RAPORT ROCZNY ANNUAL REPORT WSPÓ£PRACA MIÊDZYNARODOWA INTERNATIONAL CO-OPERATION Wspó³praca ze Œwiatow¹ Organizacj¹ W³asnoœci Intelektualnej (WIPO) Co-operation within the framework of the World Intellectual Property Organisation (WIPO) Jednym z najwa¿niejszych obszarów dzia³alnoœci Urzêdu Patentowego na arenie miêdzynarodowej jest udzia³ w pracach Œwiatowej Organizacji W³asnoœci Intelektualnej (WIPO). Dzia³alnoœæ ta realizowana jest poprzez uczestniczenie w pracach organów wykonawczych tej Organizacji, czyli Zwi¹zków przez ni¹ administrowanych, oraz utworzonych w jej ramach sta³ych komitetów i grup roboczych. Urz¹d reprezentowany jest tak¿e na corocznych sesjach Zgromadzeñ WIPO, podczas których dyskutowane s¹ zagadnienia i podejmowane decyzje w najistotniejszych dla dzia³alnoœci Organizacji sprawach. One of the most important field of the activities pursued by the Patent Office on international level is that related to the participation in the works of the World Intellectual Property Organization (WIPO). The activities in question are performed by way of the taking part in the works carried out by the governing bodies of the Organization, i.e. by the Unions administered by it and the Standing Committees and working groups established within the framework of their activities. The Office is also represented at the annual sessions of the Assemblies of WIPO’s governing bodies, during which the most important issues relevant for the activity of the Organization are discussed and the decisions in respect of these activities are taken. ŒWIATOWA ORGANIZACJA W£ASNOŒCI INTELEKTUALNEJ (World Intellectual Property Organization) (WIPO/OMPI) – organizacja miêdzynarodowa bêd¹ca agend¹ ONZ, utworzona Konwencj¹ o utworzeniu Œwiatowej Organizacji W³asnoœci Intelektualnej, podpisan¹ w Sztokholmie dnia 14 lipca 1967 r. Nadrzêdnym celem Organizacji jest promowanie ochrony w³asnoœci intelektualnej na œwiecie. Aktualnie jej cz³onkami jest 179 pañstw. Siedziba Organizacji znajduje siê w Genewie. W roku 2003 – podobnie jak w latach ubieg³ych – przedstawiciele Urzêdu Patentowego RP uczestniczyli w XXXIX sesji zgromadzeñ pañstw cz³onkowskich WIPO. W trakcie obrad polska delegacja wyrazi³a uznanie oraz pe³ne poparcie dla dzia³alnoœci Organizacji oraz dla dotychczas osi¹gniêtych przez ni¹ rezultatów. Delegacja wyrazi³a tak¿e szczególne zainteresowanie kontynuowaniem prac nad nowym Traktatem o materialnym prawie patentowym (SPLT), nad reform¹ systemu PCT oraz reform¹ konstytucjonaln¹ Organizacji. Przedstawiciele Urzêdu uczestniczyli w pracach Sta³ego Komitetu ds. Technologii Informatycznych (SCIT), grupy roboczej SCIT ds. technologii informatycznych, a tak¿e w pracach Sta³ego Komitetu ds. Prawa o Znakach Towarowych, Wzorów Przemys³owych i Oznaczeñ Geograficznych oraz Sta³ego Komitetu Prawa Patentowego, przygotowuj¹cego Traktat o materialnym prawie patentowym. Ponadto pracownicy Urzêdu WORLD INTELLECTUAL PROPERTY ORGANIZATION – an international organization being an agency of the UNO; it was established by the Convention on the establishment of the World Intellectual Property Organization signed in Stockholm on 14 July 1967. The basic aim of the Organization is to promote the protection of intellectual property world-wide. At present 179 States are Members of the Organization. It has its headquarters in Geneva. Alike in previous years – in 2003 representatives of the Patent Office attended the XXXIX series of sessions of the Assemblies of the WIPO Member States. During the session the delegation of Poland expressed its appreciation and full support for the work performed by the Organization and the results achieved, while underlying at the same time the large scope and diversity of the forms in which the Organization’s programme was performed. The delegation also expressed its particular interest in the continuing works on a new Substantive Patent Law Treaty (SPLT), on the reform of PCT and the constitutional reform. The Office’s experts participated in the works of the Standing Committee on InformationTechnologies (SCIT), its working group on information technologies, as well as in the works of the Standing Committee on the Law on Trademarks, Industrial Designs and Geographical Indications and of the Standing Committee on the Law of Patents, within the RAPORT ROCZNY mieli mo¿liwoœæ wziêcia udzia³u w subregionalnym seminarium nt. „Wyzwania dla systemu patentowego. TeraŸniejszoœæ i przysz³oœæ”, wspó³organizowanym przez WIPO i Litewskie Pañstwowe Biuro Patentowe w Wilnie. Polski Urz¹d Patentowy zorganizowa³ w Warszawie, w listopadzie 2003 r., przy wspó³pracy z WIPO, regionalne seminarium nt. w³asnoœæ przemys³owa dla ma³ych i œrednich przedsiêbiorstw. W seminarium wziêli udzia³ przedstawiciele urzêdów patentowych krajów Europy Œrodkowej i Wschodniej oraz przedstawiciele ró¿nych grup zawodowych zajmuj¹cych siê w Polsce wspieraniem ma³ych i œrednich przedsiêbiorstw. Seminarium to odby³o siê w ramach miêdzynarodowej konferencji poœwiêconej 85-leciu ochrony w³asnoœci przemys³owej w Polsce i inauguracji Roku Ochrony W³asnoœci Przemys³owej w naszym kraju. Wspó³praca w ramach Europejskiej Organizacji Patentowej (EPO) W 2003 r. kontynuowane by³y prace zwi¹zane z przyst¹pieniem do Europejskiej Organizacji Patentowej, do której zaproszenie Polska otrzyma³a w dniu 29 stycznia 1999 r., z mo¿liwoœci¹ uzyskania cz³onkostwa w tej organizacji od dnia 1 lipca 2002 r. Efektem prowadzonych prac by³o uchwalenie przez Sejm w dniu 19 wrzeœnia 2003 r. ustawy o ratyfikacji Konwencji z dnia 5 paŸdziernika 1973 r. o udzielaniu patentów europejskich. Dokument przyst¹pienia do Konwencji oraz do Aktu z dnia 29 listopada 2000 r. rewiduj¹cego Konwencjê (ratyfikowanego przez Polskê w 2002 r.) zosta³ przekazany, z koñcem grudnia 2003 r., depozytariuszowi Konwencji, którym jest Rz¹d Republiki Federalnej Niemiec. Stosownie do postanowieñ art. 169 Konwencji Polska stanie siê cz³onkiem Europejskiej Organizacji Patentowej w pierwszym dniu trzeciego EUROPEJSKA ORGANIZACJA PATENTOWA (European Patent Organization) (EPO) – autonomiczna pod wzglêdem administracyjnym i finansowym organizacja miêdzynarodowa, powo³ana do ¿ycia Konwencj¹ monachijsk¹ o udzielaniu patentów europejskich z dnia 5 paŸdziernika 1973 r., tworz¹c¹ regionalny system ochrony patentowej polegaj¹cy na tym, ¿e za pomoc¹ jednego zg³oszenia dokonanego bezpoœrednio w Europejskim Urzêdzie Patentowym lub za poœrednictwem w³aœciwego urzêdu pañstwa cz³onkowskiego, uzyskuje siê patent europejski wa¿ny w wyznaczonych pañstwach cz³onkowskich tej konwencji. Od chwili udzielenia patentów europejskich przekszta³caj¹ siê one w patenty podlegaj¹ce ustawodawstwu krajowemu pañstw cz³onkowskich konwencji, wskazanych przez zg³aszaj¹cego. Organami EPO s¹: Rada Administracyjna i Europejski Urz¹d Patentowy z siedzib¹ w Monachium. Aktualnie cz³onkami jest 27 pañstw (wszystkie pañstwa bêd¹ce cz³onkami Unii Europejskiej, Szwajcaria, Turcja, Cypr, Monaco oraz Czechy, S³owacja, S³owenia, Wêgry, Rumunia, Bu³garia, Estonia). Polska stanie siê cz³onkiem Organizacji z dniem 1 marca 2004 roku. ANNUAL REPORT framework of which the works on the Substantive Patent Law Treaty have been going on. Additionally, Office’s experts participated in the sub-regional seminar on ”Challenge of the patent system. Present and Future”, co-organised by WIPO and the State Lithuanian Patent Bureau in Vilnius. In November 2003 the Polish Patent Office organised in Warsaw, in co-operation with WIPO, a regional seminar on importance of industrial property to small and medium-seized enterprises. The seminar was attended by representatives of industrial property offices from the Central and Eastern Europe Countries and representatives of various professions providing support to small and medium-seized enterprises. The seminar was an event accompanying the international conference on the occasion of the 85th anniversary of industrial property protection in Poland, inaugurating the Year of Industrial Property Protection in Poland. Co-operation with the European Patent Office (EPO) In 2003 the works continued on Poland’s accession to the European Patent Convention at the invitation of the EPO Administrative Council of 29 January 1999 with a proposed effect for membership as from 1 July 2002. The works effected in the adoption by the Sejm on 19 September 2003 of the Act on the ratification of the Convention of 5 October 1973 on the grant of European patents. The instrument of accession to the Convention and to the Act of 29 November 2000 revising the Convention (ratified by Poland in 2002) was deposited at the end of 2003 with the depositary, which is the Government of the German Federal Republic. Pursuant to Article 169 of the Convention, Poland would become a member of the European Patent Organization on the first day of the third month following the EUROPEAN PATENT ORGANIZATION (EPO) – an autonomous, in terms of administration and finance, international organization established by the Munich Convention of 5 October 1973 on the grant of European patents, under which a regional system of patent protection was created whereby with one single application filed directly with the European Patent Office or through the intermediary of a competent authority of a Member State a European patent can be obtained with effect in the designated Member States of the Convention. Once a European patent is granted it is converted into a bundle of patents governed by national legislation of the Member States designated by the applicant. The EPO’s bodies are: the Administrative Council and the European Patent Office with its headquarter in Munich. At present 27 countries are members of the Organization (all the EU Member States, Switzerland, Turkey, Cyprus, Monaco, Czech Republic, Slovakia, Slovenia, Hungary, Romania, Bulgaria, Estonia). Wspó³praca z Europejskim Urzêdem Patentowym (EUP) polega³a na: u udziale ekspertów Urzêdu Patentowego RP w szkoleniach o ró¿norodnej tematyce, organizowanych i finansowanych przez EUP. W 2003 r. 13 ekspertów Urzêdu i 2 pracowników naukowych wy¿szych uczelni uczestniczy³o w 11 szkoleniach. Tematyk¹ szkoleñ by³y m.in.: ogólne zagadnienia w³asnoœci przemys³owej, niezbêdne dla osób administruj¹cych informacj¹; kompendium wiedzy o EUP dla przysz³ych pañstw cz³onkowskich z uwzglêdnieniem spraw dotycz¹cych zarz¹dzania finansami i planowania bud¿etu; zagadnienia ogólne dotycz¹ce poszukiwania i badania wynalazków; poszukiwania i badania wynalazków z dziedziny biotechnologii, fizyki, elektryki i mechaniki; procedura odwo³awcza przed EUP; poszukiwanie i badanie zg³oszeñ PCT; poszukiwanie informacji patentowej w Internecie oraz na CD, a tak¿e metody prowadzenia szkoleñ, u uczestnictwie przedstawicieli Urzêdu w corocznych konferencjach dla oœrodków i u¿ytkowników informacji patentowej PATLIB i EPIDOS, u zorganizowaniu finansowanej przez EUP corocznej konferencji naukowej „Informacja patentowa dla nauki i przemys³u”, w której udzia³ wziê³o 50 uczestników z Urzêdu, oœrodków informacji patentowej i œrodowiska rzecznikowskiego, u pomocy w organizacji, wspó³finansowanych przez EUP, konferencji i seminarium dla rzeczników patentowych, w których uczestniczyli równie¿ przedstawiciele nauki, wymiaru sprawiedliwoœci oraz Urzêdu, u udziale przedstawicieli Urzêdu Patentowego w posiedzeniach Komitetu Prawa Patentowego EOP i posiedzeniach Rady Administracyjnej EOP, które odby³y siê w Monachium, u organizacji, sfinansowanego przez EUP, uczestnictwa Urzêdu w Miêdzynarodowych Targach Poznañskich oraz wspó³finansowaniu miêdzynarodowej konferencji z okazji 85-lecia ochrony w³asnoœci przemys³owej w Polsce. Wspó³praca z Uni¹ Europejsk¹ Wspó³praca z Uni¹ Europejsk¹ koncentrowa³a siê na dzia³aniach zwi¹zanych z integracj¹ europejsk¹ oraz zbli¿aj¹cym siê przyst¹pieniem Polski do Wspólnoty. Co-operation with the European Patent Office (EPO) focused on: u participation of the Patent Office’s experts in various training courses organised and financed by the EPO. In 2003 13 Office’s experts attended 11 training courses, during which the following topics were discussed: general aspects of industrial property valuable to people administering information; general introduction on the EPO to the future member countries, including information on administering finances and budget planning; general introduction to search and examination of inventions, including biotechnological inventions, inventions in the fields of physics, electricity and mechanics; appeal procedure before the EPO; search and examination of PCT applications; searching for patent information on the Internet and on CD; training methods, participation of Patent Office’s representatives in annual conferences for patent information centres and users PATLIB and EPIDOS, organisation of an annual conference (financed by the EPO) on “Patent information for science and industry”, attended by 50 Office’s experts and representatives of patent information centres and patent attorneys, assistance in the organisation of conferences and seminars, co-financed by the EPO, for patent attorneys, which were also attended by representatives of scientific circles, judiciary and the Office, participation of Patent Office’s experts in meetings of the Administrative Council and the Committee of Patent Law, which were held in Munich, participation of the Office, financed by the EPO, in the Poznañ International Fairs and co-financing of the international conference on the occasion of the 85th anniversary of the protection of industrial property in Poland. Co-operation with the European Union Co-operation with the European Union focused on the issues pertaining to European integration and upcoming accession to the European Union. Within the scope of these works the Office participated in the process of translating of the final wording of the Accession Treaty in the following chapters: Company law, External relations, Agriculture in the part concerning “Quality policy” (in respect of the protection of geographical indications). Within the frameworks of the works of the Sub-Committee for the Internal Market the Office provided, at the request of the RAPORT ROCZNY ANNUAL REPORT Akcesyjnego w obszarze „Prawo spó³ek”, „Stosunki zewnêtrzne” oraz „Rolnictwo” – w czêœci dotycz¹cej polityki jakoœci (w odniesieniu do ochrony oznaczeñ geograficznych). Rynku Wewnêtrznego Urz¹d udziela³, na ¿yczenie Komisji Europejskiej, szczegó³owych informacji i wyjaœnieñ nt. uregulowañ zawartych w ustawie Prawo w³asnoœci przemys³owej odnoœnie zgodnoœci tych uregulowañ z acquis communautaire. W zakresie dzia³añ zwi¹zanych z integracj¹ europejsk¹ Urz¹d Patentowy przygotowywa³ dla potrzeb Urzêdu Komitetu Integracji Europejskiej materia³y informacyjne na temat realizacji zadañ wynikaj¹cych z Narodowego Programu Przygotowania do Cz³onkostwa w Unii Europejskiej oraz harmonogramu dzia³añ dostosowuj¹cych polski system prawny do wymogów Unii Europejskiej. Urz¹d przygotowa³ tak¿e wk³ad do raportu nt. realizacji Karty Europejskiej dla Ma³ej Przedsiêbiorczoœci, w którym przedstawi³ podejmowane dzia³ania maj¹ce na celu u³atwienie ma³ym i œrednim przedsiêbiorstwom dostêpu do informacji patentowej, bêd¹ce jednym z elementów kompleksowych prac podejmowanych przez Rz¹d w celu poprawy warunków funkcjonowania ma³ej przedsiêbiorczoœci i na rzecz wspomagania jej rozwoju. Przedstawiciel Urzêdu wzi¹³ udzia³ w ostatnim, przed przyst¹pieniem Polski do UE, posiedzeniu Komitetu Stowarzyszenia Rzeczpospolita Polska – Unia Europejska, które odby³o siê w Warszawie w dniu 19 wrzeœnia. W zwi¹zku z podpisaniem w kwietniu 2003 r. Traktatu Akcesyjnego i umo¿liwieniem przysz³ym krajom cz³onkowskim udzia³u w pracach organów Komisji Europejskiej i Rady na statusie aktywnego obserwatora, przedstawiciele Urzêdu brali udzia³ w posiedzeniach grupy roboczej ds. w³asnoœci intelektualnej – w pracach nad projektem rozporz¹dze- European Committee and in the context of its comments on the compliance of the Polish IPR law with the acquis communautaire, detailed explanations and information on the regulations contained in the Industrial Property Law. In the course of carrying out the tasks scheduled for realisation within the framework of the National Program for the Adaptation to Accession (NPAA) and the Timetable of the process of adaptation of the Polish legal system to the requirements of the European Union, the Patent Office was preparing, for the needs of the Committee for the European Integration, relevant studies and analyses. The Office also prepared a contribution to the report on the implementation of the European Chart for Small and Medium-Sized Enterprises, in which the activities undertaken by the Office and aimed at providing small and medium-sized enterprises with the facilities in the access to patent information were presented, which constitute one of the most important elements amongst the comprehensive undertakings of the Polish government, the objective of which is to enhance the economic conditions for the operating of small and medium-sized entrepreneurs and to give support to their development. An Office’s representative took part in the last, before Poland’s accession to the EU, meeting of the Poland – EU Association Committee that was held in Warsaw on 19 September. As a result of the signature in April 2003 of the Accession Treaty and invitation for future Member States to participate, as active observers, in the works of European Commission and Council bodies’ meetings, Office’s representatives participated in the meetings of the Working Party on Intellectual Property and its works on a proposal for a Council Regulation on the Community patent, on the revision of the Convention on the ZNAK TOWAROWY WSPÓLNOTY – znak towarowy zarejestrowany w Urzêdzie Harmonizacji Rynku Wewnêtrznego (OHIM) ) w Alicante z jednolitym skutkiem prawnym na terenie ca³ej Unii Europejskiej. The term of protection of a Community trademark is 10 years from the date of filing of an application in the OHIM or in a competent national authority. The term is renewable for subsequent 10-year periods. RAPORT ROCZNY W ramach pomocy w dzia³aniach integracyjnych Urz¹d korzysta³ z szerokich mo¿liwoœci uczestniczenia w szkoleniach, seminariach i konferencjach organizowanych zarówno w kraju, jak i za granic¹, a dotycz¹cych tematyki zwi¹zanej z integracj¹, organizowanych m.in. przez Biuro TAIEX Komisji Europejskiej. Pracownicy Urzêdu uczestniczyli w cyklu szkoleñ organizowanych przez Instytut Europejski w £odzi, w cyklu dwudniowych sesji szkoleniowych poœwiêconych procesowi decyzyjnemu UE oraz koordynacji polityki UE w pañstwie cz³onkowskim, zorganizowanych w Warszawie przez Instytut Polityki Europejskiej w Berlinie oraz Miêdzynarodow¹ Organizacjê Kszta³cenia Ustawicznego i Rozwoju w Kolonii. Dwóch przedstawicieli Urzêdu wziê³o tak¿e udzia³ w seminarium nt. znaków towarowych i oznaczeñ geograficznych, zorganizowanym przez TAIEX w Brukseli w listopadzie 2003 r. W ramach umowy bliŸniaczej z Hiszpañskim Urzêdem Patentowym, realizowanej w ramach programu PHARE, w dniach 27-28 stycznia odby³a siê, w Hiszpañskim Urzêdzie w Madrycie, wizyta studialna krajowych koordynatorów projektu wzmocnienia ochrony praw w³asnoœci intelektualnej w Polsce. Uczestniczyli w niej przedstawiciel kierownictwa UP RP oraz koordynator projektu w Urzêdzie. Wspó³praca z Urzêdem Harmonizacji Rynku Wewnêtrznego (OHIM) Urz¹d Patentowy RP nawi¹za³ wspó³pracê z OHIM w maju 2000 r. zawieraj¹c porozumienie o wspó³pracy, w którym okreœlono jej zakres i formy. Na podstawie tego porozumienia podejmowane s¹ decyzje przygotowuj¹ce Polskê do obs³ugi systemu znaku towarowego Wspólnoty, co nast¹pi z chwil¹ przyst¹pienia do Unii Europejskiej. Przedstawiciele Urzêdu zapraszani s¹ do udzia³u, w charakterze obserwatorów, w posieURZ¥D HARMONIZACJI RYNKU WEWNÊTRZNEGO (Znaki Towarowe i Wzory) (Office for Harmonization in the Internal Market (Trade marks and designs)) (OHIM) – organ Wspólnoty Europejskiej powo³any do ¿ycia rozporz¹dzeniem Rady (WE) nr 40/94 z dnia 20 grudnia 1993 r. w sprawie znaku towarowego Wspólnoty. Od dnia 1 maja 2004 r. jego cz³onkami bêd¹ tak¿e pañstwa przystêpuj¹ce do Unii Europejskiej, w tym Polska. Zadaniem OHIM jest przyjmowanie zg³oszeñ znaków towarowych i wzorów przemys³owych oraz udzielanie im ochrony poprzez rejestracjê, której skutek prawny automatycznie rozci¹ga siê na teren ca³ej Unii Europejskiej. Siedzib¹ OHIM jest Alicante w Hiszpanii. ANNUAL REPORT Within the framework of the program of assistance in integration activities the Office availed itself of many possibilities of delegating its staff members to participate in numerous training courses, seminars and conferences on the issues dealing with the European integration, organized both on the spot in Poland and abroad by, among others, the TAIEX Office of the European Commission. Office’s experts participated in a series of training courses organized by the European Institute in £ódŸ, in a series of two-day training sessions on the decision-making procedure in EU and EU policy coordination in Member States, which was organized in Warsaw by the Institute for European Policy in Berlin and International Organization for Education and Development in Köln. Two Office’s experts attended a seminar on trademarks and geographical indications organized by the TAIEX in Brussels in November 2003. Within the framework of the twining covenant with the Spanish Patent Office implemented within the PHARE program, there was a study mission to the Spanish Patent Office in Madrid from 27 to 28 January for coordinators of the project on the Reinforcement of the protection of intellectual property rights in Poland. The Patent Office was represented by a member of the Office’s management and the coordinator of the project at the Office. Co-operation with the Office for Harmonization in the Internal Market (OHIM) By virtue of an agreement signed by the Presidents of the two Offices in May 2000 (Memorandum of Understanding), the Patent Office of RP entered into co-operation with the Office for Harmonization in the Internal Market (OHIM), the scope and forms of the co-operation being specified therein. Under the provisions of the Memorandum a number of various forms of activities are undertaken aimed at preparing Poland to operate the Community Trademark system as from the date of Poland’s OFFICE FOR HARMONIZATION IN THE INTERNAL MARKET (TRADE MARKS AND DESIGNS) (OHIM) – a body of the European Community established by Council Regulation (EC) 40/94 of 20 December 1993 on the Community trademark. On 1 May 2004 the countries acceding to the European Union, including Poland, will become its members. An OHIM’s responsibility is receiving trademark and design applications and granting protection by registration, the legal effect of which extends automatically to the whole territory of the European Union. The OHIM’s headquarter is in Alicante in Spain. W trakcie tej imprezy eksperci Urzêdu Patentowego RP uczestniczyli w warsztatach dotycz¹cych skutków dokonywania zg³oszeñ za pomoc¹ Internetu; przyczyn niewa¿noœci znaku towarowego, naruszania prawa i nielegalnego podrabiania, a tak¿e systemu wzoru Wspólnoty (jego zalet i procedury), rozszerzenia UE i jego wp³ywu na system znaku towarowego Wspólnoty oraz wzoru Wspólnoty; nowych rodzajów znaków towarowych, wykonywania ochrony znaku oraz ochrony znaków w Internecie. Among others, representatives of the Office are invited to participate, at observer status, in meetings of the OHIM Administrative Board and Budget Committee and Liaison Committees, they attend training courses, workshops and seminars on the Community Trademark system organized both in the OHIM headquarter in Alicante and in Warsaw. In 2003 representatives of the Office took part in three subsequent meetings of the OHIM Liaison Committee on procedure and practice, information technologies and the Community Design. In November for the first time they were also invited to participate in the meeting of the OHIM Administrative Board and the Budget Committee. One of the most important events organized by OHIM jointly with the Hungarian Patent Office was the “EUROFORUM – Trademarks” held in Budapest. The Polish Patent Office was represented by three experts, who during the event attended the workshops on effects of filing applications via Internet; grounds for invalidation of the trademark, infringement of rights and illegal counterfeiting, and on the Community design system (its advantages and procedures), EU enlargement and its impact on the Community trademark and Community design systems; on new kinds of trademarks, enforcement of rights in trademark registration and the protection of trademarks on the Internet. Throughout the year under review, the Office was transmitting to the OHIM the information and explanations on the Polish regulations in respect of the protection of trademarks, the Office’s practice in carrying out searches in the non-trademark related documentation, publications and official bulletins. The Office was also providing statistical data concerning the number of trademark applications and registrations. Verification of the translation into the Polish language of the OHIM brochures, forms and EUROLOCARNO classification was made. Meetings of the presidents of the Industrial Property Offices of the Vyshegrad Group countries (Czech Republic, HunPATENT CO-OPERATION TREATY (PCT) – an international agreement signed in Washington in 1970 under the aegis of the World Intellectual Property Organization (WIPO) in Geneva. The present 123 States – parties to the PCT constitute a Union for co-operation in the filing, searching, and examination, of applications for the protection of inventions, designed to enable an applicant to assess his chances to obtain patent protection for his invention in selected Contracting Parties of the Treaty. ANNUAL REPORT gary, Poland and Slovak Republic) have been taking place, alternately in the capitals of the member states, since over ten years already. In 2003, the meeting was held in Bratislava. During the session information were exchanged on legislative and organisational works undertaken by the Offices within the period from the former meeting held in 2002 in Prague. The works mainly focused on further harmonization of the national regulations with the acquis communautaire and the preparation of the Offices to new challenges resulting from the membership in the European Union. The Czech, Slovak and Hungarian delegations shared their experiences from their membership in the European Patent Organization, while the delegation of Poland provided information on the state of preparatory works for the forthcoming accession to that Organization. The issues of cooperation within the framework of the European Patent Organization (development and implementation of joint programmes), Office for Harmonization in the Internal Market in Alicante (a need for preparation of an on-line data base on Community trademarks which would replace the present one on CD), as well as works for patent offices resulting from the reform of the Patent Co-operation Treaty (PCT) going on in the World Intellectual Property Organization in Geneva, were also discussed. It was agreed to hold the next meeting in 2004 in Poland. Two members of the PPO’s management participated in the celebrations of the 75th anniversary of the entering in force of the first Lithuanian patent law. The President of the Patent Office – Dr. Alicja Adamczak participated in the celebrations of the 10th anniversary of the foundation of the Industrial Property Office of the Slovak Republic (Banska Bystrica). One PPO’s representative took part in the celebrations of the 10th anniversary of the entering into force of the Bulgarian patent law and the first anniversary of Bulgaria’s accession to the Convention on the grant of European patents, as well as in the conference on “Bulgaria and the European patent system – developments and prospects” in Sofia.
