RAPORT ROCZNY ANNUAL REPORT POSTÊPOWANIE ODWO£AWCZE I SPORNE APPEAL AND LITIGATION PROCEDURES Postêpowanie w sprawach odwo³awczych i spornych by³o prowadzone odpowiednio w Izbie Odwo³awczej i Wydziale Spraw Spornych. Zadaniem Izby Odwo³awczej by³o ponowne rozpatrywanie spraw na skutek wniesionych œrodków zaskar¿enia od orzeczeñ podejmowanych w sprawach zwi¹zanych z udzielaniem ochrony na wynalazki, wzory u¿ytkowe, wzory przemys³owe, znaki towarowe, topografie uk³adów scalonych oraz oznaczenia geograficzne. W 2003 r. do Urzêdu wp³ynê³y 942 sprawy, z czego 842 dotyczy³o wniosków o ponowne rozpatrzenie sprawy w zwi¹zku z wydanymi decyzjami, a 99 dotyczy³o wniosków o ponowne rozpatrzenie sprawy w odniesieniu do postanowieñ. Rozpatrywano równie¿ sprawy (odwo³ania i za¿alenia) pozosta³e po by³ej Komisji Odwo³awczej, która dzia³a³a przy Urzêdzie Patentowym RP. Do za³atwienia pozosta³y 973 sprawy (21 po by³ej Komisji Odwo³awczej i 952 bie¿¹ce). Ogó³em do dnia 31 grudnia 2003 r. rozpatrzono 1.432 sprawy (o 102 sprawy wiêcej ni¿ planowano). W tej liczbie znalaz³o siê 538 spraw dotycz¹cych decyzji odmawiaj¹cych udzielenia praw wy³¹cznych, 90 spraw dotyczy³o decyzji umarzaj¹cych postêpowanie, 653 sprawy – decyzji o wygaœniêciu prawa, a ponadto decyzji o wygaœniêciu decyzji o udzieleniu prawa, a tak¿e odmów z okresu przejœciowego oraz umorzenia postêpowania wszczêtego w Izbie Odwo³awczej, natomiast 66 spraw dotyczy³o postanowieñ. W wyniku pracy Izby Odwo³awczej liczba spraw zaleg³ych po by³ej Komisji Odwo³awczej przy Urzêdzie Patentowym RP zmniejszy³a siê do 21 spraw na dzieñ 31 grudnia 2003 r. S¹ to sprawy, w których b¹dŸ zawieszono postêpowanie odwo³awcze b¹dŸ ich rozpatrzenie uzale¿nione jest od innego, nie zakoñczonego postêpowania, np. spornego lub przed s¹dem administracyjnym. W 2003 r. Naczelny S¹d Administracyjny przekaza³ do Izby Odwo³awczej w celu zajêcia stanowiska 103 skargi na decyzje i postanowienia Urzêdu, w tym 56 skarg dotyczy³o wynalazków, 5 – wzorów u¿ytkowych, 3 – wzorów przemys³owych i 43 – znaków towarowych. W wyniku rozpatrzenia tych skarg przez zespo³y orzekaj¹ce z³o¿one z ekspertów, w trzech sprawach uwzglêdniono skargê i uchylono zaskar¿one orzeczenie, w pozosta³ych sprawach podtrzymano stanowisko Urzêdu i przes³ano akta sprawy do Naczelnego S¹du Administracyjnego. Appeal and litigation proceedings were conducted before the Chamber of Appeals and Litigation Division, respectively. The Chamber of Appeals was responsible for reexamination of appeals against the decisions taken in proceedings for the grant of protection for inventions, utility models, industrial designs, trademarks, topographies of integrated circuits and geographical indications. In 2003, 942 cases were brought in the Office, 842 of which there were requests for the review of the experts’ decisions, and 99 there were requests for the review of the orders issued. The cases (appeals and complaints) inherited from the former Board of Appeals that had functioned with the Patent Office of RP, were also examined. There were 973 cases left for hearing (21 inherited from the former Board of Appeals and 952 new). Until 31 December 2003 1.432 cases were examined (102 more than planned), including 538 appeals from the decisions on refusal to grant exclusive rights, 90 appeals from the decisions on the discontinuance of the proceeding, 653 appeals from the decisions on the termination of the right granted or from the decisions on the lapse of the decisions on the grant, refusals decided in the transitional period, decisions on the discontinuance of the proceedings instituted before the Chamber of Appeals, while 66 appeals were from the orders issued. In the effect of the experts’ work in the Chamber of Appeals the number of cases not examined by the Board of Appeals with the Patent Office dropped to 21 on 31 December 2003. There are the cases in which appeal proceedings were suspended or depend on another pending proceeding, ex. a litigation proceeding or a proceeding before an administration court. During 2003, the Supreme Administration Court remitted to the Patent Office, for consideration by the Chamber of Appeals, in total 103 complaints against the Office’s decisions taken and orders issued in respect of inventions – 56 complaints, utility models – 5 complaints, industrial designs – 3 complaints and trademarks – 43 complaints. In effect of the consideration of the complaints by adjudicative panels consisting of experts, three complaints were admitted and the respective decisions reversed; in respect of other complaints the decisions of the Office were upheld and the dossiers remitted back to the Supreme Administration Court. RAPORT ROCZNY Wydzia³ Spraw Spornych jest komórk¹ Urzêdu Patentowego RP, w której rozpatrywane s¹ sprawy sporne w wiêkszoœci wynik³e na tle udzielonych ju¿ praw wy³¹cznych. W szczególnoœci s¹ to sprawy o uniewa¿nienie patentu na wynalazek, prawa ochronnego na wzór u¿ytkowy, prawa ochronnego na znak towarowy, prawa z rejestracji wzoru przemys³owego (wzoru zdobniczego), stwierdzenie wygaœniêcia prawa ochronnego na znak towarowy jak i inne sprawy nale¿¹ce w œwietle art. 255 ustawy Prawo w³asnoœci przemys³owej do w³aœciwoœci Urzêdu Patentowego RP dzia³aj¹cego w trybie postêpowania spornego. W 2003 r. do Wydzia³u Spraw Spornych wp³ynê³o 348 nowych wniosków o wszczêcie postêpowania. Z lat ubieg³ych pozosta³o nierozpoznanych 500 spraw, co ogó³em wynosi 848 spraw. Regu³¹ w postêpowaniu spornym jest rozpatrywanie spraw przez Kolegia Orzekaj¹ce ds. spornych na rozprawach. Wymaga to odpowiedniego przygotowania ka¿dej sprawy, a m.in. skompletowania dokumentów koniecznych przy rozpoznawaniu sprawy, wys³ania wniosku stronie przeciwnej w celu zajêcia stanowiska oraz zawiadomieñ o terminie rozprawy. Niektóre sprawy np. dotycz¹ce umorzenia postêpowania rozpatrywane s¹ na posiedzeniach niejawnych. W Wydziale Spraw Spornych w 2003 r. wyznaczono do rozpatrzenia ogó³em 516 spraw, przeprowadzono 412 rozpraw, rozstrzygniêto 294 sprawy, a w 169 sprawach odroczono rozprawy – przede wszystkim w celu umo¿liwienia stronom zebrania dodatkowych dowodów w sprawie lub ustosunkowania siê do nowych okolicznoœci podniesionych na rozprawie albo z przyczyn losowych (np. choroba strony lub pe³nomocnika). W 104 sprawachzosta³ypodjête rozstrzygniêcia na posiedzeniach niejawnych. Udzielono odpowiedzi na skargi przekazane przez Naczelny S¹d Administracyjny w 59 sprawach. Przedstawione dane wskazuj¹ na wzrost dynamiki rozpatrywania spraw, zw³aszcza w postêpowaniu przed Izb¹ Odwo³awcz¹, ale pozytywn¹ tendencjê odnieœæ nale¿y równie¿ do Wydzia³u Spraw Spornych. ANNUAL REPORT The Litigation Division is a unit in the Patent Office, in which litigious cases, mostly in respect of exclusive rights granted, are decided. There are in particular cases for invalidation of patents for inventions, rights of protection for utility models, rights of protection for trademarks, rights in registration for industrial (ornamental) designs, cases for declaration of termination of rights of protection for trademarks, as well as in other cases being, by virtue of Article 255 of the Act – Industrial Property Law, under the responsibility of the Patent Office when applying litigation procedure. In 2003 348 new requests for initiation of proceedings were filed with the Litigation Division. With 500 cases that remained unexamined during some previous years it makes in total 848 cases awaiting examination. It is a rule in litigation proceedings that cases are heard by Adjudicative Boards in trials. Each case requires to be carefully prepared, relevant documents to be completed, the request notified to the opposite party in order to give it a possibility to express its opinion, notifications of the date of the trial sent. Certain trials for discontinuance of a proceeding are heard at chamber. In the Litigation Division in total 516 cases were scheduled for examination in 2003, 412 hearings were held, 294 cases were settled and 169 suspended, mainly in order to give the parties a possibility to collect collateral evidences or to react on new facts produced at the hearing, or because of a misfortune (ex. disease of a party or a representative). In 104 cases decisions were taken at chamber. Replies to 59 complaints submitted to the Supreme Administration Court were provided to that Court. The above information illustrates an increasing trend in deciding cases, in particular before the Chamber of Appeals, a positive trend being also true for the Litigation Division.
