR TYKUŁY PROBLEMY TOŻSAMOŚCI ZBIOROWYCH Urszula DRZEWIECKA Uniwersytet Jagielloński TOŻSAMOŚĆ PÓŁNOCNOAMERYKAŃSKA 1 ABSTRACT Nowadays, in the decade of intense integration, the continent of North America faces a great challenge to create a common supranational space, not only in the economic sense, but also in its socio-cultural aspect. This phenomena is favoured by the integration process which, in spite of the overwhelming development differences between all three countries, has already been initiated and is constantly proceeding on the basis of firm economic and political fundaments. These fundaments guarantee the economic advance and assure the maintenance of democratic and safety principles in the region. However, apart from these pragmatic reasons, integration aspirations are more often determined by the socio-cultural factors that directly affect the identity of the continental inhabitants. Cultural globalization and commercialization influence the expansion of the common identity and the cultural space. The increasing number of migration movements, mainly the case of Mexicans emigrating to the USA, becomes a significant factor in the creation of the supraregional identity. Intensification of the supranational contacts leads to the adoption of a multi pattern style of life, that translates into multi level identity (transnationalism). Borderlands, that constitute buffers and bridges between nations, play an important role in the creation of a PanAmerican space. A noticeable increase in the convergence of American, Canadian and Mexican values assumes the universalisation of some behaviours that, in consequence, will lead to the creation of a common set of values. Improving mutual perceptions as well as the emerging sense of belonging to a broader region that crosses the traditional country borders, positively influence this process. Problems faced by North America, nowadays, cannot be addressed properly without a sense of community. Due to this, the creation of new supranational institutions that would coordinate policy and integration processes seems to be indispensable. North American identity seems to be the answer to the necessary transformation of the existing socio-political structures, as well as the redefinition of the citizens’ position in the new changing reality. Różne ludy świata wykazują tendencję do coraz silniejszego mieszania się między sobą, aż do stworzenia nowego typu człowieka, łączącego w sobie elementy poszczególnych społeczności. José Vasconcelos 19252 P o zakończeniu zimnej wojny społeczeństwa Ameryki Północnej weszły w nową fazę wzajemnych relacji. Dotychczasowa postawa, oparta na przeciwstawianiu się wspólnemu zagrożeniu, jakim określano w owym czasie komunizm, zakładała niekwestionowaną dominację USA w całej Ameryce Północnej, Środkowej i Południowej (z wyjątkiem Kuby)3. Zmiany zapoczątkowane w roku 1989 spowodowały redefinicję polityki międzyamerykańskiej, która wprowadziła do wzajemnych relacji między państwami zasady o charakterze bardziej demokratycznym i liberalnym. W Ameryce Północnej wyraziło się to znacznym pogłębieniem integracji polityczno-gospodarczej oraz wzrostem interakcji społeczno-kulturowych. Efektywność, konkurencja, wolność jednostki, adaptacja nowych rozwiązań technologicznych, które legły u podstaw jednoczenia gospodarek USA, Kanady i Meksyku4, stały się także decydującymi czynnikami w kontekście zmian tożsamościowo-kulturowych. Dynamika wzajemnych kontaktów społeczno-gospodarczych pociągnęła za sobą nie tylko ewolucję sposobu indywidualnego samopostrzegania, lecz także znalazła swój wyraz w kształtowaniu nowego zjawiska, jakim stało się kreowanie tożsamości kontynentalnej ponad wyraźnymi antagonizmami i podziałami natury etnicznej, politycznej, społecznej czy kulturowej przestrzeni Ameryki Północnej. Tożsamość północnoamerykańska jest zjawiskiem bardzo świeżym i choć jeszcze nie w pełni zdefiniowanym, to już zauważalnym. Rodzi się ona w kontekście indywidualnych i narodowych identyfikacji obywateli poszczególnych krajów, stając się ich wyraźnym uzupełnieniem, niezbędnym w dobie globalizacji. Przeciwstawiła im się jedynie Kuba, objęta w konsekwencji embargiem. Mowa o NAFTA (North American Free Trade Area), Północnoamerykańskiej Strefie Wolnego Handlu. AR TYKUŁY PROBLEMY TOŻSAMOŚCI ZBIOROWYCH Tadeusz KOPYŚ Uniwersytet Jagielloński FENOMEN SZKOCKIEGO NACJONALIZMU ABSTRACT The 1707 incorporation of Scotland into Great Britain was not something a united Scotland agreed quietly upon. There was, in particular, a strong division between the interests of the Highlands and Lowlands, the former feeling very much forced into an unwanted union. After the final, failed Jacobite rebellion of 1745 the Catholic Highlanders were forced to succumb to the superior English power. During the 19th century in Scottish history, Scotland undergoes a lot of domestic changes, various reform acts and, finally, the industrial revolution spanning over a period of 134 years (1780-1914). The industrial changes that did take place further stimulated the growth of nationalism. But in this period Scots used a British Empire as a own “invisible mothercountry” and in the whole 19th century a strong sense of a Scottish national identity within the Union had developed. The period 1914-1960 in connection with almost any European nation was a time of crisis in British colonialism and than at the beginning of 70’ties energetic problems in the world. In the early 1970s the SNP enjoyed some shortlived electoral success, especially as the flow of North Sea oil increased support for Scottish independence. Campaigning for the October 1974 election on the slogan “It’s Scotland’s oil!, ” the SNP managed to mobilize a sense of economic grievance and cultural resentment that cut across the traditional class divisions of Scottish politics. Szkocja w dziejach kształtowania się nowoczesnej świadomości narodowej zajmuje miejsce szczególne. Podczas gdy w całej Europie, od Bałkanów po Skandynawię, AR TYKUŁY PROBLEMY TOŻSAMOŚCI ZBIOROWYCH Paweł ŚCIGAJ Uniwersytet Jagielloński NARÓD, NACJONALIZM I TOŻSAMOŚĆ NARODOWA W PERSPEKTYWIE ETNOSYMBOLIZMU ABSTRACT The article is a reconstruction of the basic idea behind the ethnosymbolic conception of nation, national identity and nationalism. It discusses the main assumptions of ethnosymbolism, such as: the need to examine nations in the longue durée perspective, the relations and the combined influence of the past, the present and the vision of the future in the functioning of nations, the modern origins of nations, the cultural basis of ethnic communities and modern nations, the role of myths, symbols and particular ethno-history in the shaping of modern nations, the diversity of ways in which nations are created and the long life of nationalism. The emphasis is put also on the features that allow us to differentiate ethnosymbolism from constructivism and perenialism – the two dominant approaches in the contemporary debate on nations. These issues are analyzed on the basis of the works of the creator of ethnosymbolism – Anthony D. Smith. WPROWADZENIE Problematyka narodu i nacjonalizmu pozostaje przedmiotem sporów od blisko 200 lat. Początkowo ta debata miała charakter raczej etyczny i polityczny aniżeli naukowy, co wyrażało się w ideologicznym uwikłaniu, rzutującym na możliwości eksplanacyjne prezentowanych teorii. Większość dziewiętnastowiecznych studiów naznaczona była narodowym punktem widzenia, mówiącym więcej o politycznych aspiracjach autorów niż o autentycznym stanie rzeczy. I pomimo że w tym okresie upatruje się, głównie w pracach Johna S. Milla czy Lorda Actona, zaczątków współ- AR TYKUŁY MYŚL POLITYCZNA Stanisław ŁOJEK Uniwersytet Jagielloński O RÓWNOŚCI, RYWALIZACJI I CNOCIE ABSTRACT In this paper I make a comparison between two kinds of personal virtue or excellence — one based on a universal model of humanity and the other on what is extraordinary and exceptional in human beings — in order to find out which form of social and political regime is best suited to each of them. Following Arendt and de Tocqueville, I argue that only through practising the “aristocratic” type of virtue — described in Aristotle’s Nicomachean Ethics — we can establish and support a regime in which, like in the Grek isonomia, the division between the rulers and the ruled doesn’t exist. By promoting another model of virtue, on the other hand, the one which can be universalized, we make necessary exactly this kind of political division, which — though today we tend to think of it as natural — is probably not inevitable, and surely considerably reduces the sphere of authentic freedom. P olitycznej filozofii Arystotelesa nie sposób zrozumieć bez zapoznania się z jego teorią etyczną. On sam uważa zbiór traktatów noszący tytuł Polityka za realizującą program Etyki nikomachejskiej kontynuację1, zaś w samej Polityce oznajmia, że wspólnota państwowa winna nade wszystko troszczyć się nie tyle o życie, co o życie szlachetne2. Nazywając człowieka „zwierzęciem politycznym”, Arystoteles w zasadzie wyjaśnia już, dlaczego polityka powinna być zależna od etyki. Skoro dociekania etyczne są praktycznymi dociekaniami nad tym, jak wieść dobre życie, i skoro człowiek, ze względu na swą naturę, może zrealizować ów cel, jedynie żyjąc w obrębie politycznej społeczności, to polityka musi zostać podporządkowana etyce, musi stwarzać odpowiednie warunki do realizacji etycznego celu, jakim jest życie szlachetne. 1 2 Arystoteles, Etyka nikomachejska, przeł. i oprac. AR TYKUŁY MYŚL POLITYCZNA Dariusz GRZYBEK Uniwersytet Jagielloński KONSERWATYSTA WOBEC EWOLUCJI KAPITALIZMU – POGLĄDY EKONOMICZNE I POLITYCZNE JÓZEFA MILEWSKIEGO ABSTRACT This article attempts to analyze changes in Polish conservative political and economic thought of the late ninetieth-century by the example of nearly forgotten economist and politician Józef Milewski (1859-1916). He was a professor of economics and fiscal policy at the Jagiellonian University and an ambitious politician of the Polish conservative party in the Austrian part of Poland, acting during the era of democratic movement in Austria-Hungary. Milewski analyzed capitalism as a great process demanding even more regulation in international level. As an economist Milewski worked on monetary economics, he formulated quantity theory of money in the form close to the later Irving Fisher’s theory and backed bimetallism as optimal monetary system. Milewski argued that regulation of monetary system is possible world-wide only, through establishing international bimetallistic monetary union stabilizing value of money. He strongly criticized prevailing in his times gold standard as fundamentally unstable. As a social thinker, Milewski analyses laissez-faire as a blind force that crushed traditional social ties, providing inequality, social conflicts and ‘social question’. Although he respected the material progress of capitalist system, he claimed improvement in social system – strengthening position of workers in wage bargaining and establishing social security system. However, as a political thinker he backed traditional political elites (aristocracy and great landowners, catholic clergy etc.), viewing gradual democratization of voting law acceptable in the long run. In Milewski’s opinion, parliamentary system in his times was in great crisis, disrupted by contradictory tendencies of interest groups. He expected that the reinforcement of 238 Dariusz Grzybek POLITEJA 1(9)/2008 parliamentarism would be a result of a long run progress in public enlightenment and the rebuilding and strengthening national solidarity crumbled by laissez-faire capitalism. S zkic poniższy przedstawia analizę poglądów myśliciela podrzędnego, ale reprezentatywnego dla ważnej formacji umysłowej – konserwatystów z przełomu XIX i XX w., usiłujących na nowo sformułować swe główne idee w epoce, w której do głosu doszły masy. Józef Milewski (1859-1916) był profesorem ekonomii i skarbowości Uniwersytetu Jagiellońskiego, a także politykiem związanym z obozem konserwatywnym w Galicji autonomicznej. Jako ekonomista zajmował się głównie kwestiami systemu pieniężnego i polityką fiskalną. Na ogół wtórny i eklektyczny, był jednak pierwszym w dziejach polskiej myśli analitykiem gospodarczej globalizacji1, w swych analizach procesów gospodarczych ujmował rozwój nowoczesnej gospodarki jako wielki proces wymagający coraz większych regulacji na poziomie ponadnarodowym. Jako teoretyk pieniądza Milewski wątpił w automatyczną stabilizację wartości pieniądza w systemie waluty złotej, sądził, że zapewni ją raczej system bimetaliczny (w którym pełnowartościowym pieniądzem są zarówno monety srebrne, jak i złote), o ile zostanie utworzona międzynarodowa unia monetarna, w której ramach powszechnie przyjęto by standard dwukruszcowy. Był on zresztą przekonany, że wiele współczesnych mu problemów można rozwiązać jedynie na poziomie światowym, zwłaszcza działania państwa w zakresie prawa pracy i polityki społecznej wymagałyby międzynarodowej koordynacji, prowadzącej do ustanowienia światowych reguł sprawiedliwego handlu i międzynarodowych standardów polityki społecznej. Był też Milewski pierwszym akademickim ekonomistą polskim, który podjął „kwestię społeczną”, dowodził, że leseferyzm nie wystarcza do przezwyciężenia konfliktów społecznych, opowiedział się za reformami socjalnymi. W swej niechęci do liberalizmu gospodarczego ulegał nostalgii za tradycyjnym społeczeństwem agrarnym, którą łączył z uznaniem potrzeby ostrożnej modernizacji. Milewski pozostawał konserwatystą w polityce, opowiadał się za konserwatyzmem „wiecznych zasad” na poziomie filozoficznym, w sferze kultury uznawał ważność odziedziczonej tradycji, zarazem widział potrzebę przebudowy systemu społecznego. Pisma Milewskiego są umiarkowanie interesujące dla badaczy rozwoju teorii ekonomicznej, pokazują raczej intelektualną zależność uczonych polskich od autorytetów z zachodniej Europy, z kolei dla historyka idei i politologa analiza pism Milewskiego będzie studium ewolucji myśli konserwatywnej pod wpływem procesów modernizacyjnych. Pozwoli ona pokazać, 1 Milewski nie znał samego terminu „globalizacja”, który powstał później i został retrospektywnie zastosowany w odniesieniu do okresu kilkudziesięciu lat przed wybuchem I wojny światowej („pierwsza globalizacja”), wszelako jego interpretacja światowych procesów gospodarczych bliska jest współczesnym opisom globalizacji. NAJWIĘKSZY SPÓR IDEOLOGICZNO-POLITYCZNY OD CZASÓW DREYFUSA? ABSTRACT The outbreak of the Korean War and the Communist threat proved how urgent the need for a European defence organization, which would include German armed forces, had become. The North Atlantic Treaty Organization (NATO), established in Washington in April 1949 ensured the defence of Europe in the Atlantic context but did not solve the problem of German rearmament that the USA had pressed upon its allies. In the summer of 1950 Jean Monnet, General Commissioner of the National Planning Board and the originator of the Schuman Plan put forward an idea to organize European defence on a supranational level comparable to that mentioned in the Schuman proposal. On 27 May 1952 in Paris the members of the European Coal and Steel Community (ECSC) signed the Treaty establishing the European Defence Community (EDC). The attempt to form a European army launched an intense ideological dispute that divided the majority of French political parties. The supporters (the Christian Democrats, the part of Socialists and Radicals) stressed that the European Defence Community would constitute a decisive step in moving towards federal unity in Europe and the best way to prevent a revival of German nationalism. On the other hand, its opponents, mainly the Communists and the Gaullists, argued that it was unacceptable as it would undermine national sovereignty and would leave Great Britain out of a highly strategic European project. Finally, the Treaty establishing 270 Dorota Liszczyk POLITEJA 1(9)/2008 the European Defence Community (EDC) was rejected by the French National Assembly on 30 August 1954 by 319 votes to 264. The ‘crime of 30 August’ created consternation in Western Europe and the United States, and the problem of German rearmament remained unsolved. On 23 October 1954 the Western European Union was established by the Paris Agreements with the incorporation of West Germany and Italy. However, it would not be until 1955, and the Messina Declaration, that the process of European integration could begin once more. S ytuacja międzynarodowa, jaka zrodziła się latem 1950 r., wymusiła rewizję zasad, w oparciu o które budowano dotychczasowy zachodni system bezpieczeństwa i obrony. Wybuch wojny w Korei i amerykańska interwencja na Dalekim Wschodzie stanowiły bezpośrednią przyczynę wszczęcia rozmów na temat zwiększenia zdolności obronnej Europy Zachodniej i tym samym ewentualnego zmobilizowania niemieckiego potencjału militarnego. Ostatnia z przedstawionych kwestii była szczególnie niepokojąca dla francuskich kręgów politycznych, które do tej pory stanowczo odrzucały taką możliwość. W trakcie debaty w Zgromadzeniu Narodowym nad ratyfikacją Traktatu Północnoatlantyckiego francuski minister spraw zagranicznych Robert Schuman stwierdził: Niemcy nie posiadają armii i posiadać jej nie będą. Jest nie do pomyślenia, aby mogły one zostać przyjęte do NATO1. Tymczasem wobec szybkiego postępu wojsk komunistycznych w Korei i groźby rozprzestrzenienia się tego konfliktu Stany Zjednoczone, przy aprobacie pozostałych państw członkowskich NATO, coraz wyraźniej domagały się remilitaryzacji Niemiec. Francja, nie mogąc sobie pozwolić na międzynarodową izolację, stanęła tym samym wobec dylematu: jak pogodzić obawę przed odrodzeniem się niemieckiego militaryzmu z koniecznością podniesienia standardów obronnych Europy Zachodniej. Jedynym sposobem pozwalającym zachować francuskim decydentom kontrolę nad rozwojem wydarzeń, wydawało się przejęcie inicjatywy i przedstawienie optymalnego z punktu widzenia francuskich interesów rozwiązania. W konsekwencji Francja zgłosiła opracowany przez Jeana Monneta projekt, przewidujący odbudowę potencjału militarnego Niemiec, ale w ramach europejskiej organizacji o charakterze obronnym, tak by nie dopuścić do odrodzenia się narodowej armii niemieckiej. Choć wydawać się mogło, że pomysł powołania do życia europejskiej armii stanowić mógł kolejny, naturalny etap budowy wspólnej Europy, faktycznie był on sprzeczny z logiką powziętych planów zjednoczeniowych. Rząd Francji wychodził z założenia, że stopniowa realizacja planu Schumana pozwoli przyzwyczaić się do idei zjednoczonej Europy przed podjęciem tak delikatnych dla państw kwestii, jak wspólna obrona2. In the paper the author contrasts the following models: models of classic democracy and modern ones. The former models are restrictive in that they exclude the privileged and they are very tolerant in the range of power, the latter are characterised by the manifest inclusion of privileged, in other words, they are characterised by a sharing election responsibility with more and more public and common electorate – an increased restrictiveness in equipping privileged with political competence. Responsible authorities must possess proper civic competences, which should embrace not only the knowledge of constitutional mechanisms of exercising power but also an awareness of the consequences connected with making specific political decisions. N ie ulega wątpliwości, że większość obywateli cywilizowanego świata nie wyobraża sobie dziś dobrego państwa, w którym demokracja nie rządzi polityką. Pojęcie demokracji jest jednakże bardzo pojemne i niemal każdy, kto próbuje je definiować, wskazuje inne warunki konieczne do jej zaistnienia. Za jedną z podstawowych przesłanek prawidłowego funkcjonowania ustroju demokratycznego uznaje się istnienie rzeczywistej legitymacji społecznej – szerokiego poparcia rządzonych dla poczynań rządzących. Doświadczenie historyczne uczy jednak, iż nawet niesprawiedliwe, patologiczne i zbrodnicze systemy przez wiele lat mogą cieszyć się legitymacją społeczną (hitleryzm, stalinizm). Należy zatem postawić pytanie, czy nie są potrzebne albo nawet konieczne pewne ograniczenia w procesie udzielania legitymacji społecznej – wyłaniania władzy – i jakie powinny mieć one charakter. Za rodzaj samoograniczania się demokracji może być uznane wprowadzanie standardów aktywności politycznej i wyborczej obywateli, a także elit politycznych. ARGUMENTY NA RZECZ I PRZECIWKO PODDAŃSTWU KOBIET ABSTRACT This article is an attempt to reconstruct J.S. Mill’s and A. de Tocqueville’s attitudes towards the social status of women, especially the reasons, basis and the sense of their dependence. That problem is shown in connection with the idea of democracy expressed by both philosophers. It examines the differences in their opinions about the tendency and shape of social life. Moreover, this article shows, using the example of women’s rights in Europe and America, dissimilarities in understanding of freedom and equality as well as the relationship between them. The author tries to answer the question about the quintessence of liberalism and circumstances which enable defining Mill and Tocqueville as philosophers of liberalism. The phenomenological prism used by the author aims to present a phenomenological perspective, used, even if only on a small scale, in political studies, and pointing out to its practical possibilities. The main emphasis is being placed on understanding the ways and needs for a more pluralistic methodology within the academic fields dealing with politics and society. It is argued that there is a place for more qualitative approach towards the study of political phenomena. As is stated in the premises, it becomes apparent through the comparison of the empirical epistemology with the phenomenological one. According to the author, we must therefore take into account the human need, deeply rooted in conscience, for cognition of itself and its universe which leads to intersubjective understanding and construction of meaning in the dependent political world. Phenomenology is taking those implications into account, thanks to its method, first presented by Edmund Husserl, and used by other philosophers and scholars also today. AR TYKUŁY VARIA Jakub OLECH Uniwersytet Jagielloński DROGI POLSKIEJ CHADECJI W LATACH 1990-2005 ABSTRACT The aim of the article is to depict the history of Polish Christian Democrats from the beginning of the III Republic of Poland until the electoral victory in 2005 of one of the parties, Law and Justice, which is regarded as being Christian Democratic. Two currents of Christian Democrats, which attempted to gain power and support after 1989, are presented. At the beginning of my paper, the origin of the Christian Democratic movement in the world and in Poland, as well as their abundant evolution after the fall of communism, are described. The structures, programmes and history of the parties, which perceive themselves as Christian Democrats are depicted. On one hand, the paper concerns strict Christian Democratic formations, connected with Pawel Laczkowski and Janusz Steinhoff like the Christian Democrats’ Party and The Agreement of Polish Christian Democrats. On the other hand, The Agreement of the Centre and Law and Justice, Jaroslaw and Lech Kaczynski’s parties, perceived as espousing nationalist elements, are presented. The background of the events is the history of the III Republic of Poland, especially the years 1991-1993 and 19972001, when Christian Democrats influenced Polish politics and could entirely present their programmes. The year 1997 is particularly important, because at that time the majority of Polish right-wing politicians, among them Christian Democratic ones, made an effort to unite themselves under the common name Electoral Action of “Solidarity”. After having won the parlamentary election, quarrels within the coalition prevented any stable consolidation of Polish Christian Democrats. AR TYKUŁY VARIA Barbara STARZEC Uniwersytet Jagielloński LUDZKI WYMIAR SUNDANCE – OCZAMI ROBER TA REDFORDA ABSTRACT The article is concerned with the phenomenon which has been developing on American ground since 1981, the Sundance Institute. The internationally recognised organization with its stepping-stone for independent films, Sundance Film Festival, is shown here from a more complex and humanistic point of view. Namely, the article serves as an attempt to present the Institute from the perspective of its founder, Robert Redford and tries to show some correlation between the philosophy of Redford and the Institute. It needs to be said that the article is based on Robert Redford’s thoughts, opinions and reflections having been revealed to the press and television during 25 years of Sundance’s existence. These when combined together provide a full picture of the Institute and enable one to show its artistic, social and political role and even give a fresh look at the issue of independence in filmmaking. As one may notice, Redford has own understanding of American reality and believes in Sundance’s mission not only on the cinematographic scene but also in American society. Redford mainly underlines the evolving of the diversity of all kinds in filmmaking, artistic freedom and the importance of storytelling and character in films which, according to him, cause a film to become a cultural experience and a platform for many voices belonging to social and cultural minorities. Moreover, he mentions freedom of speech and expression which is the most precious virtue for Americans, and that is the reason why he calls on independent filmmakers to help prevent its erosion. AR TYKUŁY VARIA Renata PUCHOWICZ Uniwersytet Jagielloński DYPLOMACJA KULTURALNA NIEMIEC DO 2007 ROKU ABSTRACT The article discusses the historical circumstances regarding the beginning and development of German cultural diplomacy, and thereby the German cultural policy abroad. German diplomacy, which is characteristically different from the French or English, did not originate from colonialism and was much more similar to the Italian one for it originated from national schools established abroad. Since the first world war German Schools Abroad were the main device of the German Kulturpolitik. The cultural diplomacy model applied in Germany formed during the Weimar Republic. It is analyzed in this article from a historical perspective considering all changes and obstacles that Germany had to deal with because of the political situation in their country, infamous World War II and the process of regaining international respect. Financial resources allotted by the Ministry of Foreign Affairs of the Federal Republic of Germany for the foreign cultural policy of Germany, quoted in the tables processed by the author on the basis of available data, show how important it was for the FRG to offer to the international community their cultural and scientific benefits once again. Niemiecki badacz Manfred Abelein ustalił, że w 1913 r. kanclerz Rzeszy, Teobald Bethman Hollweg, po raz pierwszy użył pojęcia „niemiecka zagraniczna polityka kulturalna” w liście do historyka niemieckiego Karola Lamprechta. Miał on wówczas powiedzieć, iż docenia korzyści, jakie Francja i Wielka Brytania czerpią ze swej propagandy kulturalnej, i uważa, że Rzesza powinna iść za ich przykładem. Jednym z pierwszych polityków, który widział potrzebę podporządkowania zagranicznych kontaktów kulturalnych polityce zagranicznej Rzeszy, był Otto von Bismarck. ABSTRACT In this research in progress report the author outlines briefly history of the Argentine university reform movement of 1918 against its university and political background, pointing to its contents and the historic international significance as well as its current message. D zieje autonomii uniwersyteckiej oraz ogólnokrajowych, reprezentatywnych związków studentów zasługują na systematyczne zbadanie w świetle doświadczenia wykraczającego poza historię jednego kraju. Studenci i nauczyciele akademiccy oraz pracownicy administracji uczelnianej tworzą całość współdecydującą o wielokierunkowych skutkach tego rozwoju i wymagającą lepszej organizacji. Niniejsza notatka publikowana jest w dziewięćdziesiątą rocznicę pierwszego w XX stuleciu ruchu studentów na rzecz reformy uniwersyteckiej – ruchu studentów argentyńskiego uniwersytetu w Cordobie. Universidad Nacional de Córdoba był najstarszym z trzech działających w ówczesnej Argentynie. Uczelnię założyli jezuici w 1617 r. Od 1854 r. był to uniwersytet państwowy. Uniwersytet w Buenos Aires powstał w 1821 r., w La Plata – w 1890 r. Liczba studentów w Argentynie rosła dość szybko: w roku 1900 było ich 3000, w 1918 – już 14 000. Oddziaływał jeszcze wpływ Domingo Sarmiento, który w pozytywistycznym duchu przyczynił się do rozwoju badań nad bogactwami naturalnymi. Jednakże poziom nauk przyrodniczych i ścisłych był w Argentynie około 1918 r. niższy od hiszpańskiego, przy nieco większej liczbie argentyńskich pracowników nauki i studentów w tych dyscyplinach. Ale Hiszpanie mieli swego noblistę w 1906 r. – neurologa Santiago Ramón y Cajal, co wpłynęło na wzrost nakładów budżetowych na naukę. AR TYKUŁY VARIA Jakub ŻURAWSKI Uniwersytet Jagielloński KOMUNIKACJA WYBORCZA PRZEZ INTERNET 1 ABSTRACT The internet as a tool which is used in election campaigns is now entering a phase of popularisation. This relates both to so-called “old” (e.g. USA) and “new” (e.g. Poland) democracies. However, it is still too early to define the eventual effects of use of the Internet for political (especially electoral) communication. In the article the author outlines four aspects of on-line campaigning: technological, of space and time, voters acceptability to new forms of electoral communication, and the new status of participants of internet-mediated electoral communication. Conducted observations and research indicate that because of its properties the Internet can have a positive role by facilitating contacts between voters and politicians, as well as circulation of varied information and opinions. That is why the Internet will probably be an increasingly crucial medium in election campaigns. P rowadzenie działań politycznych we współczesnych demokracjach liberalnych w znacznym stopniu opiera się na rozbudowanej, zapośredniczonej przez środki masowego przekazu komunikacji zarówno pomiędzy samymi aktorami politycznymi (partiami, politykami, organizacjami społecznymi), jak i pomiędzy tymiż aktorami a społeczeństwem. Model demokracji reprezentacyjnej wymaga ciągłego kontaktu wybierających z wybieranymi, rządzonych z rządzącymi, a swobodna dyfuzja informacji stanowi de facto jedną z podstaw jej istnienia.
