Kancelaria Prawna stowarzyszona z KPMG w Polsce Legal Alert Nowa ustawa o elektrośmieciach – najważniejsze zmiany New e-waste act – most vital amendments Neues Elektroschrottgesetz – wichtigste Änderungen Kwiecień 2016 / April 2016 / April 2016 KPMG.pl LEGAL ALERT | 2 Nowa ustawa o elektrośmieciach – najważniejsze zmiany 1 stycznia 2016 r. weszła w życie nowa ustawa z dnia 11 września 2015 r. o zużytym sprzęcie elektrycznym i elektronicznym (Dz.U. 2015, poz. 1588) („UZSEE” lub „nowa ustawa”). Zastępuje ona ustawę z dnia 29 lipca 2005 r. o zużytym sprzęcie elektrycznym i elektronicznym (Dz.U. 2005, nr 180, poz. 1496 ze zm) („ustawa z 2005”). UZSEE wdraża do polskiego systemu postanowienia dyrektywy Parlamentu Europejskiego i Rady 2012/19/UE z dnia 4 lipca 2012 r. w sprawie zużytego sprzętu elektrycznego i elektronicznego („WEEE”). Ustawa nadal reguluje kwestie związane ze sprzętem elektrycznym i elektronicznym („sprzęt”). Ulega zmianie w samej definicji brak dotychczasowej przesłanki przynależności do jednej z 10 grup. W niniejszym alercie prezentujemy wybrane zmiany. 1. Nowe podmioty – nowe definicje UZSEE stosuje tak jak dotychczas do wprowadzających sprzęt, podmiotów zbierających czy prowadzących zakłady przetwarzania zużytego sprzętu; organizacji odzysku sprzętu elektrycznego i elektronicznego, użytkowników. Od tego roku do grupy podmiotów związanych ze sprzętem dołączyły nowe podmioty, a dodatkowo niektórym z nich przypisano nową definicję. WPROWADZAJĄCY SPRZĘT Nowa ustawa zawiera nową definicję pojęcia wprowadzającego sprzęt, odbiegającą o dotychczasowej wynikającej z ustawy z 2005 r. Najistotniejszą zmianą jest objęcie obowiązkiem zorganizowania i sfinansowania odbierania od zbierającego zużytego sprzętu zarówno sprzętu pochodzącego z gospodarstw domowych jak i od użytkowników innych niż gospodarstwa domowe. Co oznacza, że od 1 stycznia 2016 r. powyższe obowiązki dotyczyć będę generalnie całego zużytego sprzętu. PRODUCENT Oprócz wprowadzającego sprzęt USZEE reguluje także obowiązki nowego podmiotu jakim jest producent. Jak wynika ze zmiany definicji, pojęcie „producent” wcale nie jest przypisane do każdego, kto produkuje sprzęt objęty nową ustawą. USZEE nakłada na część producentów obowiązek wyznaczenia autoryzowanego przedstawiciela odpowiedzialnego za wykonywanie na terytorium RP obowiązków określonych ustawą. Dla pozostałej części wyznaczenie autoryzowanego przedstawiciela jest fakultatywne. AUTORYZOWANY PRZEDSTAWICIEL USZEE nie definiuje pojęcia autoryzowanego przedstawiciela. Reguluje jedynie przypadki, kiedy producent może (pkt a - c definicji producenta) albo musi go wyznaczyć (pkt d definicji producenta) na terytorium kraju. Autoryzowany przedstawiciel działa w imieniu i na rzecz producenta, ponosząc odpowiedzialność za wykonywanie obowiązków określonych nową ustawą dla wprowadzającego sprzęt. Nie wszystkie obowiązki można przenieść na autoryzowanego przedstawiciela. Sam autoryzowany przedstawiciel musi być wpisany do rejestru, który w 2016 r. prowadzić będzie jeszcze GIOŚ. DYSTRYBUTOR USZEE wprowadza nowe pojęcie dystrybutora. Pojęcie to zastąpiło funkcjonujące na gruncie ustawy z 2005 r. pojęcia sprzedawców detalicznych i hurtowych. Zgodnie z samą definicją tego pojęcia dystrybutor może być jednocześnie wprowadzającym sprzęt. Nowa ustawa nakłada na tę grupę szereg obowiązków. Najistotniejsza jednak zmiana wiąże się z wprowadzeniem wyraźnej regulacji wprowadzającej obowiązek LEGAL ALERT | 3 nieodpłatnego przyjmowania przez dystrybutorów zużytego sprzętu w określonych Ustawą warunkach. INNE PODMIOTY USZEE zmienia także definicję prowadzącego zakład przetwarzania. Zmienia się także definicja zbierającego zużyty sprzęt elektryczny i elektroniczny. W zakresie związanym z obowiązkiem uzyskania decyzji w zakresie zbierania czy przetwarzania odpadów należy sięgnąć m.in. do przepisów ustawy o odpadach. 2. Odpowiedzialność wprowadzającego sprzęt USZEE wprowadziło wyraźną regulację, zgodnie z którą wykonywanie obowiązków wynikających z ustawy za pośrednictwem organizacji odzysku sprzętu elektrycznego i elektronicznego, nie zwalnia wprowadzającego sprzęt z odpowiedzialności za realizację tych obowiązków (art. 11 ust. 2). 3. Nowe wytyczne dotyczące poziomów zbierania i odzysku W zakresie poziomów zbierania zużytego sprzętu najważniejsza zmiana wiąże się z tym, iż od 1 stycznia tego roku wszyscy wprowadzający sprzęt (nie tylko sprzęt przeznaczony dla gospodarstw domowych jak dotychczas) są obowiązani do osiągania minimalnych rocznych poziomów zbierania zużytego sprzętu. Generalnie poziomy te wzrosły w stosunku do wcześniejszych przepisów. Co istotne będą one sukcesywnie zwiększane. Nowe poziomy uregulowane są w sposób przejściowy. Od 1 stycznia 2018 r. poziom zbierania wynika już z art. 20 USZEE, zwiększając poziomy na przestrzeni kolejnych trzech lat. Podwyższono także minimalne poziomy odzysku oraz przygotowania do ponownego użycia i recyklingu zużytego sprzętu (art. 115 i art 21 USZEE). Zmiany w zakresie minimalnych poziomów zbierania mogą przełożyć się na wzrost ewentualnej opłaty produktowej w razie nieosiągnięcia obowiązkowych poziomów zbierania. 4. Nazwa i logo KPMG są zastrzeżonymi znakami towarowymi bądź znakami towarowymi KPMG International. sprzedaż sprzętu przeznaczonego dla gospodarstw domowych na powierzchni poświęconej sprzedaży wynoszącej co najmniej 400 m2 nieodpłatnego przyjęcia w tej jednostce lub w jej bezpośredniej bliskości zużytego sprzętu pochodzącego z gospodarstw domowych, którego żaden z zewnętrznych wymiarów nie przekracza 25 cm (tzw. małego AGD) nawet wówczas gdy klient nie dokonał zakupu nowego sprzętu przeznaczonego dla gospodarstw domowych w tym sklepie. 5. Rejestr - potem BDO Generalnie prawie wszystkie podmioty podlegające pod nową ustawę o zużytym sprzęcie elektrycznym i elektronicznym muszą uzyskać wpis do rejestru prowadzonego nadal przez Głównego Inspektora Ochrony Środowiska zgodnie z przepisami ustawy z dnia 14 grudnia 2012 r. o odpadach (Dz.U. 2013, poz. 21 ze zm.). Od 24 stycznia 2018 r. rejestr ma być zastąpiony, kiedy to zostanie utworzona baza danych o odpadach tzw. BDO. Baza ta miała ruszyć już w tym roku, ale ostatecznie jej powstanie przesunięto o dwa lata. Mimo, iż nowe zasady wpisu do rejestru będą obowiązywać za dwa lata, już teraz nałożono nowe obowiązki w zakresie wpisu do rejestru prowadzonego przez GIOŚ. 6. Zmiany od 2018 – otwarty katalog sprzętu W zakresie katalogu sprzętu zmiany w 2016 roku są stosunkowo niewielkie, ale wymagają uwagi w zakresie załącznika nr 6 do Ustawy. Zgodnie z przepisem przejściowym w art. 112 USZEE, do końca 2017 r. nową ustawę stosuje się tylko do sprzętu należącego do jednej z grup określonych w Załączniku nr 6, ale i tak tylko w niektórych przypadkach. Załącznik nr 6 opisuje rodzaje sprzętu na zasadzie otwartej poprzez sformułowanie: „oraz inne produkty lub sprzęt (…)” co oznacza, de facto, iż już teraz niektóre grupy sprzętu nie są zupełnie zamknięte. Od 1 stycznia 2018 r. wykaz sprzętu elektrycznego i elektronicznego objęty zakresem stosowania ustawy zostanie zupełnie „otwarty”, czego konsekwencją będzie uznanie za sprzęt każdego urządzenia spełniającego definicję sprzętu w rozumieniu nowej ustawy i niewyłączonego z zakresu jej stosowania. Ponadto, od 1 stycznia 2018 r. LEGAL ALERT | 4 zakres grup sprzętowych podlegających przepisom nowej ustawy zmaleje z 10 do 6 grup (Załącznik nr 1 do USZEE). 7. Audyt i niezapowiedziane kontrole Nowością jest obowiązek przeprowadzenia przez organizacje odzysku oraz zakłady przetwarzania obowiązkowych rocznych audytów zewnętrznych. Druga kwestia to możliwość przeprowadzenia niezapowiedzianych kontroli działalności w zakresie zbierania i przetwarzania zużytego sprzętu oraz recyklingu i innych niż recykling procesów odzysku odpadów powstałych ze zużytego sprzętu. 8. Większa ilość kar Nowa ustawa zwiększyła liczbę przypadków przewidujących administracyjne kary pieniężne. Wysokość kar wg nowej ustawy wynosi od 5000 PLN do 1.000.000 PLN (USZEE ustala szczegółowe pułapy dla określonych kategorii naruszeń). 9. Przepisy przejściowe Stosując nową ustawę należy szczególnie pamiętać o okresach i przepisach przejściowych na najbliższe kilka lat. LEGAL ALERT | 5 New e-waste act – most vital amendments On 1 January 2016 entered into force a new Act of 11 September 2015 on Waste Electrical and Electronic Equipment (Dz.U. 2015, item 1588) (the “WEEE Act” or the “New Act”). It superseded the Act of 29 July 2005 on Waste Electrical and Electronic Equipment (Dz.U. 2005, no. 180, item 1496, as amended) (the “2005 Act”). The WEEE Act transposes into Polish system provisions of the Directive 2012/19/EU of the European Parliament and of the Council of 4 July 2012 on waste electrical and electronic equipment (the “WEEE Directive”). The act continues to regulate issues connected with electrical and electronic equipment (“equipment”). Subject to change was the definition of equipment, wherefrom the previously applicable requirement to be classified in one of 10 categories was removed. In this alert we discuss selected amendments. 1. New entities – new definitions The WEE Act is applicable, as it has been so far, to entities placing the equipment on the market, operators involved in the equipment collection or treatment; organizations for electrical and electronic equipment recovery, users. From this year, the group of entities dealing with the equipment has been extended to include new entities, and definitions of some of them has additionally changed. ENTITY PLACING EQUIPMENT ON THE MARKET The New Act includes a new definition of the entity placing equipment on the market, different from the one included in the 2005 Act. Worth mentioning is a differing definition of introduction to trading and a newly defined notion of making available on the market, to which the introduction refers. introduction to trading – making equipment available on the market for the first time as part of the business conducted making available on the market – delivering equipment with a view to its distribution, consumption or use within the territory of Poland, as part of the business activity carried out, against a fee or gratuitously. © 2016 D.Dobkowski sp.k., a Polish limited partnership is a law firm associated with KPMG in Poland. The most vital change is an imposed obligation to arrange and finance collection from a waste equipment collecting entity of equipment deriving from both households and from other users. This means that from 1 January 2016 the abovementioned obligations have applied in general to all the waste equipment. PRODUCER Along with the obligations of the entity placing equipment on the market, the WEEE Act regulates obligations of a new entity which is the producer. As transpires from the amended definition, the notion of the “producer” is not ascribed to any entity that produces equipment regulated by the New Act. The WEEE Act imposes on certain producers an obligation to appoint an authorised representative liable for the performance within the territory of the Republic of Poland of obligations determined in the act. For other producers an appointment of an authorised representative is optional. AUTHORISED REPRESENTATIVE The WEEE Act does not provide a definition of an authorised representative. It merely regulates the cases where the producer may (sec. a of the definition of the producer) or has to (sec. d of the definition of the producer) appoint an authorised representative in Poland. The authorised representative acts in the name and for the benefit of the producer, and is liable for the performance of obligations defined in the New Act for the entity placing equipment on the market. However, the authorised representative may not be transferred all the obligations. The authorised representative itself must be recorded in the register that in 2016 will still be maintained by the Chief Inspectorate for Environmental Protection. DISTRIBUTOR The WEEE Act introduces a new notion of a distributor. The said notion superseded those of a retailer and wholesaler introduced under the 2005 Act. Under the very definition of that notion, a distributor may be simultaneously the entity that places equipment on the market. LEGAL ALERT | 6 The New Act imposes on that group numerous obligations. However, the most vital change is connected with an introduction of an explicit regulation that imposes an obligation of a gratuitous acceptance by distributors of the waste equipment in the circumstances defined in the Act. OTHER ENTITIES In addition, the WEEE Act introduces a definition of the entity managing a treatment facility. Amendments were introduced also to a definition of an entity collecting waste electrical and electronic equipment. With reference to an obligation to obtain a decision on waste collection or treatment consulted should be, among others, provisions of the Act on Wastes. 2. Liability of the entity placing equipment on the market Under the WEEE Act introduced was an explicit regulation, pursuant to which in a situation where obligations imposed by the act are being fulfilled through an organization for electrical and electronic equipment recovery, the entity placing equipment on the market is not released from liability for the fulfilment of such obligations (Art. 11 sec. 2). 3. New guidelines on collection and recovery levels The most vital change concerning the levels of waste equipment collection is connected with the fact that from 1 January 2016 all entities placing equipment on the market (not only entities placing on the market household equipment, as it has been the case so far) are required to achieve minimum annual levels of waste equipment collection. In general, such levels have risen as compared with those stemming from the previously binding provisions. What is important, they will gradually be increased. New levels are subject to temporary regulations. From 1 January 2018, the collection level will be regulated by Art. 20 of the WEEE Act, and the levels within three subsequent years will be gradually increased. Moreover, increased have been also the minimum levels of recovery level and of preparation for re-use and recycling of waste equipment (Art. 115 and Art. 21 of the WEEE Act). © 2016 D.Dobkowski sp.k., a Polish limited partnership is a law firm associated with KPMG in Poland. Amendments of minimum collection levels may result in an increase of a possible product fee if the required collection level is not attained. 4. Obligation of collecting small e-waste equipment even if the client did not make a purchase Under the New Act, distributors who run retail trade points with retail space of at least 400 m2, where household equipment is sold, are required to accept at that point or in its immediate vicinity, free of charge, household waste equipment, with no external dimension of more than 25 cm (the so-called small household appliances), without the need to purchase new household equipment in that point. 5. Register – next the WDB In general, almost all entities regulated under the New Act on Waste Electrical and Electronic Equipment must be recorded in the register, which is still maintained by the Chief Inspectorate for Environmental Protection under the provisions of the Act of 14 December 2012 on Wastes (Dz.U. 2013, item 21, as amended). From 24 January 2018 the register is to be superseded with the waste database, the so-called WDB. The said database was to start this year, but finally the commencement of its operation was postponed by 2 years. Although the new principles for being entered to the database are to enter into force in two years, new obligations concerning the entry into the registered maintained by the Chief Inspectorate for Environmental Protection have already been introduced. 6. 2018 amendments – open equipment catalogue 2016 amendment introduces small changes to the equipment catalogue, yet attention should be paid to appendix no 6 to the Act. In accordance with transitional provisions included in Art. 112 of the WEEE Act, by the end of 2017 the New Act applies only to equipment included in one of the groups defined in Appendix no. 6, still in certain cases Appendix no. 6 describes types of equipment using a non-exclusive phrase and other products or equipment, which in fact means that even at present some groups of equipment are not entirely closed. LEGAL ALERT | 7 From 1 January 2018, the list of electrical and electronic equipment subject to the act will be “opened” completely, as a result of which any appliance that conforms to the definition of equipment within the meaning of the New Act and that has not been excluded from the scope of its application, will be classified as equipment. In addition, from 1 January 2018, the number of equipment groups covered by the New Act will be reduced from 10 to 6 (Appendix no. 1 to the WEEE Act). 7. Audit and unannounced inspections A novelty here is an obligation imposed on organizations for electrical and electronic equipment recovery and treatment facilities to submit to annual external audits. Another issue is the possibility of carrying out unannounced inspections of activity of collecting and treating waste equipment, as well as activity of recycling and activities involving waste equipment recovery processes other than recycling. 8. More penalties The New Act increased the number of cases where administrative fines apply. The amounts of fines introduced thereunder span from PLN 5,000 to PLN 1,000,000 (the WEEE Act defines in detail the thresholds for particular categories of violations). 9. Transitional provisions When applying the New Act, particular attention should be paid to transitional periods and provisions for next few years. Januar 2016 ist das neue Gesetz über Elektro-und Elektronik-Altgeräte vom 11. September 2015 in Kraft getreten (Dz.U. 2015, Pos. 1588) („ElektroG” oder „neues Gesetz“). Es ersetzt das Gesetz über Elektro-und ElektronikAltgeräte vom 29. Juli 2005 (Dz.U. 2005, Nr. 180, Pos. 1496 mit Änd.) („Gesetz 2005”). ElektroG setzt ins polnische System die Richtlinie 2012/19/EU des Europäischen Parlaments und des Rates vom 4. Juli 2012 über Elektro- und Elektronik-Altgeräte um („WEEE”). Das Gesetz regelt nach wie vor die Fragenbereiche bezogen auf Elektro- und Elektronikgeräte („Geräte”). Neu ist, dass in der Definition selbst die bisherige Voraussetzung für die Eingliederung in eine der 10 Gruppen nicht mehr vorhanden ist. In diesem Alert stellen wir ausgewählte Änderungen dar. 1. Neue Subjekte – neue Definitionen ElektroG gilt wie bisher für diejenigen Subjekte, die Geräte in Verkehr bringen, Geräte sammeln bzw. eine Abfallbehandlungsanlage betreiben; Organisationen für die Verwertung von Elektro- und Elektronik-Altgeräten, Nutzer. Ab diesem Jahr haben sich der mit Geräten verbundenen Gruppe neue Subjekte angeschlossen und einige davon wurden neu definiert. INVERKEHRBRINGER VON GERÄTEN Das neue Gesetz enthält eine neue Definition des Inverkehrbringers von Geräten, die von dem bisherigen, aus dem Gesetz 2005 stammenden Begriff abweicht. Anbei sei hinzuweisen auf eine andere Definition des Inverkehrbringens sowie einen neuen Begriff der Bereitstellung auf dem Markt, auf den in der Einführung Bezug genommen wird. Die wichtigste Änderung besteht in der Pflicht zur Organisierung und Finanzierung der Rücknahme von dem Sammler solcher Altgeräte, die sowohl aus privaten Haushalten als auch gewerblichen Nutzern stammen. Dies bedeutet, dass ab 1. Januar 2016 die vorgenannten Pflichten generell für alle Altgeräte maßgeblich sind. HERSTELLER Nebst den Pflichten des Inverkehrbringers von Geräten regelt ElektroG ebenfalls die Pflichten eines neuen Subjekts, des Herstellers. Der Begriff „Hersteller” wird im Sinne der geänderten Definition nicht jedem zugeteilt, der Geräte produziert, die in den Anwendungsbereich des neuen Gesetzes fallen. ElektroG legt auf einen Teil von Herstellern die Pflicht auf, einen Bevollmächtigten zu benennen, der für die Erfüllung der gesetzlichen Pflichten im Hoheitsgebiet der Republik Polen verantwortlich ist. Für die übrigen ist die Benennung eines Bevollmächtigten fakultativ. BEVOLLMÄCHTIGTER ElektroG gibt keine Begriffsbestimmung des Bevollmächtigten an. Im Gesetz werden lediglich solche Fälle geregelt, in welchen der Hersteller im Hoheitsgebiet des Landes den Bevollmächtigten benennen darf (Ziff. a- c der Definition des Herstellers a) oder muss (Ziff. d der Definition des Herstellers). Der Bevollmächtigte handelt im Namen und zugunsten des Herstellers und ist für die Erfüllung der im neuen Gesetz festgelegten Pflichten des Inverkehrbringers verantwortlich. Auf den Bevollmächtigten dürfen nicht alle Pflichten übertragen werden. Der Bevollmächtigte ist in ein Register einzutragen, der im Jahre 2016 noch vom Hauptinspekteur für den Umweltschutz geführt wird. Inverkehrbringen - die erstmalige Bereitstellung eines Gerätes auf dem Markt auf gewerblicher Grundlage VERTREIBER ElektroG führt einen neuen Begriff des Vertreibers ein, wodurch die Begriffe der Großhandels- und Kleinhandelsvertreiber aus dem Gesetz 2005 ersetzt wurden. Die Definition selbst schließt nicht aus, dass der Vertreiber gleichzeitig ein Inverkehrbringer sein kann. Bereitstellung auf dem Markt - entgeltliche oder unentgeltliche Abgabe eines Gerätes zum Vertrieb, Verbrauch oder zur Verwendung im Hoheitsgebiet des Landes auf dem Markt des Landes im Rahmen einer gewerblichen Tätigkeit; © 2016 D.Dobkowski spółka komandytowa ist eine der KPMG Polen angeschlossene Rechtsanwaltskanzlei. Der Name KPMG und das Logo sind eingetragene Markenzeichen von KPMG International. Das neue Gesetz legt auf diese Gruppe eine Reihe von Pflichten auf. Die wichtigste Änderung hängt jedoch mit LEGAL ALERT | 9 der ausdrücklichen Regelung zusammen, die Vertreiber dazu verpflichtet, Altgeräte unter gesetzlich bestimmten Bedingungen unentgeltlich zurückzunehmen. ANDERE SUBJEKTE ElektroG ändert ferner die Definition des Betreibers einer Abfallbehandlungsanlage. Geändert wird auch die Definition des Sammlers von Elektro- und Elektronikaltgeräten. In Bezug auf die Pflicht zur Einholung einer Entscheidung im Bereich der Abfallsammlung oder Abfallverarbeitung ist auf die Regelungen des Abfallgesetzes zurückzugreifen. 2. Verantwortung des Inverkehrbringers ElektroG hat eine ausdrückliche Regelung eingeführt, dass die Erfüllung gesetzlicher Pflichten über eine Organisation für die Verwertung der Elektro- und Elektronikgeräte, den Inverkehrbringer von Geräten von der Verantwortung für die Durchführung dieser Pflichten nicht befreit (Art. 11 Abs. 2). 3. Neue Leitlinien betreffend Sammel- und Verwertungsquoten Im Bereich der Sammelquoten von Altgeräten hängt die wichtigste Änderung damit zusammen, dass ab 1. Januar dieses Jahres alle Inverkehrbringer von Geräten (nicht nur wie bisher Geräte aus privaten Haushalten) verpflichtet sind, jährliche Mindestzielvorgaben im Bereich der Sammlung von Altgeräten zu erreichen. Generell wurden diese Quoten im Verhältnis zu den bisherigen Vorschriften höher angesetzt. Sie werden sukzessiv erhöht. 4. Pflicht für die Rücknahme von kleinen Elektroabfällen ohne den Kauf eines neuen Geräts Dem neuen Gesetz zufolge müssen die Vertreiber in ihren Geschäften von Geräten für private Haushalte mit Verkaufsflächen von mindestens 400 m2 oder in deren unmittelbarer Nähe die Altgeräte aus privaten Haushalten mit einer äußeren Abmessung unter 25 cm (sog. Haushaltskleingeräte) kostenlos und ohne Verpflichtung zum Kauf in diesem Geschäft eines neuen Elektro- oder Elektronikgeräts für private Haushalte zurücknehmen. 5. Register – später ADB Generell müssen sich fast alle Subjekte die in den Anwendungsbereich des Gesetzes über Elektro-und Elektronik-Altgeräte fallen, ins Register des Hauptinspektors für den Umweltschutz laut dem Abfallgesetz vom 14. Dezember 2012 (Dz.U. 2013, Pos. 21 mit Änd.) eintragen lassen. Ab 24. Januar 2018 wird dieses Register durch eine Abfalldatenbank, sog. ADB ersetzt. Diese Datenbank sollte bereits dieses Jahr starten, letztendlich aber entsteht sie in zwei Jahren. Obwohl die für die Eintragung ins Register neue Regelungen erst in zwei Jahren in Kraft treten, wurden bereits jetzt neue Pflichten hinsichtlich der Registrierung beim Hauptinspektor für den Umweltschutz auferlegt. 6. Änderungen ab 2018 – offene Kategorien von Geräten Die Mindestquoten für die Verwertung, Vorbereitung zur Wiederverwendung und zum Recycling der Altgeräte wurden auch höher festgelegt (Art. 115 und Art. 21 ElektroG). In dem Katalog von Geräten sind die Änderungen im Jahre 2016 verhältnismäßig gering, sind aber im Hinblick auf Anhang Nr. 6 des Gesetzes sorgfältig zu lesen. Nach der Übergangsvorschrift gemäß Art. 112 ElektroG ist das neue Gesetz bis Ende 2017 nur auf Geräte aus einer der im Anhang Nr. 6 genannten Gruppen anwendbar, trotzdem wurden die Gerätearten im Anhang Nr. 6 in einigen Fällen durch die Formulierung: „sowie andere Produkte oder Geräte (…)” offen dargestellt, was de facto bedeutet, dass einige Gerätegruppen bereits jetzt nicht ganz geschlossen sind. Änderungen der Mindestsammelquoten können dazu beitragen, dass sofern die obligatorischen Sammelquoten nicht erreicht werden, eine Erhöhung etwaiger Produktgebühr möglich ist. Ab 1. Januar 2018 ist das Verzeichnis von Elektro- und Elektronikgeräten, das in den Anwendungsbereich des Gesetzes fällt, ganz „offen” und demnach wird jedes Gerätestück für das Gerät erklärt, soweit es mit der Neue Quoten sind in den Übergangsvorschriften geregelt. Ab 1. Januar 2018 verringert sich ferner die Anzahl von Gerätegruppen von 10 auf 6, auf die das neue Gesetz Anwendung findet (Anhang Nr. 1 ElektroG). 7. Prüfung und unangekündigte Kontrollen Neu ist die Pflicht für Verwertungsorganisationen und Verarbeitungsanlagen, jährliche externe Prüfungen pflichtgemäß durchzuführen. Zweitens sind unangekündigte Kontrollen der Tätigkeit im Bereich Sammlung, Verwertung und Recycling von Altgeräten sowie andere als Recycling Abfallverwertungsverfahren von Altgeräten möglich. 8. Größere Anzahl von Strafen Dem neuen Gesetz zufolge wurde die Anzahl von Fällen erweitert, wo verwaltungsrechtliche Geldbußen vorgesehen ist. Die Höhe der Geldbußen nach dem neuen Gesetz beträgt von PLN 5000 bis zu PLN 1.000.000 (ElektroG legt für jeweilige Vorstöße detaillierte Höchstwerte fest). 9. Übergangsvorschriften Bei Anwendung des neuen Gesetzes sind in besonderem Maße Termine und Übergangsvorschriften für die nächsten Jahre zu beachten.
