PRZEDMIOT UMOWY
The subject of this contract is the definition of the
rights and obligations of both parties, arising in the
connection with the presentation of a theatre stage
production: “Nasza klasa” (“Our Class”) written by T.
Slobodzianek and directed by O. Spišák within the
framework of the Focus Poland at Nová dráma/New
Drama Festival which will be held in Bratislava from

A. Theatre is obliged:

2. To send by mail an attestation / certificate about
fire protection reliability and fire protection
modifications and check of coulisse (stage props) as
part of the present contract.
2.
Dołączenia do niniejszej umowy certyfikatu
o dostosowaniu dekoracji scenicznych do wymogów
przeciwpożarowych.
3. To provide and to cover medical and travel
insurance of all members of artistic group and
technicians and to inform the Festival about the kind
of insurance.

Zapewnienia oraz opłacenia ubezpieczenia
podróży oraz ubezpieczenia medycznego dla
wszystkich członków zespołu artystycznego oraz
pracowników technicznych oraz poinformowania o
ww. Festiwalu.
4. To provide the Festival with:
a) reviews of a respective stage production in
English language
b) 15 photographs of the stage production (designed
for a bulletin, press conferences, the festival press
centre during the event)
c) other available promotion sheets and materials for
publicity
4. Udostępnienia organizatorowi Festiwalu:
a) recenzji spektaklu w języku angielskim
b) 15 zdjęć ze spektaklu w rozdzielczości
odpowiedniej dla publikacji oraz konferencji
prasowej
c) innych materiałów promocyjnych
5. If in contact with mass media and journalists at the
festival, we kindly ask you to inform the press centre
of the festival (Lucia Čarnecká,
[email protected]). The festival has to be
informed about any interview. In contact with media,
please make sure they mention your participation at
the Nová dráma / New Drama Festival 2012.

Festiwal musi był poinformowany o wszelkich
wywiadach, a Teatr poinformuje media o swoim
udziale w Nová dráma / New Drama Festival 2012.
6. To set up and strike down the set of the respective
production in accordance with the conditions of the
Festival and its obligations towards other theatres
presented (to free the stage no later than 120
minutes after the end of performance).

Dostosowania czasu montażu i demontażu
dekoracji spektaklu do możliwości czasowych
festiwalu oraz zwolnienia sceny najpóźniej do 120
min. po zakończeniu przedstawienia.
7. To allow Festival and the staff of television and
radio to make programmes to be broadcast in news
production, prime news programmes, with the aim to
provide the information, documentation, promotion
and publicity of the festival event free of a claim for
the royalties. The recording should be less than 5
minutes long.

Umożliwienia bez dodatkowych opłat
dokonania nagrania spektaklu przez Festiwal, ekipy
radia i telewizji w celu jego wykorzystania w ich
programach informacyjnych oraz materiałach
informacyjnych, dokumentacyjnych i promocyjnych
Festiwalu. Długość nagrania nie może przekroczyć
5 min.
8. To play a theatre performance at high standard
level in compliance with a significance of the
Festival.

Zaprezentowania przedstawienia na
najwyższym poziomie odpowiadającym randze
festiwalu.
9. Any author´s rights and respective royalties in
regards to the performance presented in the frame of
Festival are at the full responsibility of the Theatre.
9.
Teatr jest w pełni odpowiedzialny za prawa
autorskie oraz związane z tym honoraria autorskie
wynikające z prezentacji spektaklu na Festiwalu.
10. To provide and cover the travel costs. All later
changes of names, dates, times and destinations of
the above mentioned means of transport are at the
expense of the Theatre.

Zapewnienia i pokrycia wszystkich kosztów
podróży. Wszelkie koszty wynikające z późniejszych
zmian danych personalnych, terminów oraz
destynacji dotyczących uzgodnionego środka
transportu pokrywa Teatr.
B. Festival is obliged:
B. Festiwal zobowiązuje się do:
1.To cover the following items for the Theatre:
a) To arrange and to provide Theatre with
accommodation in 3 star hotel and up, according to a
room description as follows:
single rooms: 15
double rooms: 4
date of arrival: 18. 5. 2012

zakwaterowania w hotelu min. 3gwiazdkowym zgodnie z poniższą specyfikacją:

b) to provide a fee for the performance of 9 000 €
(nine thousand Euro) including fee for
performance, royalty, per diems to the Theatre,
payable in a following manner in installment:

1 installment of 9 000 € payable via bank transfer
according to payment instructions following the
completion of this engagement, after receiving an
invoice from the Theatre and no later than on two
days after the presentation, i.e May 21st, 2012.
b)
wynagrodzenia za wykonanie spektaklu w
wysokości 9 000,- EUR (słownie: dziewięć tysięcy
euro), w tym honorarium, opłaty licencyjne i
autorskie oraz diety, płatnego w jednej racie
przelewem bankowym po otrzymaniu faktury od
Teatru, najpóźniej dwa dni po prezentacji spektaklu
tj. 21.5.2012.
2. To provide favourable technical conditions for a
performance:
a) to provide, to arrange and to prepare:
- stage - SEE TECHNICAL RIDER
- sound technician booth - 1 PERSON
- lighting-up equipment booth - 1 PERSON
- cloakrooms / wardrobe - 3 wardrobe rooms
- start of setting up a stage: 7 a.m., 19.05;
- rehearsal of a stage production – 3 p.m., 19.05;

b) to provide a necessary team of technicians
required to be on duty during a performance

3. To provide during a performance the special
services required (fireman, usherettes, cloakroom
services. etc.).
3. Zapewnienia usług koniecznych podczas
przedstawienia (BHP, bileterki, szatniarki, itp.).
4. To provide promotion and publicity of a respective
stage production (play) performed, in all Festival
leaflets, bulletins, brochures, posters, with the
information delivered by the Theatre.
4. Zapewnienia promocji spektaklu na podstawie
materiałów otrzymanych z teatru.
5. To provide a simultaneous translation in Slovakian
and cover a cost of a person who will operate a
surtitles during a rehearsal and a performance.
5. Zapewnić tłumaczenie symultaniczne na słowacki
i pokryć koszty osoby święcącej napisy w trakcie
próby i spektaklu.
6. To provide Theatre with 6 free tickets.
6. Zapewnić Teatrowi 6 bezpłatnych miejsc na
pokaz Spektaklu.

Special provisions

POSTANOWIENIA SPECJALNE
1.
The Theatre may withdraw a performance
only in case of a serious disease of any of the
leading role protagonists with respect to the fact that
he / she cannot be adequately replaced at a
respective high standard acting required. The
respective costs which occurred during the
preparation of this presentation to this point will be
equally shared by both contractual parties.
1. Spektakl może zostać odwołany przez Teatr tylko
w przypadku poważnej choroby jednego z
podstawowych aktorów, o ile nie może on zostać
godnie zastąpiony przez inną osobę. Już poniesione
i zapłacone koszty przygotowania spektaklu zostaną
rozdzielone po równo między obie strony umowy.
2.
As far as the Theatre will cancel the
performance due to other reasons, Theatre
authorities will cover the respective costs to the
Festival, which occurred within the framework of the
preparation, or which are necessarily required for
arranging and managing an emergency performance
to substitute the scheduled one.
2. Jeśli Teatr odwoła przedstawienie z innych
przyczyn, zobowiązuje się do pokrycia wszelkich
kosztów poniesionych przez organizatorów
Festiwalu lub też kosztów, które są niezbędne do
zorganizowania przedstawienia zastępczego.
3.
The Festival has the right to cancel the
contractually stipulated and agreed performance
(eventually, participation of a respective Theatre in
the festival), under the circumstances that the
contractually stipulated and agreed terms and
conditions are not followed and are not fulfilled by
the Theatre, or if the performance itself to be on and
/ or the high standard of the Festival are jeopardised
seriously otherwise and put under threat due to other
reasons. As far as the Festival will cancel the
performance due to other reasons and less then 14
days before the performance the Festival will pay
1000 EUR to the Theatre as an agreed penalty by
bank transfer.
3. Festiwal ma prawo do odwołania przedstawienia,
o ile nie zostały spełnione przez Teatr uzgodnione
warunki umowy lub też realizacja spektaklu albo
jego poziom artystyczny są poważnie zagrożone z
innych przyczyn. Jeżeli Festiwal odwoła
przedstawienie z innych powodów i na mniej niż 14
dni przed dniem prezentacji, w takiej sytuacji
Festiwal zapłaci Teatrowi przelewem 1000 EUR
kary umownej.
4.
All extraordinary situations which may occur
during a preparation for the performance to be on in
the time of the Festival's ongoing and proceeding,
are to be solved by an agreement in order to keep
and follow the scheduled programme of the Festival
and not to jeopardise its high standard and
reputation.
4. Wszystkie sytuacje nadzwyczajne, które
powstaną w trakcie przygotowań do spektaklu w
trakcie Festiwalu będą rozwiązywane w formie
polubownej między obiema stronami umowy w taki
sposób, by został zachowany program Festiwalu
oraz jego poziom.
5.
Eventual damages which may be caused by
Theatre ensemble, being present and involved in the
Festival, will be solved by financial compensations,
fines and penalties.
5. Ewentualne szkody spowodowane przez Teatr
podczas obecności na Festiwalu zostaną pokryte w
formie kar finansowych.
6.
Technical requirements of the Theatre, which
were not listed in the contract, will not be additionally
provided and covered by the Festival.
6. Wymagania techniczne niewymienione w umowie
lub też niezgłoszone wcześniej w oficjalnej
korespondencji między Teatrem i Festiwalem, nie
będą mogły zostać zapewnione i sfinansowane
przez Festiwal.
7.
The Festival does not deposit any things in
possession owned by the theatre or its members.
This is not under the Festival’s activity. It is the
theatre’s responsibility to take care of its
possessions. The Festival does not take any
responsibility for damage or loss of the possessions.
7. Festiwal nie ponosi odpowiedzialności za majątek
Teatru lub jego członków. Festiwal nie ponosi
odpowiedzialności za ich utratę lub kradzież.
8.
By course of the article 433 of the Civil Code,
the possessions in the place of accommodation are
under responsibility of the owner of the place. The
compensation for the damage must be claimed from
the owner of the place of accommodation without
any further delay, fifteen days after the day of
learning of the damage otherwise the claim will
lapse.
8. Zgodnie z § 433 Kodeksu cywilnego [Rep.
Słowackiej], za mienie zakwaterowanych gości,
znajdujące się w pomieszczeniach noclegowych
ponosi odpowiedzialność zarządca bazy
noclegowej. Wniosek o odszkodowanie za
ewentualne szkody Teatr musi złożyć bez zbędnej
zwłoki u zarządcy bazy noclegowej, najpóźniej w
ciągu 15 dni od daty, kiedy poszkodowany
dowiedział się o szkodzie, po tym terminie wygasa
prawo do odszkodowania.
9.
In accordance with the Act No. 546/2010
Coll. amending the Act No. 40/1964 of the Civil Code
as amended in latter provisions amending and
supplementing some acts, the contractual Party
(Author) agrees with publishing the contract on the
Website of the Theatre Institute, the Central Register
of Contracts, and in the Commercial Bulletin. In the
case of disagreement the Contractual Party is
cognizant that such agreement is invalid.
9. Na podstawie ustawy nr 546/2010 Dz.U. Rep.
Słowackiej, która nowelizuje ustawę nr 40/1964
Kodeks cywilny w brzmieniu późniejszych
przepisów oraz zmienia i uzupełnia inne ustawy,
Teatr wyraża zgodę na opublikowanie niniejszej
umowy na stronie internetowej Instytutu Teatralnego
(Divadelný ústav), w Centralnym Rejestrze Umów
(Centrálny register zmlúv) lub w Monitorze
Handlowym (Obchodný vestník).

POSTANOWIENIA KOŃCOWE
Both Contractual Parties are obliged to keep and
follow strictly and thoroughly the agreed terms and
conditions stipulated in the present Contract, so thus,
to maintain a successful procedure of the Festival.
Strony umowy zobowiązują się do dokładnego
wypełnienia warunków umowy, a tym samym
zapewnienia pomyślnego przebiegu festiwalu.
This document is made in two identical copies in the
English and Polish language. Each party shall
receive one signed copy thereof.
Umowa została sporządzona w dwóch
jednobrzmiących egzemplarzach, po jednym dla
każdej ze Stron.
