5. Aboutendingofprocessofcontractorselection,theparticipantswillbeinformedbythemessage
availableontheorderingParty’swebsite.
6. TheorderingPartywillnotreimburseanyexpensestotheparticipantsoftheinquiryproceeding
arisingduringthepreparationofsubmissionoftheoffers.
7. TheorderingPartyreservestherighttocancelorendtheprocessofthecontractor’sselection,
withoutindicatingareason.
8. Incasethatnoneofthesubmittedoffershavebeenchosen,theparticipantshavenorighttoclaim
totheorderingParty.
9. Incaseofcircumstanceswhennoneofthesubmittedoffersareconsistentwiththerequirements,
theorderingPartyreservestherighttonegotiatethemostconvenientofferaccordingtoitsown
opinion.
10. Incaseofcircumstanceswhenthesubmittedoffersgetthesamenumberofpoints,theordering
Partyreservestherighttonegotiatethemostconvenientofferaccordingtoitsownopinion.

11. Criteriaforcontractorselection:

a) ThenumberofNPpointsforthe„NetPrice”criterionwillbecalculatedasfollows:

Pbest–thelowestpriceamongalloffers,
Po-pricegivenbythebidderfor
whomthepointsarecalculated.ForevaluationNPshallbecalculatedwiththeprecision
oftwodecimalplaces.InthecaseofothercurrencythanthePolishzloty(PLN),the
conversionpricewillbeappliedwithrespecttotheaverageexchangerateofthe
currencyannouncedbytheNationalBankofPolandonthedayonwhichtheoffersare
evaluated.
b)thenumberofGRpointsforthe“Guarantee”criterionwillbecalculatedasfollows:

GRo–guaranteegiveninmonths

12. Fromtheparticipationinthetenderentitieswhoarepersonallyorfinanciallyrelatedtothe

OrderingPartywillbeexcluded.
Throughthecapitalorpersonalrelationsmaybeunderstoodtheinteractionsbetweenthe
OrderingPartyorthepeopleauthorizedtoenterintocommitmentsonbehalfoftheOrdering
PartyorpersonsperformingonbehalfoftheOrderingPartyalltheactivitiesrelatedtothe
preparationandimplementationofproceduresforselectionofthecontractor,andBidder,in
particularby:
• participationinthecompany,asapartnerorpartnership,
•
owningatleast10%oftheshares,
•
roleasamemberofthesupervisoryboard,managementorproxy,
•
remainingmarriedinconsanguinityoraffinityinastraightline,theseconddegreeof
kinshiporaffinityoftheseconddegreeinthecollaterallineorbyadoption,guardianship
orcustody.
13. Amendmentstothecontract:
a) TheOrderingPartyreservestherighttonegotiatethedetailedtermsofthecontractwith
theselectedcontractor.
b) TheOrderingPartyreservestherighttochangethecontractwiththeselectedContractor
intheresultoftheorderawardprocedureforthefollowingreasons:
- substantialchangesinthewayofexecutionofthecontract,
- objectivereasonsindependentoftheOrderingPartyortheContractor,
- changesinlegislationthattakeeffectwhenthecontracthasbeensigned.
