5. The item to be purchased is a new rotary guillotine for cutting fine propellant strands in the production of
single-base (SB) nitrocel lulose propeJlants.
6. The item to be ordered includęs:
6.1. delivery to the Customer's factory at ul. Zakładowa "t,26-610 Pionki, (Poland) ofa rotary guillotine for

cutting fine propellant strands in the production of sirrgle-base (SB) nitrocellulose propellants, as per the
technical guidelines ref. SB -910-1 which are attached witli tlris Procurement Notice as Appendix 2, along
with the technical documentation referred to in ss, 6,5 ; 6.8;
delivery of spare pafts and quick-wear pads for the rotary guillotine for cutting fine propellant strands for
a 24-morrtlr operation in a two shift system;
installation, staft_up and commissioning ofthe delivered equipment;
training customer's personnel in the operation ofthe equipment on site;
technical and maintenance documentation: 2 copies in PoIish language, a printout and a soft copy;
EC declaration of conforrnity;
Operating manual: 2 copies in Po|isli larrguage, a printout and a soft copy;

7. Appendix 2 to this Procurement Notice, referred to in. ss. 6.1 is

The tender shall be in writing and signed personally by an authorized representative of the tenderer. All
pages of the tender and appendices tlrereto, as well as any alterations made in the document by the
Contractor, shall be signed by its autliorized representative.
If the Contractor is represented by an attorney, the respective power of attorney providirrg the scope of
powers must be attached with the tender.

The tender shall include
a) An extract fiom the rrational register of companies or a copy
listing in the register of businesses
confirming that the tenderer's business is ofthe type matching the tendered item, issued not more than 3
months before the tender submission deadline.
In the case of foreign tenderers whose country autlrorities do not issue the a./m document, the tenderer
should submit a declaration to the effect that the type oftheir business matches the item to be contracted
and that the tenderer is not in liquidation or bankruptcy;
b) A copy ofthe NIP ceńificate (does not apply to foreign tenderers who should submit their EU VAT ID if
of
they have it);
c) A copy ofthe REGON ceńificate (does not apply to foreign tenderers);
d) An insurarrce policy or other insurance document confirming tlre tenderer is insured against civil liability
for its business for an amount not less than the value ofthe tendered item;

12. Tenders should be subrnitted in Polish, in sealed envelopes, stamped, addressed to the Customer with the
following text,. "O/|erta na dostawę krajalnicy obrotowej gilotynowej do kłojenia cienkich włókien
plochowych przy proclukcji prochów nitrocelalozowych jetlnobazowych SB".
l3. The bids shall be submitted to the office of the Management Board of MESKO S.A,Pionki Branch, ul.
Zakładowa 7,26-670 Pionki by 01-06-20l5, l4.00 hrs. (the reception date oftlre tender at the office).
l4. The bids will be opened by the tender board at tlre Customer's headquańers, ul. Zakładowa 7,26-670 Pionki
on 02-06-20l5, 9.00 hrs.
l5. To select tlre winning bid, the Customer will apply the followirrg critelia:
- price
- 40%
- compliance with technical guidelines - 30%
- date ofdelivery
- 30%
16. The customer reserves t|re right to:
freely choose any tender
not to choose any tender without stating the reason
- seek detailed infomatiorr and clarification from tenderers
- have the sole interpretation oftlris Notice
- Ęect any tender whic|r does not meet forma| rcquirements or cal| on tenderers to correct formal
defects in the tender.
Negotiations will be taken up with the tenderer whose tender is chosen in order to enter into a contract on the terms
and conditions specified by the Customer.

We herebY Pledge for an unlimited time to preserve the confidęntiality of information we
received regarding Procurement Notice for the delivery of a rotary guillótine for cutting fine
ProPellant strands in the production of single-base nitrocellulose propellants
(SB) and the
confidentiality of technical, technological, economic, financial, cómmelciai, iegal and
organizational information relating to MEsko s.A. with its registered office in skarżyskoKamienna, irrespective ofthe form in which such information is transmitted and irrespective
of its source unless regulations is place provide otherwise.
Moreover, we acknowledge that thę technical guidelines ref. SB-910-1 for the rotary guillotine
for cutting fine propellant strands, which are found in Appendix 2 to the Procuremeni Ńotice no.
2llY/2015 of 30 April 2015 constitute secrets of MESKO S.A. within the meaning of the unfair
competition act of 16 April 2015 (consolidated text in Dz.U. 2003, it. 1503 as am.). Any
duPlication, copying, disclosure to third person(s) or dissemination in any other form will infringl
secrets of MBsko s.A. resulting in civil sanctions and punitive sanctions as provided by
regulations of law.
In the case of infringement of the above covenants, MESKO S.A. with its registered office in
SkarżYsko-Kamienna shall be entitled to pursue compensation for all the resultant damages and
lost profits.
