Information on the German market Current as of October 2001 GERMANY Regulation There are no specific legal regulations on insurance intermediation. Registration a) It is compulsory to register (in a trade register) as a self-employed insurance intermediary (Gewerbe anmeldung) b) In addition, all insurance intermediaries must be registered with the AVAD. Any employer who employs an insurance intermediary must notify the AVAD. (AVAD is an institution managed jointly by the Gesamtverband der Deutschen Versicherungswirtschaft and the insurance intermediaries' professional associations. Qualification There are no compulsory requirements regarding the training of insurance intermediaries. All training facilities are on a voluntary basis: e.g. through a joint voluntary initiative, the German insurance market introduced in 1993 a qualification programme for intermediaries leading to a certificate. Professional indemnity insurance Insurance intermediaries are not legally required to have a professional indemnity insurance. No figure are available on how many agents/brokers in practice have concluded a PI-coverage although they are not legally requested to do so. There are today in Germany 7 PI-carriers but there is a tendency for an up going number of companies to offer this coverage , the reason being partly the impending transition of the IMD into national law. Code of conduct The code of conduct for insurance agents is contained in the competition guidelines of the insurance industry which are established by the associations of the insurance industry and insurance agents. For brokers, the "Gesamtverband der Deutscher Versicherungswirthschaft" and the "Bundesverband Deutscher Versicherungsmakler" as well as other associations of insurance intermediaries have published a "catalogue designed to avoid abusive brokerage contracts". In the case of abusive conduct, the BAV can impose sanctions on an intermediary. The members of the " Bundesverband Deutscher Versicherungskaufleute, BVK" are obliged to follow the " Rules of professional conduct". These "rules" have been part of the association by-laws since 1978. Rejestracja istnieje obowiązek rejestracji w rejestrze handlowym jako samodzielnego pośrednika ubezpieczeniowego (Gewerbe anmeldung); dodatkowo każdy pośrednik ubezpieczeniowy musi być zarejestrowany w AVAD. Pracodawca, zatrudniający pośrednika ubezpieczeniowego, musi o tym powiadomić AVAD. (AVAD jest instytucją wspólnie zarządzaną przez Stowarzyszenie Niemieckich Ubezpieczycieli i zawodowe stowarzyszenia pośredników ubezpieczeniowych). Kwalifikacje Nie ma obowiązkowych wymagań w sprawie szkolenia pośredników ubezpieczeniowych. Wszystkie programy szkoleniowe oparte są na zasadach dobrowolności. Na przykład w 1993 roku, przez wspólną inicjatywę, niemiecki rynek ubezpieczeniowy wprowadził program kwalifikacyjny, umożliwiający pośrednikom ubezpieczeniowym uzyskanie certyfikatu. Zawodowe OC Nie ma prawnego wymogu posiadania przez pośredników ubezpieczeniowych profesjonalnego ubezpieczenia OC. Kodeks postępowania Kodeks postępowania dla agentów ubezpieczeniowych jest zawarty w dokumencie "Podstawowe zasady konkurencji w przemyśle ubezpieczeniowym", ustanowionym przez stowarzyszenia przemysłu ubezpieczeniowego i agentów ubezpieczeniowych. W odniesieniu do brokerów - Stowarzyszenie Niemieckich Ubezpieczycieli i Stowarzyszenie Niemieckich Brokerów, wraz z innymi stowarzyszeniami pośredników ubezpieczeniowych ustanowiły "Katalog unikania nadużyć umów brokerskich". W wypadku nieodpowiedniego zachowania organ nadzoru może nałożyć sankcje. Członkowie Niemieckiego Stowarzyszenia Brokerów (Bundesverband Deutscher Versicherungskaufleute - BVK) są zobowiązani do przestrzegania "Zasad postępowania zawodowego", które od 1978 roku są częścią składową statutu stowarzyszenia.
