Delegacje otrzymują w załączeniu wniosek Europolu w sprawie nowego sprawozdania dotyczącego sytuacji i tendencji w dziedzinie terroryzmu (TE-SAT) w brzmieniu uzgodnionym przez Grupę Roboczą ds. Terroryzmu podczas posiedzenia w dniach 3-4 kwietnia 2006 r. i poprawionym na podstawie uwag zgłoszonych przy okazji posiedzenia Komitetu Art. 36 w dniach 11-12 kwietnia 2006 r. 2. Podczas posiedzenia w dniach 16-17 maja 2006 r. Komitet Art.36 zatwierdził wniosek znajdujący się w załączeniu. Na tej podstawie wzywa się COREPER do zwrócenia się do Rady, by przyjęła do wiadomości i zatwierdziła wniosek Europolu w sprawie nowego TE-SAT. ___________ 8196/2/06 REV 2 jm/PPA/gt DGH II 1 PL ANNEX The Hague, 10 May 2006 EUROPOL File nº 2566-387r1 Proposal of Europol for the New TE-SAT 1. Introduction According to the ENFOPOL 41 REV 2 (8466/2/01), the Terrorism Situation and Trend Report (TE-SAT) is intended to inform the European Parliament on the phenomenon of terrorism in the Member States. Furthermore, the Council could take into account the TE-SAT when developing policies on counter terrorism. The report is unclassified and does not contain any information which, if distributed, could compromise investigations under way or the fight against terrorism. The Presidency is responsible for drafting the TE-SAT based on a file and analyses supplied by Europol. To date, Europol has compiled four TE-SAT reports since the requirement for the paper was agreed in 2001. In the Terrorism Working Party (TWG) meeting in January 2006, Europol proposed to widen the data collection for the TE-SAT in order to enhance the quality of the report. On 7 March 2006, Europol was asked by the TWG to develop a proposal for a new TE-SAT. In line with the Council conclusions on intelligence-led policing and the development of the Organised Crime Threat Assessment (OCTA) on 12 October 2005 (CRIMORG 56), the Council is requested to task Europol to draw up the new TE-SAT. 8196/2/06 REV 2 ANNEX NB/mp DGH II 2 EN 2. Nature and Aim of the New TE-SAT The new TE-SAT remains an unclassified document, which is intended to inform the European Parliament of the phenomenon of terrorism in the EU. It will also be forwarded to the Council and can be used to inform the public. The ownership of the TE-SAT changes in line with the OCTA developments. The TE-SAT becomes a Europol product. Europol is responsible for developing the methodology for the new TE-SAT in consultation with the contributors. The TE-SAT will not contain information which is classified, falls under data protection law or information which could jeopardise ongoing investigations. The data collection plan and the intelligence requirement for the new TE-SAT will be coordinated by Europol and the draft TE-SAT will be discussed with the contributors. The final report will be agreed within Europol structures. 3. Procedure for the New TE-SAT In the beginning of each year Europol will draw up the TE-SAT report. The TE-SAT will be handed over to the European Parliament and the Council by latest on 31 March. The reporting period starts on 1 January and ends on 31 December. Member States' contributions continue to serve as the main input into the TE-SAT. Europol will send the Intelligence Requirement to Member States and all other potential contributors by 31 August. Member States' contributions to the TE-SAT are expected no later than 31 January. Other contributions for the TE-SAT report will also include, subject to the limitation on the use of classified information set out in paragraph 2 above: • Open sources; 8196/2/06 REV 2 ANNEX NB/mp DGH II 3 EN • EU and Member States' reporting related to the phenomenon of terrorism (such as various documents produced by the TWG, the SITCEN, the CTG, Eurojust and the Commission); • Europol's own information including strategic output from the relevant AWFs; and • Information provided to Europol by Third States and Organisations.
