MAKING MOVIES IN POLAND
Polish cinema and the country’s entire film industry have recently
been enjoying a period of positive change and spectacular accomplishment. Both 2014 and the beginning of 2015 have brought
a host of important achievements, particularly as regards the resounding victories won by Paweł Pawlikowski’s Ida, which received
five European Film Awards and the Oscar® for the Best Foreign
Language Film. Then there are the successes attained by other
Polish filmmakers, including the Berlinale Silver Bear awarded to
Małgorzata Szumowska for Body and a string of awards and distinctions for Poland’s documentary makers, including the two Oscar®
nominations for Aneta Kopacz’s Joanna and Our Curse, directed
by Tomasz Śliwiński. A vital supplement to filmmaking activities
came in the form of support for international collaboration. In 2014,
the Polish Film Institute, which celebrates its tenth anniversary this
year, decided to subsidise a total of thirty-six feature, documentary
and animation co-productions, providing financing to a combined
total of EUR 8.5 million.
Another feature of 2014 was the extent of the international
film market’s interest in Poland as a source of locations. Polish
producers gave ample proof of their ability to meet the challenges
connected with major foreign productions and the Polish companies servicing the international projects showed themselves to be
first-class organisations providing fully professional services, with
a high level of linguistic proficiency and at competitive prices, all of
which enables them to compete effectively with their counterparts
in other Central and Eastern European countries. Equally as gratifying is the fact that, in most cases, foreign producers also appreciated the talents and skills of Polish actors, filmmakers and crews,
deciding to cooperate extensively with them.

Steven Spielberg’s Bridge of Spies unquestionably numbers
amongst the most important of those projects, as does the dashing,
Japanese historical production Persona Non Grata, directed
by Cellin Gluck and shot on location in Warsaw, Gdańsk, Łódź
and amidst the natural glories of the Lower Silesia region, which
features in the film in the role of ... Manchuria!
Interest in Poland on the part of global media concerns also
increased. In May and June 2014, Warsaw and Lódź provided
locations for shooting The Passing Bells, a war-drama TV series
that continues the collaboration between BBC Worldwide and
Telewizja Polska which began with Spies of Warsaw. In turn, AXN
Central Europe filmed The Crime, its first Polish mini-series,
on the Hel Peninsula.
Polish producers should also be commended for attracting three major Bollywood productions to the country. Sajid
Nadjadwala’s Kick, starring Salman Khan, was filmed in Warsaw
and went on to gain outstanding box office returns in India and
a Taurus World Stunt Awards nomination for its daring stunt
scenes. In the south of Poland, Krakow, Lublin and Książ Castle
played host to the other two films, Bagistan, which involved
around forty days shooting in Poland, and Shandaar; both were
awaiting their premiere when this publication went to press.
In early 2015, well-known French director Anne Fontaine spent
forty days in Orneta, a small town in the north-eastern region
of Warmia, shooting her latest film, Agnus Dei, set in the brutal
realities of the post-war era.
Why are film locations in Poland attractive? The country has
a rich and varied range of landscapes featuring breathtaking
mountains scenery, great expanses of water of every description,
swathes of dense forest, stretches of desert and a coastline which,
in many spots, calls to mind the beaches of many another places
around the world.

Her urban landscapes, guaranteeing exteriors from a wide range
of eras and epochs, are another major attribute, as are her wealth
of fortifications and other military structures and her abundance
of castles and palaces, all of which have enticed Polish and foreign
filmmakers for many years. Situated in places accessible to trucks
and other heavy vehicles, everything can be reached at the drop of
a hat, with no vast distances to be covered between one spot and
another.
In addition to three major film studios, there are several dozen
superbly equipped editing and sound editing studios operating in
Poland. Warsaw, Wrocław, Krakow and Łódź all offer professional
sound stages. Poland’s camera crews are considered to be amongst
the best in the world and Polish cinematographers and camera operators of the ilk of Sławomir Idziak, Paweł Edelman, Jerzy Zieliński
and Artur Reinhart work on blockbusters and numerous prestigious
productions across Europe and in Hollywood. Animation, be it traditional or computer generated, is another field of expertise which
is developing dynamically and with enormous success, along with
special effects, in particular. More than a dozen superbly equipped
studios work to service films and adverts from all over the world,
supported not only by the cutting-edge quality of their equipment,
but first and foremost by the visual talent, proficiency and professional background of Polish animators and special effects experts.

2015 Operational Programmes
The Polish Film Institute (Polski Instytut Sztuki Filmowej, PISF)
provides subsidies and loans. For 2015, the Institute has allocated
a sum of EUR 30 million for operational programmes:

A subsidy granted by the PISF for features, documentaries and
animated films under the Film Production objective may not exceed
50% of the planned costs of the undertaking and the limits set out
in the table below. The exception to this is a difficult film project,

which may receiving a subsidy of up to as much as 70% of the
production costs.
When applying for production funding, the producer is obliged to
contribute a minimum of 5% of the planned costs of the undertaking.
This contribution may be financial or a combination of financial and
contribution in kind. At the same time, a contribution in kind may
constitute no more than 95% of the producer’s entire contribution.
International Co-Productions
The Application Process
• Producers may apply for up to four projects per application
round, including projects from previous application rounds with
a pending decision;
• To be eligible for consideration, applications must contain every
single piece of accompanying information that is requested
(script, director’s explication, synopsis, budget, estimated
production costs, script rights agreement etc.);
• All applications are to be submitted in Polish;
• Important: Applicants must provide proof (letters of intent,
memorandum or co-production agreement) of the remaining
sources of financing (i.e. excluding the grant requested from the
Institute);
• The project review process lasts 90 days;
• The final decision is at the discretion of the General Director of
the Polish Film Institute and takes into account the opinions of
appointed experts;
• The grant decision remains valid for six months. This can be
extended by a maximum of another six months;

• During this period, the producer must finalise an agreement with
the PFI (having completed the budget and signed the remaining
production agreements);
• If the film makes a profit, the grant is to be reimbursed (applicable only in the first six years after the film’s premiere).
Majority Co-Production
• The project in general must follow the requirements set in the
European Convention on Co-production;
• Co-production projects are evaluated based on artistic potential
and must compete against domestic projects (same funding
sources);
• The maximum subsidy for a contemporary full-length feature film
is set at 4 million PLN (approx. 1 million EUR) or no more than 50%
of the budget;
• If the director of the film is of Polish nationality, rules of a majority co-production apply even if Polish financing accounts for less
than 50% of the budget;
• For international co-productions, the application must include
details on the total amount to be spent on Polish territory, as
well as a list of creative and production elements contributed by
the Polish side;
• When applying for a subsidy for film production, the producer’s
own contribution must amount to no less than 5% of the total
expected cost of the project.

Minority Co-Productions
• In bilateral co-productions, the Polish contribution must account
for at least 20% of the total budget;
• In multilateral co-productions, the Polish contribution must
account for at least 10% of the total budget;
• For a Polish co-producer of a European feature film, the maximum subsidy is 2 million PLN (approx. 500,000 EUR), which
cannot exceed 50% of the Polish financing;
• For a Polish co-producer of a non-European feature film, the
maximum subsidy is 1.5 million PLN (approx. 375,000 EUR), which
cannot exceed 50% of the Polish financing;
• For minority international co-productions, the summary page of
the global production budget must be included with the application, with totals converted into Polish zlotys (PLN) and including
the exchange rates, as well as a detailed budget of the Polish
side, indicating expenditures on Polish territory;
• For minority co-productions, when applying for a subsidy for film
production, the Polish producer’s own contribution must amount
to no less than 5% of the total expected cost of the project;
• The artistic contribution must be adequate to the requested
subsidy and meet the minimum requirements listed below:
Features: at least one Polish Head of Department (DoP, Set
Designer, Editor, Composer);
Animation: producing part of the animation in Poland, and at least
one Polish artist (Director of Animation, Storyboard Writer, Author
of Artistic Project, Composer);
Documentaries: at least one of the following: Use of Polish Archives,
Polish character or subject, Polish artist (DoP, Composer, Editor)
• At least 80% of the subsidy must be spent in Poland.

CO-DEVELOPMENT FUND
Polish and German producers may apply to the Polish-German
Co-Development Fund for financing for the development of film
projects.
The Fund, which was established by the Polish Film Institute
(PISF), Mitteldeutsche Medienförderung (MDM) and Medienboard
Berlin-Brandenburg, supports feature and animated films and
creative documentaries. Projects for which funding applications
are submitted must possess artistic quality and demonstrate the
potential for drawing European audiences and, at the very least,
audiences in Poland and Germany. Applications may only be
submitted on condition that a co-development agreement has been
signed by at least one Polish producer and at least one German
producer from the region in which MDM and Medienboard operate.
Financing is awarded to a maximum total of EUR 60 000 and
decisions regarding its allocation are taken jointly by the directors
of the PISF, MDM and Medienboard. The application forms are available on the websites of the Fund’s founders.
The Fund’s annual budget is approximately EUR 150 000.
Plans are currently afoot to increase the financial allocation and
transform the initiative into the Polish-German Film Fund, which will
also be oriented toward supporting the production of smaller scale
Polish-German projects. The primary target group will be debuting
filmmakers for whom financial support and international experience
could prove extremely helpful in their future cinematic careers.

REGIONAL FILM FUNDS
There is a well-developed network of regional film funds in Poland
and their operations encompass most of the Polish regions. There
are currently nine operating funds, but the authorities in the regions
not yet covered have declared that more will be launched. In the case
of Lower Silesia, Łódź, Małopolska, Mazovia, Silesia, and Poznań, the
regional film commissions work alongside the film funds.
In general, the Polish regional film funds seek film projects
by announcing competitions. One basic condition for entering
a project for a competition is that it is related to a city or town in the
region, or to the region itself, either in its theme and/or its setting,
or through the participation of local people and companies in its
production. Support is also contingent on the expending of at least
100% of the funding within the region; in some cases, the sum
to be expended is 150%. The competition organisers are interested
in consolidating and enhancing the positive image of the city, town
or region, which is why projects intending to use distinctive locations, sites and buildings receive the most favourable assessments.
The Polish regional film funds differ in terms of the budgets
they manage, the form of support they provide and the sums
which must be expended in their cities, towns and region during
the production of a film. Support most often takes the form of

the institution managing the fund participating in the production
as a co-producer with its own financial or in-kind contribution.
Other forms of support are non-repayable grants or refunds,
in other words, a partial reimbursement of the costs incurred,
which is paid after the production has been completed. All the
Polish film funds provide support of up to 50% of the film’s
budget, although in the case of documentaries and animated
films, the funding may be higher.
The regional film funds usually announce the competitions once
a year, with the assessment of the projects and allocation of funding
taking anything from sixty to one hundred and twenty days. Foreign
producers are also welcome to submit projects, though preferably
as partners to Polish producers. All the requisite documentation
must be completed in Polish.
In addition, the Kujawsko-Pomorskie Voivodship runs a project
entitled ‘Creative Region’, which makes it possible to obtain financing in exchange for the placement of noteworthy local products,
services and places in films, serials and television programmes. The
initiative includes foreign productions. Any producer interested
in the scheme should apply to the project administrator, Fundacja
Tumult (the Tumult Foundation). The selection criteria are open and
the process is continuous until such time as the funds allocated to
the scheme are expended.
The Krakow International Film Fund (Międzynarodowy Fundusz
Filmowy w Krakowie) was launched in 2014. A competition is held for
the purpose of co-financing international co-productions intended
primarily for cinema distribution and with the aim of developing
cooperation between the European audiovisual sector and that of
other countries. Film projects submitted to the competition must be
connected to Krakow in terms of their theme or topic, the authors
and, most importantly, the place of production. They must also involve
the participation of at least two producers from other countries.

EURIMAGES FUND
Creative Europe is a new European Union programme for 2014 to
2020, offering financial support for the audiovisual, cultural and
creative sectors. The programme includes the MEDIA sub-programme, which is addressed to film and computer-game producers,
distributors, sales agents and organisers of sectoral events and
enterprises such as training, festivals, industry fairs and other
ventures of that kind.
Creative Europe has a budget of EUR 1.46 billion.
EURIMAGES is a fund supporting European cinema. It is adminstered
by the Council of Europe and it primarily subsidises co-production
activities, earmarking almost 90% of its funds for that purpose. The
Fund’s annual budget is EUR 25 million.
Eurimages provides financial support for the production of
full-length features and animations and for documentaries with
a running time of more than seventy minutes. The main condition
attached to applying for funding is that at least two producers,
from at least two of the countries belonging to the Fund, are
participating in the project. Co-producers from countries which are
not members of Eurimages may participate in a project, provided
that their combined share in the co-production does not exceed
30% of the film’s budget.

Following the adoption of the new film law in Poland in 2005 and
the establishment of the Polish Film Institute, the country’s film
production began to grow rapidly. Several dozen feature films are
made each year, often in co-production with other countries, and
go on to win awards and acclaim at national and international film
festivals, as well as enjoying enormous popularity amongst Polish
cinemas and their audiences alike.
Both 2014 and the beginning of 2015 form part of one of Polish
cinema’s most successful periods. First and foremost comes
Paweł Pawlikowski’s Ida and its triumphant circuit of international
festivals, awards ceremonies and the cinema screens of France,
Spain, Denmark, Australia, Canada and the USA, to name but a few.
After receiving five European Film Awards, a BAFTA, a Goya award
in Spain and an Independent Spirit Award, Ida went on to win the
Oscar® for the Best Foreign Language Film. Two Polish documentaries were also a presence amongst the nominees at the American
Film Academy awards this year; Aneta Kopacz’s Joanna and Our
Curse, directed by Tomasz Śliwiński. Poland’s cinema also achieved
other successes on the international festival scene; Małgorzata
Szumowska won the Silver Bear for Best Director with Body at the
2015 Berlinale and Paulina Skibińska’s Object received a Short Film
Special Jury Award at the Sundance. International audiences also
had the opportunity of watching Agnieszka Woszczyńska’s graduation film, Fragments and a number of animations; Tomasz Siwiński’s
A Blue Room, Ewa Borysewicz’s To Thy Heart, Tomasz Ducki’s Baths
and Wojciech Sobczyk’s Summer 2014. There was no shortage of
Polish documentaries on international screens either, with Domino
Effect, directed by Elwira Niewiera and Piotr Rosołowski, Monika
Pawluczuk’s When I’m a Bird, Janusz Matuszyński’s Deep Love and

Zuzanna Solakiewicz’s 15 Corners of the World being just a few of
the many titles making their way around the globe.
Ticket sales on the domestic market exceeded forty million for
the first time in 2014, with Polish productions claiming a significant
share; audiences for Łukasz Palkowski’s Gods, which swept the
board at the 2014 Polish Film Festival in Gdynia, reached 2 154 737,
Jan Komasa’s historical blockbuster, Warsaw ’44, was seen by
1 742 935 people and Władysław Pasikowski’s political thriller, Jack
Strong, sold 1 175 625 tickets.
FILM PRODUCTION
Between thirty-five and forty features are made in Poland annually,
along with several dozen documentaries and animations. A number
of the films are bilateral or multilateral international co-productions.
The budgets for Polish features in 2014 ranged between EUR
500 000 and 6.2 million, with those for documentaries and animations at EUR 35 000 to 660 000 and EUR 50 000 to 1.3 million,
respectively. The budgets for international co-productions and
animations were by far and away the highest.
Poland has three major film studios; the Documentary
and Feature Film Production Company (Wytwórnia Filmów
Dokumentalnych i Fabularnych; WFDiF) in Warsaw, the ATM Group
(Grupa ATM) in Wrocław and Alvernia Studios in Kraków. WFDiF is
state-owned and is the largest film producer in Poland. ATM is the
country’s largest television producer and Alvernia is a state-of-theart enterprise which has been compared to Pinewood Studios and
Babelsberg Studios. Polish film studios are not only experienced
co-production partners, but also offer a full range of film services.

THE TELEVISION MARKET
2013 marked the end of analogue broadcasting in Poland and the
launch of digital terrestrial television. Three multiplexes broadcast
twenty-four nationwide channels free of charge. The digitisation
process has given audiences access to new content and audience
measurement surveys indicate that their preferences have altered.
Poland’s broadcasting market leaders are Polsat, TVN and
Telewizja Polska’s TVP1 and TVP2 channels. However, Nielsen
Audience Measurement data reveals that the popularity of all three
stations has declined significantly since 2013. The current market
share of the most watched channels is Polsat, at 13.51%, TVN, at
13.96%, TVP1, at 9.51% and TVP2, at 8.91%. The total share of the top
four channels decreased from 55.87% in 2012 to 45.89% in 2014.
The top four are followed in the ratings by channels broadcast
via digital terrestrial television, namely TV Puls, TVN7 and TV4 and
genre channel TVN24, with a share ranging from 2.35 to 3.36%. This

suggests that Polish audiences are increasingly turning their attention to news, current affairs, film and entertainment channels.
The television market in Poland is also changing as a result of the
development of the Internet and of mobile technologies, which is
having a direct impact on the current models of media consumption. As every survey demonstrates, audiences have a growing
preference for watching content of their own choosing, where and
when they like. The leading Polish broadcasters, and others, have
launched VoD (Video on Demand) platforms, providing access to
their content to web users and users of Internet-enabled televisions
and mobile devices.
According to a Megapanel PBI/Gemius study developed by
Wirtualnemedia.pl and covering December 2014, the most popular
VoD service is Vod, with more than four million users and almost
thirty-three million views per month. Vod is followed in the ratings
by Player, with 1.38 million real users and 28.5 million views, Ipla,
with 1.19 million real users and 25.3 million views and VOD TVP, with
770 thousand real users and 10.3 million views.

Thanks to a comprehensive database,
up-to-date records from the film sector
and close cooperation with the network of
regional film commissions, FCP is the first

Regional Film Commissions
At present, there are six regional film
commissions operating in Poland. They are
based in the regions of Silesia (Śląsk), Lower
Silesia (Dolny Śląsk), Mazovia, Małopolska,
Łódz and Poznań. Further commissions are
currently at the organisational stage. All
the film commissions are managed independently, but collaborate closely with Film
Commission Poland.
As a rule, the commissions work in
conjunction with the Regional Film
Funds, thanks to which their activities
are integrated in nature. They frequently
operate alongside institutions with a wealth
of experience in cultural activities, an
outstanding knowledge of their region’s
unique characteristics and extensive local
contacts at their fingertips. Some have their
own production support systems in the
form of reductions in the fees for the use of
locations or discounts on hotels and local
public transport services. Every commission
provides the following services:
• location scouting;
• administering and updating a database
of locations;
• assistance in obtaining permits to film,
make use of roads, change the flow of
traffic and so forth;
• reducing the length of time required to
obtain permits by applying effectively
developed procedures;
• assistance in talks with the owners of
buildings, facilities and land;
• assistance in establishing contact with
municipal services and offices;
• assistance in arranging accommodation,
often with discounts;
• providing information and contacts
relating to local professionals, specialists
and audiovisual production companies in
their region;
• providing information on the
infrastructure and film resources
available in their region.

The Documentary and Feature Film Production
Company is Poland’s largest state-owned film
studio. It provides full production services and
produces feature and documentary films funded
from its own financial resources. The studio also
engages in film education projects.

• film production department which is engaged
in searching for interesting documentary and
feature film scripts, the development and

contact with co-producers in Poland and

chronicles and documentaries, including the
greatest works from the Polish Documentary
School;
• educational projects: the Screenplays Studio
and On Set initiatives and Teatroteka, a cycle of screen adaptations of contemporary Polish

There is one public television broadcasting
corporation in Poland, Telewizja Polska
S.A. There are also several dozen private
broadcasting companies. In total, there are
almost two hundred television channels,
the majority of which are genre channels,

The Polish Filmmakers Association is
Poland’s largest organisation of film and
television professionals. Its primary task is
to integrate the film community and protect
its interests. The Union of Audiovisual
Authors and Producers (Związek Autorów
i Producentów Audiowizualnych; ZAPA),
a collective copyright management organisation, operates within the structures of
the Association, as does the Andrzej Munk
Youth and Film Studio (Studio „Młodzi
i Film” im. Andrzeja Munka), which produces
debut films. The SFP has a number of sections and circles, which unite representatives of all the filmmaking professions. It is
also the organiser or co-organiser of the
most important film festivals held in Poland.

The Polish Audiovisual Producers’ Chamber
of Commerce unites producers and
protects their interests. As an autonomous
organisation, it has a genuine impact on the
shaping of legal, financial and economic
legislation relating to the film sector
through consultation with the government
and parliament. It collaborates with Polish
and European producers’ organisations,
as well as with filmmakers and television
producers.
The Chamber established the Polish
Audiovisual Centre Foundation (Fundacja
Polskie Centrum Audiowizualne), together with which, it runs the Regional
Audiovisual Initiative (Regionalna Inicjatywa
Audiowizualna; RIA). The aim of the initiative is to increase the number of funding
sources for Polish filmmaking by launching
a national network of regional film funds
and commissions.

FILM PRODUCTION
A foreign producer planning to produce
a film independently in Poland must
complete the necessary formalities and
fulfil the obligations set out in respect of
entrepreneurs under Polish law. No matter
what form of business activity they elect to
run, it must be registered in Poland and the
accounts must be kept in Polish. However,
given the opportunities and facilities which
await foreign producers in Poland, the
simplest form of activity in the filmmaking
field is co-production with a Polish partner.
In 2002, Poland ratified the European
Convention on Cinematographic Coproduction, which is binding upon forty
European countries. It guarantees not only
a status equal to that of national films for coproductions undertaken by producers from
the signatory countries, but also the rules
of fair cooperation. In addition, it facilitates
matters such as the crossing of borders.
Countries bound by the Convention are
obliged to facilitate the entry, residence
and granting of work permits on their
territory for the technical and artistic
personnel of other parties participating in
a co-production. Each party is also obliged
to permit the temporary import and reexport of the equipment necessary to the

production and distribution of cinematic
works produced within the framework of
the Convention.
The Convention applies to:
• co-productions involving at least
three co-producers based in three
different Member States bound by the
Convention;
• co-productions involving at least
three co-producers based in three
different Member States bound by the
Convention, as well as one or more
co-producers who are not based in
those Member States; however, the total
contribution of the co-producers who
are not based in the Member States may
not exceed 30% of the total production
cost;
• bilateral co-productions, in the absence
of any agreement governing bilateral
co-production relations between two
parties to the Convention.
The Convention establishes the
principle that, in the case of a multilateral
co-production, the minimum contribution
may not be less than 10% and the maximum
may not exceed 70% of the total cost of the
production of the film. However, when the
Convention takes the place of a bilateral
agreement, the co-producer’s contribution
may be no less than 20% and no more than
80% of the total production cost.
The Convention regulates the matter of
the co-producers’ technical and artistic participation, stipulating that the contribution
of the co-producers’ creative, technical and
artistic personnel, as well as that of a given
co-producer‘s technical equipment, must
be proportional to the investment made by
the co-producer in question. Co-producers
must also be guaranteed both joint ownership of the original picture and the sound
negative and the right to an internegative
or to any other medium of duplication.
The European Convention on
Cinematographic Co-production applies
to European cinematographic works which
have acquired co-production status. The
term ‘European cinematographic work’ is
understood as a work involving an appropriate number of creative and technical
personnel, as defined, respectively, by the
Convention, in the creative group and technical craft group, from the co-producing
states. In order to acquire co-production
status, the relevant applications should be
submitted to the authorities designated by
the Member State/Party to the Convention
two months before shooting begins.
The signatories to the Conventions
are Albania, Armenia, Austria, Azerbaijan,
Belgium, Bosnia and Herzegovina, Bulgaria,
Croatia, Cyprus, Denmark, Finland, France,
Germany, Greece, Hungary, Iceland,

Ireland, Italy, Latvia, Lithuania, Luxembourg,
Malta, Moldova, Montenegro, Netherlands,
Norway, Portugal, Romania, Russia,
Serbia, Slovakia, Slovenia, Spain, Sweden,
Switzerland, the Former Yugoslav Republic
of Macedonia, Turkey, Ukraine and the
United Kingdom.
Poland has also entered into bilateral
co-production agreements with France,
Canada, Israel and India, pursuant to which,
the co-producers’ financial contribution
must total from 20% to 80%, while the
creative and technical contributions should
be proportional to the parties’ share of the
film’s budget. The agreements also allow for
co-productions with third-party countries
which have entered into individual agreements with France, Canada or India.
EMPLOYMENT LAW
As a Member State of the European Union,
Poland guarantees EU citizens the free
movement of people, goods, services
and capital. This includes equal access to
the labour market and the recognition of
educational and professional qualifications.
Although the regulations pertaining to the

employment and economic activity of foreigners on the Polish market impose some
restrictions on third country nationals, the
Polish legislature is systematically introducing new improvements in this respect.
Polish law identifies various groups
of people who are authorized to work in
Poland without the necessity of obtaining
a work permit. They include the citizens of
the European Union and the states with
which the EU has entered into agreements
on the free movement of people. People
who hold a Polish residence or settlement
permit may also work in Poland without
a work permit. In addition, Polish law lists
categories of people who, by virtue of the
particular nature of their activities, are
exempt from applying for a work permit.
This group includes foreigners who, either
individually or in teams, perform services
over no more than thirty days per calendar
year. These services include performances
given by actors, directors, reciters, conductors, instrumentalists, singers, circus
performers, dancers and mime artists.
Employment in Poland is based on a written contract of employment which may
be open-ended or fixed term or cover the
period of time required to complete a specified job. Two types of civil contract relating
to the commissioning of work and services
may also be entered into, a contract
for specific work (umowa zlecenia) and
a contract of mandate (umowa o dzieło).
Agency agreements may also be concluded.
Both a natural person and an entrepreneur
of any kind may be party to a fixed-term
civil contract. The Labour Code (Kodeks
Pracy) sets out the provisions which should
be included in a contract of employment in
detail and the Civil Code (Kodeks Cywilny)
stipulates those for civil law contracts.
Contracts for specific work and contracts of mandate are most frequently used
in the film production process. In the case
of a contract of mandate, the contractor
undertakes to perform the designated work
and the commissioning party undertakes
to remunerate them for it. This is thus an
agreement based on an end result, where
the contractor is obliged to provide the
film producer with the outcome set out in
the contract. In the case of a contract for
specified work, the contractor’s commitment is to carry out the work in question
with due diligence; this kind of agreement
is therefore also known as an agreement
of due diligence. Other types of contract
used in the film production process relate
to copyright and are discussed in the
Copyright section.

ECONOMIC LAW
The citizens of the EU Member States,
as well as those of Norway, Iceland,
Lichtenstein and Switzerland may undertake and carry out economic activities
under the same conditions as Polish
entrepreneurs. This also applies to people
who hold a Polish residence or settlement
permit. Other foreigners may only engage
in business activity in the form of a limited
partnership, a limited joint-stock partnership, a joint stock company or a limited
liability company (spółka z ograniczoną
odpowiedzialnością; Sp. z o.o.). They can
also join such companies and acquire and
purchase stocks and shares in them.
The most common form for conducting
a business activity in the Polish film industry
is a limited liability company.
This can be formed by one or more
partners, although not by another singleperson limited liability company alone.
The shareholders are not liable for the
company’s obligations; however, they are
obliged to contribute share capital to the
sum of at least PLN 5 000, which equates
to around EUR 1 160. The company is liable
for its obligations by way of its own assets.
It is also obliged to pay corporate tax

(CIT). Anyone wishing to establish a limited
liability company must:
• draw up the Articles of Association;
• pay in the share capital;
• appoint the company’s governing bodies;
• register the company in the National
Court Register’s register of entrepreneurs (Krajowy Rejestr Sądowy [KRS];
rejestru przedsiębiorców).
In the course of these procedures, the
company’s areas of activity are defined
on the basis of the Polish Classification
of Activities (PKD), which is fundamentally
similar to the international classification
(NACE). The division of shares among the
shareholders is also determined. At the
same time, the company is registered with
the Social Insurance Institution (ZUS, Zakład
Ubespieczeń Społecznych) as a payee and
it is assigned a National Official Register of
Business Entities identification number
(REGON; Rejestr Gospodarki Narodowej)
and a NIP tax identification number (Numer
Identyfikacji Podatkowej). The entrepreneur is also obliged both to pay taxes and
due payments such as VAT, income tax,
tax withheld on remunerations and social
insurance contributions and to submit tax
declarations and financial reports.
VAT
In accordance with Polish law, VAT is included, inter alia, in paid services rendered
in Poland. This means that the majority of
film production services, such as shootingrelated services or those involving logistics
in the form of transport, accommodation,
catering and so forth, are subject to VAT.
The present rate is 23%.
The transfer of copyright to a film in
return for a co-producer’s financial contribution is also deemed a service and is
therefore subject to VAT. The factors which
will have tax effects are decided by the
provisions of the co-production agreement,
which should set out the parties’ mutual
obligations in detail.
Entities running a business activity in
Poland may reclaim VAT. Pursuant to the VAT
Act, the statutory period for its return is
sixty days; however, it is possible to apply
for a reduction to twenty-five days.

COPYRIGHT
The term copyright refers in general to the
rights of an author of a work whereby the
author is entitled both to determine its use
and to benefit from it. Polish law distinguishes two types of copyright:
• moral rights (personal rights; osobiste);
• property rights (majątkowe).
Moral rights protect the relationship
between the author and the work. They
are permanently assigned to the author, do
not expire over time and are inalienable;
in other words, they cannot be transferred
to other persons. However, the author may
agree not to exercise these rights.
Property rights protect the material
well-being of the author, who can benefit
from the work and may manage its use in
exchange for remuneration. The author may
transfer either all of their property rights,
or a specified range, to other persons.
The producer acquires the rights to a film
by concluding agreements on the transfer
of property rights with the co-creators of
the film, including, but not limited to, the
director, cinematographer, screenwriter,
production designer, costume designer,
special effects director and composer. The
most common practice is to conclude one
contract of mandate with the co-creator,

covering the execution of the work and the
transfer of copyrights and, in the case of an
already completed or ready-to-use work,
such as a script, covering the transfer of
copyrights alone.
It is worth noting that the transfer of all
property rights does not deprive the author
of the exclusive right to decide on the implementation of what is known as dependent
copyright. The scope of the rights granted
depends on the substance of the agreements entered into. Agreements should always be concluded in writing and should set
out the terms agreed between the parties in
detail. For example, if the producer plans to
use stills and visual sequences from a film in
order to create promotional materials such
as posters and trailers, then the agreement
with the cinematographer should contain
either a clause stipulating the terms of the
use for stills and visual sequences beyond
the film itself, or an undertaking on the part
of the cinematographer to the effect that
they will not exercise personal copyright in
such a way to conflict with the producer’s legitimate interests. The exception is the right
to translate the film into other languages ​​
without the consent of co-creators; this
right is assigned to the producer. It should
also be remembered that, unless otherwise
provided for, the rights acquired under the
agreement may be resold.
