TERMS AND CONDITIONS of purchasing neostamp under Envelo §1 DEFINITIONS BOK PPUC: PPUC's Customer Service Office in Warsaw, ul. Stanisława Żaryna 2 C, 02-593 Warsaw. BOK may be reached by calling 801 500 200 or sending an e-mail to [email protected]. Customer Data: any and all text data, including personal data, which the Customer enters during the process of selecting a neostamp using Envelo platform's functionalities available to the Customer. Envelo: Internet platform, in the form of an organized ICT system, which is operated and maintained by PPUC and may be accessed by going to http://envelo.pl/, on which e.g. neostamps may be selected and purchased. My account: an individual interactive account kept (under Envelo) by PPUC for the Customer, hereinafter also referred to as the "User", under a unique name (login), in which the information on the Customer's actions taken within the Envelo platform is stored and which gives the Customer (User) the opportunity – after logging in to it – to use the functionalities available under My account. neostamp: a postage stamp which constitutes the confirmation of payment for common postal service provided by Poczta Polska S.A., containing the information on the amount of the payment for the postal service and the Data matrix which can be used to verify its validity; it is purchased by the Customer and then printed on the carrier selected by the Customer such as an envelope, a self-adhesive label or paper. Neostamp may be used for common domestic and foreign non-registered letters. Neostamp selected by the Customer may be personalized using functionalities available under Envelo. Customer: a natural person or legal entity (represented by the duly authorized person) having full capacity to perform legal actions. In the case of natural persons without capacity to perform legal actions or natural persons with limited capacity to perform legal actions, the Customer should be properly represented by his/her legal guardian or act with the consent of such legal guardian. The Customer may purchase neostamp(s) in his/her/its own name. If it is purchased in the name of a third party, it is necessary to obtain a proper authorization in that regard. The Customer may purchase neostamp(s) as a Consumer or as an Entrepreneur. To that effect, when purchasing neostamp(s) the Customer is asked to state his/her/its status. Data matrix: data matrix defined according to coding conditions applicable to the digital postage stamp; it is encrypted and signed electronically, and it constitutes neostamp's Spółka Poczta Polska Usługi Cyfrowe Sp. z o.o. z siedzibą w Warszawie przy ul. Data matrix is the basic element that identifies the validity of a given neostamp. Consumer: Customer which is a consumer within the meaning of Article 22 (1) of the Civil Code. Fee: a nominal value, which is explicitly stated on neostamp and which corresponds to the price of a common postal service provided by Poczta Polska S.A. Electronic Payments Operator: an entity performing the authorization, i.e. confirming that the person who uses the given payment card or bank account is authorized to make the payment (e.g. he/she/it has sufficient funds on the account), and settling and processing the transaction; this entity is eCard S.A. with its registered office in Gdańsk, ul. Arkońska 11, 80-387 Gdańsk, entered in the business register kept by the District Court for Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register, under file no. KRS 0000042304, with share capital of PLN 16,840,000 (paid in full) and taxpayer identification number (NIP): 5213103040. PPUC: Poczta Polska Usługi Cyfrowe Sp. z o.o. with its registered office in Warsaw, ul. Stanisława Żaryna 2 C, 02-593 Warsaw, entered in the Business Register kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under file no. KRS 0000425263, with share capital of PLN 11,000,000.00, NIP: 525-25-33-454. Poczta Poczta Polska Spółka Akcyjna with its registered office in Warsaw (address: ul. Stawki 2, 00-940 Warsaw), entered in the Business Register kept by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under file no. KRS 0000334972, with share capital of PLN 774,140,000 (paid in full), NIP: 525-000-73-13 – an entrepreneur authorized to perform postal operations on the basis of an entry in the register of postal operators, pursuant to the Act of 23 November 2012 entitled Postal Law (Journal of Laws of 2012 item 1529). Polska S.A.: Entrepreneur: Customer which has the status of an entrepreneur within the meaning of the relevant prevailing regulations Terms and Conditions: these Terms and Conditions with all the attachments. IT System: an ICT system which is in PPUC's disposal and is used to conduct sales of neostamps; it includes in particular the computer hardware, servers and peripheral devices. Agreement: the agreement to purchase neostamp, concluded electronically between PPUC and the Customer using Envelo. Agreements are concluded with Customers with the status of a Consumer or an Entrepreneur. For the purpose of concluding the Agreement, only Customers with the status of an Entrepreneur must have the place of residence or address of registered office on the territory of the Republic of Poland. In these Terms and Conditions, each time purchase of neostamp is mentioned, this also includes one-time purchase of many neostamps selected by the Customer. §2 INITIAL PROVISIONS 2.1. The Terms and Conditions define the terms and conditions of purchasing neostamp under Envelo. 2.2. Everyone may familiarize himself/herself/itself with the Terms and Conditions free of charge. The content of the Terms and Conditions may be printed, downloaded and multiplied using any technique and recorded on any carrier. 2.3. The Terms and Conditions are provided prior to conclusion of the Agreement in the form allowing their recording, storage and retrieval. 2.4. The Terms and Conditions may be browsed and downloaded from the Envelo platform at http://envelo.pl/regulamin.neoznaczek/, “Terms and Conditions” tab. In addition, upon Customer's request, PPUC will send the Customer the copy of the Terms and Conditions in the electronic form to the e-mail address specified by the Customer. 2.5. PPUC advises all the Customers that – except for neostamp's nominal value which corresponds to the Fee (and is equal to the price of a common postal service provided by Poczta Polska S.A. prevailing on the date of purchasing neostamp) – these Terms and Conditions do not regulate any other terms and conditions of concluding agreements for provision of postal services between the Customer and Poczta Polska S.A. involving neostamps purchased by the Customer. §3 SPECIFICATION AND FUNCTIONALITY 3.1. PPUC gives the Customer the following options: 3.1.1. selection of the nominal value of neostamp and personalization of the same, under Envelo functionalities, by way of: 1) using the graphics available under Envelo, referred to under item 3.2 below; 2) placing individual graphics on the same, referred to under item 3.3 below; 3.1.2. performing electronic conversion of neostamp selected by the Customer into a printable document; 3.1.3. downloading or printing neostamp directly from the website provided by PPUC with the use of a code received from PPUC; the code's expiration date is 365 calendar days, however in no case will it fall after neostamp's expiration date; 3.1.4. receiving neostamp as a PDF file (or a PDF file containing the neostamp and the graphics referred to under items 3.2 to 3.3 below) – as an attachment to an e-mail message (however, this option does not apply to one-time purchase of more than 100 neostamps). The Customer may personalize neostamp with graphics provided by PPUC, i.e. with a multimedia object (e.g. a graphical file or a picture) provided by PPUC (hereinafter “Graphics”). PPUC authorizes the Customer to use Graphics to compose neostamp and send a letter with neostamp on it to the addressee. The Customer is authorized and obligated to use Graphics to the extent and on terms and conditions provided under prevailing regulations 3.3. In order to use individual graphics, the Customer uses his/her/its own multimedia object in the form of a graphical file or a picture (hereinafter “Customer’s Graphics”). After unloading the same to Envelo, the Customer may post the graphics in the field located directly next to the selected neostamp. Following the Customer’s approval for such composition, Envelo generates a PDF file for the Customer, which contains neostamp and the Customer’s Graphics next to it. Technical requirements, including the format and type of a file for Customer’s Graphics, are defined in item 5.2. of these Terms and Conditions. The Customer is authorized and obligated to use Customer’s Graphics to the extent and on terms and conditions provided under prevailing regulations. PPUC advises that in order to use the aforesaid functionality, the Customer has to log in to My account. The My account service is regulated under separate terms and conditions (Terms and Conditions for My Account under Envelo). 3.4. PPUC advises that the generated (with one of the aforesaid options), paid and then printed neostamp constitutes the postage stamp of Poczta Polska S.A. for a common domestic or foreign non-registered letter, as selected by the Customer. 3.5. PPUC advises that neostamp may be used only once, which is subject to verification by Poczta Polska S.A. by way of scanning the unique Data matrices on neostamps. If an attempt is made to use the same neostamp for the second time (i.e. containing the same Data matrix), the letter verification system of Poczta Polska S.A. will detect the same and consider it as unpaid postage. 3.6. In addition, PPUC advises that: 3.6.1. neostamp's expiration date determined by Poczta Polska S.A. falls 365 calendar days from the date of its purchase; 3.6.2. it is not possible to affix two or more neostamps on the same letter; 3.6.3. it is forbidden to modify neostamp or any constituent part of the same in any way, before printing it as well as after it is printed; 3.6.4. for Customer’s Graphics it is forbidden to add any contents that are illegal or offensive, considered as non-compliant with the principles of social coexistence and breaching the rights of third parties.; 3.6.5. at any moment after dispatch of the letter with neostamp affixed to it, Poczta Polska S.A. may verify whether the amount of postal fee, i.e. nominal value of the given neostamp, is appropriate for the selected type of letter. If it is found that it is necessary to make additional payment so that the total payment would be equal to Poczta Polska S.A.'s fee in effect on the date of dispatch, the additional payment will be made in accordance with the relevant regulations of Poczta Polska S.A.; 3.6.6. after the Customer has already purchased neostamp, a possible additional payment which should be made so that the total payment would be equal to Poczta Polska S.A.'s fee in effect on the date of dispatch, can only be made with postage stamps or other postal fee payment certificates purchased in Poczta Polska S.A.'s outlets. The Agreement will be concluded with the Customer when the Customer subsequently meets all the following conditions: 4.1.1. defines the nominal value of neostamp, 4.1.2. selects neostamp without graphics or uses one of the functionalities referred to under items 3.2 to 3.3 above, 4.1.3. correctly fills out all the fields of the order form, which must be completed in order to purchase neostamp, including selection of the method and form of payment for neostamp; 4.1.4. the Customer expresses his/her/its consent for the content of the Terms and Conditions through checking the relevant checkbox on the form; 4.1.5. the Customer accepts the terms and conditions of making the payment for neostamp purchased. 4.2. Customer's acceptance of the Terms and Conditions in the manner described in item 4.1.4 above also means that the Customer represents that: 4.2.1. he/she/it has familiarized himself/herself/itself with the content of the Terms and Conditions and accepts all of their provisions without reservations; 4.2.2. the User has acceded to the Agreement voluntarily; 4.2.3. the data included on the order form are consistent with the actual state of affairs and correct. 4.3. The Agreement may not be executed unless the Terms and Conditions have been accepted. 4.4. The content of the Agreement with the Customer is comprised of the Terms and Conditions and the neostamp order form filled out by the Customer. 4.5. On the basis of the concluded Agreement, the Customer is obligated to pay the Fee by the deadline and in the manner contemplated in the Terms and Conditions and the terms and conditions of the Electronic Payments Operator. 4.6. The Customer may make the payments for purchasing neostamp via online transfer or with a payment card. Detailed rules for making the payments for purchasing neostamp are defined in the terms and conditions of the Electronic Payments Operator. 4.7. If payment is made with a payment card, the funds will be returned directly to the Customer's card. 4.8. Immediately after the payment is recorded, PPUC will allow the Customer to download neostamp, record it on a hard drive or print it, in the manner defined in the Terms and Conditions. 4.10. PPUC allows the possibility of downloading neostamp and recording it on a hard drive during the entire term prior to its expiration, i.e. 365 days, however neostamp may be used as payment for a letter only once. The consequences of using the same neostamp for the second time (or multiple times) are described in item 3.5. of the Terms and Conditions. §5 TECHNICAL REQUIREMENTS 5.1. In order to purchase neostamp, the Customer must have: 5.1.1. Internet access with a correctly functioning and configured browser through which web pages may be accessed, such as: Microsoft Internet Explorer, version 8.X or higher, Mozilla Firefox, version 3.6 or higher, Google Chrome, version 13.X or higher, Opera, version 10.X or higher, Safari, version 5.X or higher, 5.1.2. e-mail address, 5.1.3. as well as other necessary software, including software for reading PDF files (the newest version of Adobe Reader software is preferred). 5.2. The functionalities referred to in item 3.3. of the Terms and Conditions require the Customer's Graphics delivered with the following technical parameters: Spółka Poczta Polska Usługi Cyfrowe Sp. z o.o. z siedzibą w Warszawie przy ul. Customer’s Graphics required resolution: 28x21 mm, 300 dpi, 336x252 pixels. 5.3. The Customer must meet the following technical requirements in order to be able to print neostamp: the Customer must have the software enabling readout and printout of PDF files and the Customer must have an ink or laser printer which can print with resolution of at least 300 dpi. 5.4. In order to use certain functionalities of Envelo and in order to achieve full capacity of the same, the Customer may be required to enable the SSL cryptographic protocol which provides communication security over the Internet, Java, Java Script, Flash and Cookies. 5.5. Launch of certain Envelo functionalities may require fulfillment of additional technical conditions, about which the Customer will be informed before using them. 5.6. PPUC is not liable for loss of Customer's contents or data, which cannot be attributed to PPUC and which has been caused by failure of hardware or system or other circumstances which are beyond PPUC's control but are associated with the Customer's hardware. 5.7. PPUC is not liable for technical problems or technical limitations of hardware, ICT system or telecommunication infrastructure used by the Customer, which make it impossible or difficult for the Customer to purchase neostamp. 5.8. PPUC is not liable for the quality and looks of the Customer’s Graphics and technical errors or incorrect format of the same, which make it impossible or difficult for the Customer to purchase neostamp with the Customer’s Graphics. 5.9. PPUC advises that there may occur slight differences in color between the Graphics or the Customer’s Graphics visible on the Customer's equipment and the final printout of neostamp using one of the aforesaid graphics. 5.10. PPUC advises that for technical and organizational reasons it is not possible to receive a single order for more than 100 neostamps via e-mail. §6 RIGHTS AND DUTIES OF THE CUSTOMER 6.1. When using Envelo, the Customer is at all times obligated to provide correct data. The data should be accurate, up-to-date and cannot be misleading. This is the requirement which must be met in order for PPUC to be able to guarantee that the Agreement with the Customer will be correctly performed. 6.2. When purchasing neostamp (using the Envelo platform), the Customer can access his/her/its data (Customer Data), and he/she/it may modify and update them. Rules of personal data processing are regulated in the document entitled Privacy Policy which is posted on http://envelo.pl/Polityka.prywatności/, as well as on Envelo's main website. 6.3. The Customer undertakes to comply with the provisions of the Terms and Conditions. 6.4. When purchasing neostamp (using the Envelo platform), the Customer is obligated to observe the law, good practices and principles of social coexistence, and not to breach the rights of third parties. PPUC recommends that the Customer contributes to Envelo's correct functioning by immediately notifying it about each and every instance of suspected breach, actual breach and gaining unauthorized access to Envelo, which is known to the Customer. 6.6. The Customer cannot transfer to third parties the rights and duties which he/she/it gained under the Agreement. §7 BAN ON ILLEGAL ACTIVITIES 7.1. In the course of the process of purchasing neostamp (using the Envelo platform), the Customer is forbidden from delivering illegal contents. In particular, no person may introduce or store – whilst using Envelo – any materials which breach the provisions of law, good practices or rights of third parties. Specifically, the Customer must not use Envelo to introduce or process any materials or contents: 7.1.1. which breach the law, the principles of social coexistence or good practices, including pornographic materials, racist contents, or materials whose contents are commonly considered obscene or offensive; 7.1.2. which breach or may breach the rights of third parties, in particular proprietary copyrights or personal copyrights, company secret, industrial property rights, image rights or other personal goods of third parties, including PPUC or other Customers; 7.1.3. which breach or may breach the rights to trademarks, geographic signs, company signs, rights to business name or any other protected designations of origin of goods or services. 7.2. The Customers are forbidden from using Envelo in the manner breaching the Terms and Conditions or for purposes contradictory to the provisions of law, rules of social coexistence, good practices and the commonly accepted rules of conduct (including the principles of netiquette). 7.3. The aforesaid is also applicable to the Customer’s Graphics. When using the Customer’s Graphics, the Customer is forbidden from posting any materials and contents which breach the rights and interest of third parties and whose contents are commonly considered offensive, breach the principles of social coexistence, ethical standards and good practices. 7.4. Having regard to the type and scope of Services provided by PPUC in cooperation with Poczta Polska S.A., the Customer using the Customer’s Graphics cannot infringe the reputation or damage the interest of both the aforesaid entities. 7.5. Therefore, PPUC advises the Customer that pursuant to Article 16.1.3 Poczta Polska S.A. refuses to conclude a postal service agreement or may withdraw from such agreement if packaging of a letter or a visible part of its contents contains inscriptions, pictures, drawings or other graphic symbols that breach the law or postage stamps that are not compliant with statutory requirements. §8 RIGHTS AND DUTIES OF PPUC 8.1. PPUC ensures availability of Envelo and its functionalities, including technical assistance, and it also oversees the correct usage of Envelo by the individual Customers. 8.3. PPUC does not verify the contents or looks of the Customer’s Graphics. 8.4. PPUC has the right to temporarily suspend the operation of Envelo, its selected functionalities as well as the entire Envelo to perform maintenance, repairs or technical inspections. In such case, PPUC will make every effort to ensure that suspension of operations of the Envelo platform or its selected functionalities will not last longer than five business days. The Customer will be informed about the aforementioned circumstance properly in advance via e-mail message. 8.5. PPUC has the right to temporarily suspend the operation of Envelo, My account and the selected functionalities of My account or Envelo, or the entire Envelo platform in the case of occurrence of technical failure, about which fact the Customer will be informed via message displayed on Envelo's main page or after logging in to My account. Suspension of operation of My account, its functionalities or the entire Envelo should not last longer than 10 business days, and if the failure has significant consequences, PPUC will make all efforts to ensure that suspension of their operation lasts no longer than 10 consecutive business days. §9 CUSTOMER SERVICE PROVIDED BY BOK PPUC 9.1. PPUC provides the Customer with access to BOK PPUC on business days between 8 am and 8 pm at phone no. 801 500 200 and via e-mail at [email protected]. 9.2. The Customer may contact BOK PPUC to report technical problems, questions and doubts related to operation of My account or Envelo. Each Customer, when contacting BOK PPUC, should provide his/her/its contact details and precisely describe the problem. § 10 INTELLECTUAL PROPERTY 10.1. The Customer is obligated to comply with regulations concerning intellectual property rights, in particular the provisions of the Act of 4 February 1994 on Copyrights and Neighboring Rights (Journal of Laws of 1994 no. 24, item 83) and the Act of 30 June 2000 entitled Industrial Property Law (Journal of Laws of 2001 no. 49, item 508). The Customer is obligated to respect the intellectual property rights of third parties. 10.2. It is forbidden to transfer, resell, modify, copy or provide for commercial purposes any materials which may be obtained under Envelo. 10.3. Any and all intellectual property rights associated with Envelo, in particular rights to graphic elements of neostamp and Envelo, logotypes, illustrations, pictures, website layout, website contents, concepts of activities, technical solutions, functionalities, software, databases, software documentation – are the exclusive property of PPUC or the entities collaborating with PPUC, including the entities from the Poczta Polska S.A. capital group. PPUC grants to the Customer the non-exclusive license to use the software related to Envelo, in the scope necessary to use Envelo. 10.5. The Customer represents that he/she/it has the relevant authorizations concerning the contents posted and stored by him/her/it whilst using Envelo, in particular he/she/it remains in compliance with the proprietary copyrights and neighboring rights within the meaning of the Act of 4 February 1994 on Copyrights and Neighboring Rights (Journal of Laws of 1994 no. 24, item 83) and the industrial property rights within the meaning of the Act of 30 June 2000 entitled Industrial Property Law (Journal of Laws of 2001 no. 49, item 508). Besides, the Customer represents that in the case of using pictures, it holds relevant consents to use the image of persons in such picture, to the extent authorizing the Customer to use the picture as the Customer’s Graphics under Envelo. 10.6. When using the Customer’s Graphics, the Customer represents that, to the extent of materials or contents provided in connection with this functionality, the Customer holds relevant rights, referred to in item 10.5 above, and that he/she/it will not breach any rights of third parties, in particular property rights or personal copyrights, industrial property laws and the reputation of any entity. The Customer is fully liable for breaching the rights of third parties in connection with the use of User’s Graphics. § 11 FORCE MAJEURE, GOVERNING LAW AND COURT WITH RELEVANT JURISDICTION 11.1. Neither PPUC nor the Customer will be liable for delay in performance, non-performance or inadequate performance of the Agreement which has resulted from a force majeure event. 11.2. The applicable law, as defined hereunder, is the Polish law. 11.3. Any disputes which may result from the Agreement will be resolved by common courts with general jurisdiction. 11.4. Provisions of the Civil Code will apply to the matters not governed by the Terms and Conditions. § 12 LIABILITY 12.1. As part of performance of the Agreement, PPUC does not create, verify or in any way change any data entered by the Customer. This applies in particular to the above-specified Customer Data as well as any and all effects gained by the Customer in the course of usage of the functionalities available under Envelo. 12.2. The Customer is exclusively and fully liable for the contents of the Customer Data entered by him/her/it and the consequences of using them. 12.3. In the light of the Act of 18 July 2002 on Electronic Provision of Services, PPUC is not the initiator of the transfer of Customer Data, which the Customer performs in connection with gaining the access to and using Envelo, it does not choose the recipients of Customer Data and it does not choose or modify the Customer Data. PPUC does not monitor the content of Customer Data. § 13 COMPLAINTS 13.1. The Customer has the right to submit complaints concerning Envelo and its functionalities. Complaints may pertain to a choice to conclude and conclusion of the Agreement to purchase neostamp as well as the consistency of the received neostamp with the description found in the Agreement concluded. 13.2. A complaint should contain the following: - full name, company name or business name, place of residence or address of registered office of the party submitting the complaint; - description of the event to which the complaint pertains; - justification for the complaint; - signature of the person submitting the complaint – if the complaint is submitted in writing. 13.3. The complaint may be sent electronically to [email protected] or in writing to the mailing address at ul. Stanisława Żaryna 2 C, 02-593 Warsaw. 13.4. The complaint may be submitted no later than within 12 months from the date of concluding the Agreement. 13.5. If the submitted complaint does not meet PPUC's requirements, PPUC will summon the person submitting the complaint to make corrections to the complaint within 7 days from delivery of the summons. This period will not be included in the deadline for examining the complaint. 13.6. If the corrections referred to in item 13.5 above are not made, the complaint will not be examined, and PPUC will immediately notify the person submitting the complaint about that fact. 13.7. PPUC will examine the complaint and provide an answer to the person submitting the complaint within 14 business days from its receipt. 13.8. PPUC advises that the foregoing complaint procedure does not apply to the agreement with Poczta Polska S.A. for provision of postal services related to a common domestic non-registered letter paid for with neostamp. § 14 CHANGE OF TERMS AND CONDITIONS 14.1. PPUC will have the right to change the provisions of the Terms and Conditions for any of the following important reasons: 14.1.1. a need to adapt the Terms and Conditions to applicable laws, in particular new (revised) laws; Spółka Poczta Polska Usługi Cyfrowe Sp. z o.o. z siedzibą w Warszawie przy ul. Warszawy, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego pod nr KRS 0000425263, NIP 525-25-33-454, o kapitale zakładowym 11 000 000 zł (w całości wpłaconym) Strona 11 z 12 14.1.2. the need to adjust PPUC's activity to, respectively, recommendations/orders/verdicts/resolutions/guidelines or decisions of the authorized state administration/local government/tax authority or the court ruling pertaining to PPUC; 14.1.3. change of the data of the entities described in the Terms and Conditions (e.g. number of entry in the National Court Register (KRS), address, etc.) or change of the entities named in the Terms and Conditions; 14.1.4. introduction of new Envelo functionalities and changes in the methods of neostamp's distribution related thereto; 14.1.5. change of technical conditions or parameters affecting Envelo functionalities concerning the distribution of neostamp (e.g. introduction of new technical requirements); 14.1.6. the need to adjust the Terms and Conditions to best practices of online distribution of goods and services, including best practices in the area of protection of Customers' rights. 14.2. PPUC will announce a change of the Terms and Conditions by displaying a notification about changes made to Terms and Conditions with consolidated version of the Terms and Conditions under My account and Envelo, and by posting the new version of the Terms and Conditions (with the indicated changes) in the Envelo platform. In addition, the notification about changes made to the Terms and Conditions with the consolidated version of the Terms and Conditions will be posted on Envelo's website. § 15 PERSONAL DATA 15.1. The administrator of the Customers’ personal data provided in connection with the Agreement is PPUC (Poczta Polska Usługi Cyfrowe Sp. z o.o. with its registered office in Warsaw, ul. Stanisława Żaryna 2 C, 02-593 Warsaw). Customer's personal data are processed for the purpose of performance of the Agreement, for PPUC's own marketing purposes, for the purpose of explaining the instance of usage of Envelo in contravention of the Terms and Conditions or the prevailing regulations (forbidden usage), and for the purpose of examining possible complaints. Provision of data is voluntary but they are necessary for the conclusion and performance of the Agreement. The Customer has the right to access the content of his/her/its data and correct them. Rules of personal data processing are regulated in the document entitled Privacy Policy which is posted on http://envelo.pl/Polityka.prywatności/, as well as on Envelo's main website. § 16 MISCELLANEOUS 16.1. Any reference to a business day in these Terms and Conditions is understood as Monday to Friday, except for public holidays. 16.2.
