Zgodnie z art. 22 ust. 1 ww. ustawy ,,0 spelnieniuwarunkaw, o kt6rych mowa w art. 21, orzeka Szef UrZ{!du do Spraw Kombatant6w i Os6b Represjonowanych lub osoby przez niego upowazmone, na podstawie udokumentowanego wniosku zainteresowanejosobyorazrekomendacjistowarzyszenia wlasciwego dla okreslonego rodzaju dzialalnosci kombatanckiej lub represji. Wspolna 2/4 Phone 661 81 11 fax 661 90 73 DECISION By the Director of the Veteran and Persecution Victims Bureau from 29 February 2016 Nr [redacted] Pursuant to Article 1, 2, 3, 4 and Article 22 paragraph 1 of 24 January 1991 on combatants and certain persons being victims of wartime and post-war oppression (uniform text, Journal of laws of 2014, item 1206) having considered the application by: Mr. [redacted] Address: [redacted] I hereby refuse to grant Veteran status. GROUNDS The parties requested an allocation of rights for veterans basing its application on the circumstances in hiding during World War II World. The administrative body does not deny the severity of the events that affected the party … However, one must say that in accordance with article 6 kpa, organs of public administration act on the basis of the provisions of the law, and therefore all decisions made by it must be supported in the content of the provisions that are absolutely binding (in the current case, provisions of the law of January 24, 1991, relating to veterans or other persons suffering from wartime and postwar repression). This legal act specifically enumerates the areas that may be recognized as wartime activity or activity equivalent to it, which form the basis for granting veteran’s eligibility. From the statements of the applicant it emerges that … hid from the occupier. It must be noted that the circumstance of a Jewish person hiding from extermination was not intended by the legislature as one of the reasons for giving veteran’s eligibility in articles 1-4 of the veteran’s act. It is therefore not possible to subsume the above circumstance in the legal provisions, and the administrative organ is therefore not empowered to give eligibility because it would go beyond the law obtaining in the Polish Commonwealth. According to the Article 22 of the above mentioned Law "Head of the Office for War Veterans and Victims of Oppression or person authorized by him decides, based on the documented request of the person concerned and the recommendation of the association appropriate to a particular type of veteran activities or repression, about the fulfillment of the conditions referred to in Article 21. Recommendation shall be granted regardless of whether the person applying for rights is going to join the association. On the basis of the decision to grant the authorization laid down in the Act, Head of the Office for War Veterans and Victims of Oppression issues appropriate certificate”. Therefore, the Head of the Office found that there are grounds for refusing to grant the rights of veterans. Instruction: A Party who is not satisfied with the Decision may apply to the Director of the Veteran and Persecution Victims Agency may petition for its reconsideration within 14 days of its receipt.
