Evidence for the existence of a website of the Complainant’s festival, set up at the end of July 2003, which website was also visited by the Defendant, who thus learned about the structure of the Complainant’s festival —competition, idea, prizes, categories etc. (of which fact the Defendant informed the Complainant during their meeting on August 14th, 2003). The evidence for the existence of the website and the fact of sending a newsletter with the name of the Complainant’s Festival is in the form of replies to the Complainant’s newsletter which was sent on the night of July 30th, 2003 to eight thousand email addresses, among them addresses of prestigious institutions and persons in several dozen countries. The newsletter informed about the upcoming 2003 edition of the festival and additionally contained a link to the already existing website of the festival. I hereby attach a reply from an American journalist, Mr. Philip Kutner, from the American magazine DER BAY, of August 1st, 2003 (evidence no. 8 A together with certified translation) and a letter of August 5th, 2003 from the cultural attaché in the German Embassy in Poland, Mr. Erwin Starnitzki, addressed to the chairman of the Central Council of Jews in Germany, in which he informs about the Festival and its website (evidence no. 8 B together with certified translation). At the end of July 2003, the festival's website is online. The website in both Polish and English presents: rules for the competition, an introduction about the history of Polish Jews, including Warsaw Jews, the mission of the Complainant’s festival, there is a list of the members of the Honorary Committee (still growing), an application form for film‐makers, a map of Warsaw with hotels or pharmacies, first media patrons. The Complainant also makes a preliminary selection of films to be screened; the narrative feature films include the prewar films in Yiddish: Purim Clown ‐ Purim Szpiel, dir. J. Nowina Przybylski, 1937,Poland; Judel plays the violin ‐ Jidł mit'n fidł, dir. J. Nowina Przybylski, 1936, Poland. A little known film by Andrzej Wajda was also included: Sentence on Franciszek Kłos Wyrok na Franciszka Kłosa, 2000, Poland. The Applicant also chose a short fiction film by a professor at his Film School in Łódź, Near the train track/ Przy torze kolejowym dir. Andrzej Brzozowski, 1963. This film was banned by the Communist government in the People's Republic of Poland and in practice, its premiere in the presence of its author took place only at the Complainant`s festival in November 2003. There were also other short fiction films, which were not commonly known, like AMBULANS dir. Janusz Morgenstern of 1960. For obvious reasons, those films did not take part in the competition, but their screening at the Festival was a unique way to present them to a wider audience in Warsaw. The selected documentaries included the documentary by Ewa Szprynger. In general, the first festival in November 2003 presented 65 documentaries and feature films from 15 countries. Some of the most recent and excellent narrative feature films were unavailable for the first Complainant`s festival in 2003, e.g. NOWHERE IN AFRICA, whose producers decided to screen it only at the second festival, after it was awarded with an Oscar in 2004. The rule of producers is that if they want to present their film at one of the most important festivals in Europe: Cannes, Berlinale or Venice, they have to decide which festival which be the first and only one, as they cannot present films at all festivals or other festivals before, if they want to have a screening at one of those three. Which is why the Applicant's festival, as a smaller festival, does not have any chance for such exclusive premieres, such films are available only after huge festivals, although some exceptions took place later. For the 1st edition on November 2003 applicant took decision not to screen narrative feature productions in the competition screenings, because the collected and available narrative features for the 1st Festival didn't fit criteria by the competition rules: they were pre war productions in Yiddish or important movies from 60s. The new productions were unavailable or they didn't have a good artistic and technical quality to be screened. Additionally the time in the screening room for the screenings were limited, so the Complainant took decision to show only the best and most interesting productions, where only documentaries were in the competition. At the 1st edition the Complainant made some exceptions and presented in the competition movies, which were older than two years ‐ produced in 2000. The Complainant wanted to give a chance both filmmakers and the audience to participate and to watch for the first time ever the interesting and important movies about Jewish topics. Therefore in email from July 31, 2003 the call for submissions was dedicated for documentary productions, which were no longer than 55 minutes ‐ this one gave the additional chance to present more interesting documentary productions, since 55 minutes is regular broadcast duration time. Only Documentaries involving Jewish subjects, which are longer
than 55 minutes, and produced no earlier than the year 2000 will be
accepted.
The movies can be set in systems PAL and NTSC on carriers:
DVD, VHS, S-VHS
For every movie must be enclosed its description, no longer than
100 words, and also a note about the author/authors of the
creation. May be also enclosed photo materials from the movie,
press reports,
and information about participation in other festivals
Movies need to have enclosed the English dialogue list.
The received materials will not be returned unless with enclosed
envelope and full returned mail fee (stamp).
The authors, who will be accepted to the Main Competition will be
informed by mail and also find all information on the FESTIVAL
website.

Do konkursu zostana dopuszczone filmy dokumentalne tylko i
wylacznie poswiecone tematyce zydowskiej o dlugosci do ok. 55
minut zrealizowane nie wczeoniej niz przed 2000 rokiem.
Filmy moga byc nadsylane w systemie PAL i NTSC na nosnikach:
DVD, VHS, S-VHS.
Do kazdego filmu musi byc zalaczony opis filmu nie dluzszy niz
100 slów a takze notatka o autorze / autorach filmu. Moga byc
dolaczone materialy fotograficzne filmu oraz materialy prasowe i
informacje o uczestnictwach w innych festiwalach.
W wypadku filmów nie polskojezycznych wymagane jest
nadeslanie polskiej listy dialogowej.
Materialów nadeslanych nie zwracamy, chyba, ze zostana
przeslane wraz z zaadresowana koperta
i naklejonym pelnowartosciowym znaczkiem zwrotnym.
Autorzy prac, którzy zakwalifikuja sie do Konkursu Glównego
zostana poinformowani listownie oraz informacje te znajda sie na
stronach www FESTIWALU.

I am writing to you in case you have not already heard about the
Warsaw Jewish Film Festival from other sources. You can find more
information about the Festival, which is formally to start on 4 November
in the Jewish Theatre in Warsaw, at www.strehlau.hbz.pl/festival/.
The Festival is open for films about Jewish topics no longer than 55
minutes and created after 2000. Applications with films or tapes with
English subtitles may be submitted by 30 September. Application forms
and more information is available on the above website. There is a
competition of films submitted to the Festival.
The Director of the Festival is Mr Daniel Strehlau, whom I do not know
any closer.
I would appreciate if you could - if you have not done so already - notify
any documentary directors who might be interested.

für den Fall, dass Sie nicht schon auf anderem Wege Kenntnis von diesem Festival haben,
erlaube ich mir diesen Hinweis. Näheres zu dem Festival, das am 04. November im
Staatlichen Jiddischen Ester Rachel Kaminski- Theater in Warschau
feierlich eröffnet werden soll, erfahren Sie unter www.strehlau.hbz.pl/festival/.
Zugelassen sind Dokumentarfilme über jüdische Themen bis zu 55 Minuten Spieldauer, die
nach 2000 entstanden sind. Anmeldungen sind bis zum 30. September mit Film oder Kassette
und englischsprachigem Begleittext an das Festivalbüro zu richten. Anmeldeformulare und
weitere Angaben finden sich auf der o.a. Web-Site. Unter den für das Festival zugelassenen
Einsendungen findet ein Wettbewerb statt.
Direktor des Festivals ist ein mir nicht näher bekannter Daniel Strehlau, M.A.
