KOMENTARZ COMMENTAR Y Stan faktyczny The facis 1. Zagadnienie „wpuszczenfa" krzyżaków na obszar Polski stawia Włodkowic zgodnie z prawdą. Zostali „wpuszczeni", „wyznaczono i dano" i~ pewne posiadłości na pograniczu pruskim. „z nich" działali przeciw Prusom. Nie ma tu mowy o tym aby powstała, czy miała powstać, osobna, niezależna od władców polskich jednostka po1irtyczna na obszarze Polski. Zupełnie zgodne z tym jest późniejsze przedstawienie sprawy przez Włodkowica w piśmie dla Zygmunta ( Oculi) niżej III str. 12, 29. 2. Mówiąc o „książętach Polski" Włodkowic ma na myśli Konrada Mazowieckiego, który był jednym z książąt z rodziny Piastów, administrującym jedną z dzielnic Polski, ale nie miał prawa odstępować władzy nad częścią terytorium państwa polskiego, a to zarówno dlatego, że była to tylko administracja (jaką w poprzednim stuleciu Bolesław Krzywousty obdzielił swych synów), jak ponieważ wedle ówczesnych przekonań prawnych nawet król nie mógłby dowolnie przenieść na kogoś innego władzy królewskiej nad częścią obszaru królestwa. Sprawę tę omawia Włod kowic później w pismach do Zygmunta (Oculi) i do doradcy papieża (Ad videndum), np. niżej III str. 142. 3. Paweł odróżnia pierwotną obronę przed napadami Prusów i następne najazdy krzyżaków na sąsiadów już spokojnych, więc naprzód na dalsze plemiona pruskie, a z kolei na Litwinów i Żmudzinów. Odróżnienie to ma podstawowe znaczenie w jego następnych wywodach prawnych, gdyż obrona jest dozwolona przez prawo natury, a napadanie jest zakazane. 4. Krzyżacy polegali przede wszystkim na przywilejach uzyskanych, czy rzekomo uzyskanyoh, od papieży i cesarzy. Włodkowic zajmuje się więc zagadnieniem, czy papież i czy cesarz mógł nadać takie właśnie przywi,leje. Za podstawę swych wywodów bierze ogólną zasadę tolerancji wobec innowierców i wyciąga z niej konsekwencje. A stwierdziwszy w pierwszym „traktacie" ograniczenia obowiązu jące papieża, przechod:.vi w drugim do stwierdzenia, że władza cesarza jest od władzy papieża niższa i w stosunku do niej pochodna. Stąd wynika wniosek, że skoro papież nie mógł dać krzyżakom pewnych upoważnień, nie mógł też cesarz. 1: Speaking of "princes of Poland" Paul had in mind Prince Conrad of Cuyavia, who was one of the princes of the Piast dynasty and was administering one of the par~s of Poland, but had no right to cec:le power over part of the territory of the Pohsh State, both because he was only administering (as in the preceding century Boleslas III had divided the administration between his sons) and because according to the legal views of the time a king could not at will transfer to somebody else royal power over a part of the kingdom. This is discussed by Paul later in his papers ( Oculi for Sigismund, and Ad videndum, for the adviser to the Pope), e. g. below III p. 142. 2. Paul answers the question of how the Crucifers were "admitted" to Polish t:rritory, in accordance with the truth: They were "admitted'', and certain possess10ns on the border of the land of the Pruthenians were "assigned and given" to them. "From these" they were acting against the Pruthenians. Nothing is said ab.out there having already arisen, or about its being agreed that there would anse, on Polish territory, a separate political unit, independent of Polish rulers. This is quite .in accordance with how Paul later presented the case in his paper Oculi e. g. below III pp. 12, 29. . 3. Paul distinguishes between the original defense against attacks by Pruthenian ne:ghbours of Pol.and: and the subsequent in.va,si{)llls by the Crucifers of peaceful ne1ghbours, that is, first of the more distant Pruthenian tribes and later of the Lithuanians and Samagitians. This distinction is fundamental in his subsequent legal statements, for defense is permitted by the law of nature while attacking is forbidden. ' 4. The ~rucifers relied above all on privileges obtained, or which they claimed t~ have obtamed, from popes and emperors. Hence Paul first deals with the quest10n whether a pope or an emperor could grant precisely such privileges. He takes for the general basis of his statements the general principle of toleration in relation to peo~le ~f ~ther faiohs, and draws the consequences of this prinoiple. Jednakże ten drugi „traktat" obejmuje też zagadnienia, które nie odnoszą się do władzy cesarza (pytania od czwartego do ostatniego), lecz dotyczą stosunku mię dzy państwami chrześcijańskimi a innymi, zagadnień prawa wojny, zdobyczy wojennej, pomocy innowierców dla chrześcijan prowadzących wojnę, wreszcie zdolności procesowej innow.ierców w sądach chrześcijańskich. Plan pracy 5. Podział na dwa „traktaty'', zawierające po jedenaście punktów, jest przejrzysty. Zapewne chodziło Włodkowicowi o to, aby jak najliczniejsi uczestnicy soboru mogli szybko zapoznać się z jego wywodami. Temu samemu celowi służy ujęcie, w piśmie rozdanym wszystkim nacjom, streszczenia wywodów Włodkowica w 52 punkty. Ale nie wszystkie pytania drugiego „traktatu" dotyczą kompetencji cesarza w stosunku do niewiernych (patrz uwagę poprzednią). PIERWSZY TRAKTAT 6. Pierwsze pytanie, co do wypędzania i zabierania mienia, sformułowane ściśle wedle Piotra de Ancarano. Odpowiedź na nie ma stanowić ogólną podstawę wywodów przez stwierdzenie zasady tolerancji: skoro tolerancja obowiązuje w stosunku do innowierców mieszkających w państwie chrześcijańskim, tym bardziej obowią zuje w stosunku do innowierców, którzy mieszkają gdzie indziej, we własnym państwie. 7. To jest nie Boskiego, ani naturalnego, lecz nadanego. 8. Ogłaszając akta soboru w Konstancji, Hermann von der Hardt, na przełomie XVII ti. XVIII wieku, chwalił Włodkowica za stanowisko, którego w tej sprawie bronił na soborze a. Wkrótce potem Lenfant, historyk soboru w Konstancji, duchowny kościoła protestanckiego w Berlinie, podkreślał z naciskiem znaczenie prac Włodkowica, wskazując, że wśród kwestii prawnych (tj. zasadniczych) w sporze polsko krzyżackim była ta, „czy wolno chrześcijanom nawracać niewiernych w drodze walki orężnej i czy ziemie i;iiewiernych należą z prawa do chrześcijan" stwierdzając, że odpowiedzi przeczącej bronił z mocą (fortement) Włodkowic b. 9. Lenfant, Histoire du Concile de Constance, 2 wyd. 1727 I str. 238-239. goes on to say in the second "treatise" that the power of the Emperor is inferior to that of the Pope, and derived from h.im. Hence follows the conclusion that since a pope could not give the Crucifers a certain authorization still less could an emperor. This is discussed in the answers to the first three qu~stions of the second "treatise". But this second "treatise" also deals with questions which do not refer to the power of the Emperor ( questions four to eleven), but concern relations between the States of Christians and those of people of other faiths, questio:ns of the law of war,. of w~r loot, of help accepted by Christians hav.ing wars from . people of other behefs, fmally of the right of people of other beliefs to sue before · Christian courts. Here arises at once a difficulty which is repeated in translating this and the further writings of Paul: dominium can refer either to what is called today "ruling" in the sence of public law, or to "property" in the sense of private law, or to a "State". Possessiones can mean that which is owned (not only actually held), or the word may denote a territory which is under a certain "government" in the sense of public law. The word dominus is used in this place as denoting a "ruler". It follows from the sense of the statements repeated by Paul after Innocent and Zabarella, that all three recognized the right of peoples of other faiths both to have independent States and to own property within Christian States.
