Information on the Belgian market Current as of September 2003 BELGIUM Regulation The law of 27 March 1995 modifeid by the law of 11 April 1999 on the insurance intermediation and the distribution of insurances. All persons and legal entities offering insurance to the public with or without an insurance intermediary are subject to the law. (modification: 11.04.1999, publication 30.04.99) See below the following documents (available in French) : - Law of 27 March 1995 on the Insurance Intermediation - Royal decree of 25 March 1996 on the above law - A comprehensive file on this law Registration No one is allowed to act as an insurance intermediary in Belgium if that person is not listed in the Register of Insurance Intermediaries kept by the Insurance Supervisory Authority (OCA/CDV). The Register has four sections, one for insurance brokers, one for insurance agents, one for insurance sub-agents and one for other insurance intermediaries. (with activities other than specified in the law of 27.03.1995 for brokers, agents or subagents) Qualifications The law requires qualification of all insurance intermediaries and all persons who are appointed by an insurer. (f.e. direct-writing) The qualification level can be limited to a basic knowledge of insurance products which are sold or offered by subagents or persons in contact with the public. Financial guarantees The law lays down the principle of the adequacy of the financial guarantee ("to have sufficient financial capacity"). The content of this requirement is defined by Royal Decree. Professional indemnity insurance The law requires insurance intermediaries to have professional indemnity insurance. This requirement is also specified in a Royal Decree. Minimum PI cover is 743 680 euros per claim and 2 478 935 euros per year for all claims. Intermediaries acting on behalf of and for the account of insurance companies which assume this responsibility are exempted from complying with this obligation. Code of conduct A professional code of ethics is signed between the professional federations of insurance brokers and insurance companies. Legal provisions regarding free provision of services (FPS) by insurance intermediaries (EU) The obligation to register - and to satisfy the relevant conditions - applies to intermediaries established in Belgium as well as intermediaries of other EU Member States providing services in Belgium on a cross-border basis. Dotyczy wszystkich osób fizycznych i prawnych, oferujących ubezpieczenia. Rejestracja Każdy pośrednik ubezpieczeniowy w Belgii musi być zgłoszony do rejestru organu nadzoru (OCA/CDV). Rejestr składa się z dwóch części: dla pośredników zależnych i niezależnych. Kwalifikacje Ustawa wymaga kwalifikacji od wszystkich pośredników ubezpieczeniowych lub osób zaangażowanych do sprzedaży czy oferowania produktów. Gwarancje finansowe Ustawa określa zasadę odpowiedniej gwarancji finansowej ("posiadanie wystarczających zasobów finansowych"). Szczegóły tych wymagań określa Dekret Królewski. Profesjonalne ubezpieczenie OC Ustawa wymaga od pośredników ubezpieczeniowych posiadania profesjonalnego ubezpieczenia OC. Ten wymóg również jest określony Dekretem Królewskim. Pośrednicy działający dla oraz w imieniu zakładów ubezpieczeń, które przyjmują na siebie tę odpowiedzialność, są zwolnieni z wypełnienia tego obowiązku. Kodeks postępowania Kodeks etycznego postępowania zawodowego został zawarty między profesjonalnymi federacjami brokerów ubezpieczeniowych oraz zakładami ubezpieczeń.
