The idea to find safety of purchase transactions on residerttial markets of developers and cooperatives was put forward in the time when difficult situation in residential construction resulted in bankruptcies of companies, which could not balance demand and prices with the costs of apartments built. There were also examples of sheer fraud. In effect, we had situations, when the client was irretrievably losing his money paid before construction had started or in the course of construction. Law on escrow account appears in the time when investment market is in upswing. Market participants: clients, developers and banks will have the time to leam and implement the law in the time of good economic situation. But obligatory escrow account will reveal in fuli its benefidal effects and usefulness in the time of difficult situation in construction industry, would it happen as łatę as possible. Whom will this law burden the most? One may perversely say that it will be incorwenient for those building and selling on the residential real estate market, who fairly conduct their business in accordance with law and with their best intentions. On the other hand, escrow account will be beneficial, when threats and possibilities of clients losing money often coming from loans will appear. Both above mentioned markets will share the risk, costs and also advantages of such a law - one market will beai an extra costs and the other will have potential advantage due to either retaining the right to a parł of outlays on construction of an apartment madę or - what we propose outside the escrow account - the right to indemnity from insurance policy, because we mąkę an attempt to create second layer of protection for the transaction market. The increased level of risk, connected with multiplying shortlived investments also provides justification for creation of such a legał regulation. At the moment, assumptions for such a law arę prepared and an attempt is madę to integrate these assumptions into generał content of the law. A team composed of representatwes of i.a. the Ministry of Construction, the Ministry of Justice, the Ministry of Finance, Office of Competition and Consumer Protection holds meetings and attempt to write the assumptions and generał content of the law. Deweloperzy przyjmują go tradycyjnie z rezerwą i pytają: kto na tym zyska, kto straci? Idea bezpieczeństwa transakcji zakupu lokali mieszkalnych na rynku deweloperskim i spółdzielczym wywodzi się z okresu, kiedy dekoniunktura w budownictwie mieszkaniowym powodowała upadtość firm, które nie znalazły odpowiedniego poziomu popytu oraz cen, będących odpowiedzią na koszty budowania. Zdarzały się również przypadki jawnych oszustw. Dochodziło w efekcie do sytuacji, w której klient bezpowrotnie tracił środki wpłacane przed rozpoczęciem budowy lub w trakcie budowy. Ustawa o rachunku powierniczym pojawia się w okresie, kiedy rynek inwestycyjny przeżywa prosperity. Jego uczestnicy, klienci, deweloperzy, banki będą mieli czas na uczenie się i wdrażanie ustawy w okresie dobrej koniunktury. Ale obowiązkowy rachunek powierniczy swoje dobroczynne skutki i przydatność pokaże w pełni dopiero w okresie dekoniunktury w budownictwie, który oby nastąpił jak najpóźniej. Kogo projektowana ustawa najbardziej obciąży? Można powiedzieć przewrotnie, że będzie niewy- godna dla tych uczestników rynku budowania i zbywania nieruchomości lokalowych którzy i tak prowadzą swój biznes uczciwie, zgodnie z prawem i najlepszymi intencjami. Natomiast tam, gdzie występują zagrożenia i możliwość utarty środków klientów, często pochodzących z kredytów, tam rachunek powierniczy będzie dobrodziejstwem. Ryzykiem, kosztami, ale i pożytkami działania takiej ustawy podzielą się oba wspomniane rynki - jeden rynek dodatkowym kosztem, drugi rynek ewentualną korzyścią z tytułu albo zachowania prawa do części nakładów poniesionych na budowę lokalu, albo - co proponujemy poza rachunkiem powierniczym - prawa do odszkodowania z polisy ubezpieczeniowej, bo tutaj podejmujemy próbę tworzenia drugiej warstwy chronienia rynku transakcyjnego. Poziom podwyższonego ryzyka w związku z mnożącymi się dziś inwestycjami koniunkturalnymi również stwarza uzasadnienie do stworzenia takiej regulacji prawnej. W tej chwili są przygotowywane założenia do tej ustawy oraz próba scalenia tych założeń w postaci jej treści ogólnej. Zespół, który jest złożony m.in. z przedstawicieli Ministerstwa Budownictwa, Ministerstwa Sprawiedliwości, Ministerstwa Finansów, Urzędu Ochrony Konkurencji i Konsumentów, w tej chwili odbywa spotkania i próbuje napisać założenia oraz ogólną treść ustawy. On the other hand, commons arę not eager to sell land, or they do it only when they arę surę that revenue from the sale is profitable and they will be able to use it for other statutory obligations of the common. In tum, the land owned by the Treasury, for instance at the disposal of the Agricultural Property Agency or Military Property Agency, may be put on market in various situations, but it nas a fundamental flaw - its value and usefulness for residential construction depends on the authorities of a common, i.e. on drawing up and approving spatial development plans and on dedsions on so called 'taking the land out of agricultural use" and on the outlays of the State, common of private companies on the infrastructure. Planning to turn land for residential construction and putting it on the market does not mean that normal investment process may be started, because the land must first be madę accessible and developed. And today many plots put for sale have no appropriate infrastructure. At the same time, this year already the number of construction permits is by over 47% higher than in the same period of 2006. i marne czasy ' Obawy deweloperów budzi kwestia ograniczania dostępu do terenów budowlanych przewidzianych pod budownictwo mieszkaniowe, co powoduje niekontrolowany wzrost cen gruntu. Ma to w tej chwili kluczowe znaczenie dla rozwoju mieszkalnictwa. Czy Ministerstwo chce i może coś w tej kwestii zrobić, jak uelastycznić podaż terenów budowlanych? Grunty w Polsce, poza sytuacjami spornymi, są już podzielone - są własnością gminy, osób fizycznych i prawnych, skarbu państwa... Można powiedzieć, że tych gruntów nie brakuje, dokładnie mówiąc, one są w takiej ilości, ile jest powierzchni gruntów pod budownictwo w Polsce. Ich właściciele, zwłaszcza osoby fizyczne cieszą się z dobrej koniunktury i możliwości zbycia na rzecz nowego inwestora konkretnej działki. Natomiast gminy niechętnie wyzbywają się gruntów bądź czynią to wtedy, gdy mają pewność, że zarobek z ich sprzedaży będzie opłacalny, a następnie będzie mógł być przeznaczony na inne, statutowe zadania gminy. Z kolei grunty skarbu państwa, np. znajdujące się w dyspozycji Agencji Nieruchomości Rolnych oraz Agencji Mienia Wojskowego, to są grunty, które w różnych sytuacjach są wypuszczane na rynek, ale mają podstawową wadę - ich wartość i przydatność dla budownictwa mieszkaniowego zależy od organów gminy, tzn. od sporządzenia i uchwalenia planów zagospodarowania przestrzennego oraz od decyzji dotyczących tzw. odrolniania oraz od nakładów państwa, gminy i firm prywatnych, poniesionych na infrastrukturę. Zaplanowanie gruntów pod budownictwo mieszkaniowe, skierowanie ich na rynek nie oznacza, że można rozpocząć normalny proces inwestycyjny, ponieważ grunt powinien być najpierw skomunikowany z otoczeniem i uzbrojony. A dzisiaj mamy do czynienia z sytuacją taką, że przeznacza się do zbycia grunty bez odpowiedniej infrastruktury. Równolegle w bieżącym roku wydano już ponad 47 proc. więcej pozwoleń na budowę niż w analogicznym okresie 2006 roku. My oceniamy taką liczbę wydanych pozwoleń jako silną presję inwestycyjną, która może być ograniczana nie tyle brakiem gruntu, co brakiem gruntu o cechach, o których wspomniałem wcześniej, czyli uzbrojonych i skomunikowanych z otoczeniem. Gminy twierdzą, że w konsekwencji planowania gruntów pod budownictwo mieszkaniowe spada na nie obowiązek uzbrajania, budowania infrastruktury, a więc koszty i duży wysiłek inwestycyjny. Mogłoby to zostać zrekompensowane poprzez pobieranie opłat adiacenckich i opłat pla- In our opinion, such a number of granted permits is a proof of strong investment pressure, which may be restricted not so much by shortage of land, but by shortage of plots with above mentioned features, namely developed and accessible. The commons complain that in the result of planning grounds for residential construction, they arę obliged to develop them and invest in infrastructure, and so to bear costs and to undertake great investment efforts. It could be compensated by taking adjacent fees and planning fees, but most commons resign from charging these fees. Why commons do not charge these fees? Arę they afraid of their local electorate? It seems that out political culture in self-govemments consists in not doing things which electors would not like. It is a pity that so few representatives of self-government arę ready to pay the price of functioning in morę difficult conditions and, on the other hand, to gain positive values for the community for which they serve. Developer activity is exceptionally oriented on big profits and deals with the use of big capital. For this reason developers' activities arę to much extent ruthless, as regards appropriation of land. On the other hand, architectural and urban thinking is missing in the cities and urban shape of a city should also depend on the will of those making decisions in the stage of drawing up spatial development plans. Land, plots arę quite intensely developed, dense building development is allowed, at the same time big places, greenery and appropriate traffic routes arę restricted to minimum. This entails devastation of urban values of space. l am corwinced that the new law will find happy medium to solve this issue. ' And what about good neigbourhood principle which restricts so much building deuelopment? Will it be also included in the new law? The principle of good neighbourhood should be extended and liberalized in the new law. For instance, not only directly adjacent building development should be taken into account, but also diagonal development. The shape of the building development : should not be decided solely by existence of identical or similar development next door, but also by its shape and naturę on a wider area than one plot. Having some knowledge of the area, e.g. acting on the basis of development study - the decision makers will be able to issue specific types of development conditions and construction permits for individual structures. Next issue - first development conditions, then plans - and in the case that there arę no plans, architectural and urban standards, which shall enter the market, will provide basis for building development of specific terrains. Commons will have to consider whether they should mąkę plans or not, because they may come across a situation, where investors shall develop land on the basis of centrally determined parameters and standards (i.e. by the minister). Perhaps, such a situation will be even better for inyestors, because then there will be no questions about the plan and there will be no reason to błock the investment because of łąck of a plan. It results from collected data that in Poland 50% of land designated for construction is aiready owered by plans. * Ań idea appeared recently, that a słotę institutian with land at its disposal should take fhe tasks o/a deve1aper. Is this idea implemented? This idea has not appeared in the Ministry of Construction. We aiready have such a structure established for definite purposes - the Military Housing Agency, which builds for the army. Besides this specific case, l do not consider it appropriate to create any big economic entity realizing government construction with 100% participation of the State Treasury. l think that we should only influence construction market by regulating specific areas reguiring such regulation and by acting precisely and accurately, particularly in the area of social housing. 11 i Vft What does the government want to do with loan subsidies? Even after adjustment offinancial thresholds they arę too Iow, particularly in big agglomerations, where prices per sq.m arę high. These questions arę asked by those who build expensive apartments. Let their critical remarks function in the areas in which they operate, because we arę not going to create programs subsidizing those, who build expensive and for those, who can afford to buy expensive apartments. But we arę perfectly aware that after amendment of the law on financial support of families in purchase of their own apartments, there will be an influence on price formation of average standardized resources, which can be purchased by beneficiaries of this law. Perhaps, when demand for expensive apartments and luxury apartments will decrease, it will the law will guide developers' attention to housing segment for nistycznych, ale gminy w większości z pobierania tych optat rezygnują. Widocznie nasza kultura polityczna samorządów polega na nieczynieniu czegoś, co mogłoby spotkać się z niechęcią wyborców. Należy żałować, że tak niewielu przedstawicieli samorządów decyduje się zapłacić tę cenę, jaką jest funkcjonowanie w trudniejszych warunkach i w zamian uzyskiwać pozytywną wartość dla społeczności wśród której pełnią swoją funkcję. ' Czy przygotowana ustawa o gospodarce przestrzennej będzie miala zapisy chroniące przestrzeń przed nieuprawnionymi zakusami deweloperów? Czy ktoś w Ministerstwie Budownictwa polemizuje z poglądami, wyrażonymi niedawno na lamach „Rzeczpospolitej": że gdyby wprowadzić wysokie budownictwo tam, gdzie już zaplanowano jednorodzinne, można by wbudować jeszcze więcej mieszkań? Działalność deweloperska jest branżą wyjątkowo nastawioną na duże zyski i obraca się w niej dużym kapitałem. To powoduje, że deweloperka jest w wysokim stopniu bezwzględna w odniesieniu do zawłaszczania przestrzeni. Z drugiej strony brakuje w miastach architektonicznego, urbanistycznego myślenia - kształt urbanistyczny miasta powinien zależeć również od woli decydentów na etapie formułowania planów zagospodarowania przestrzennego. Grunty, dziatki są zabudowane dość intensywnie, pozwala się na gęstą zabudowę, jednocześnie niwelując do minimum duże place, zieleń oraz odpowiednie ciągi komunikacyjne. Powoduje to dewastację wartości urbanistycznej przestrzeni. Jestem przekonany, że nowa ustawa pozwoli znaleźć złoty środek dla rozwiązania tej kwestii. DH27A co z zasadą dobrego sąsiedztwa, która mocna ogranicza możliwości zabudowy? Czy również znajdzie się w nowej ustawie? Zasada dobrego sąsiedztwa w nowej ustawie o zagospodarowaniu przestrzennym powinna być mocno rozszerzona i zliberalizowana. Np. powinna być brana pod uwagę nie tylko bezpośrednio przyległa zabudowa, ale i zabudowa istniejąca po tzw. przekątnej. O kształcie zabudowy nie powinien decydować wyłącznie fakt, że istnieje obok zabudowa bliźniacza czy też podobna, tyko jej kształt i charakter na terenie szerszym niż jedna działka. Decydenci mając pewną wiedzę o terenie, np. działając w oparciu o studium zagospodarowania - będą mogli wydawać określone typy warunków i pozwoleń na budowę dla określonych obiektów. Kolejna kwestia - najpierw warunki zabudowy, później plany, a w przypadku braku planów standardy architektoniczno-urbanistyczne, które wejdą na rynek, będą podstawą do zabudowania określonych terenów. Tutaj gminy będą musiały się za- stanowić, czy planować czy też nie, bo spotkają się z sytuacją, gdzie inwestorzy na podstawie centralnie ustalonych parametrów i standardów (czyli przez ministra) będą i tak zabudowywać tereny. Być może ta sytuacja dla inwestorów będzie nawet lepsza. Dlatego, że wówczas nie będzie zapytania o plan, nie będzie również z powodu braku planu blokowania inwestycji. Z danych wynika, że w Polsce ok. 50 proc. terenów pod budownictwo jest już zaplanowanych. i celnie szczególnie w sferze budownictwa społecznego i socjalnego. IT7TT7 Co rząd chce robić z subsydiami do kredytów? Nawet po korektach progów finansowych będą one zbyt niskie, aby obejmować znaczącą część rynku mieszkaniowego, zwłaszcza w większych aglomeracjach, gdzie ceny m kw. są wysokie. To pytanie zadają generalnie ci, którzy budują drogie mieszkania. Niech ich krytyka funkcjonuje OSS2J Pojawil się ostatnio pomyśl, aby inw tych obszarach, na których się poruszają, bo my stytucja państwowa dysponująca gruntami nie tworzymy programów dotowania kredytów dla podejmowała się zadań dewelopera. If we confine to critical remarks and most of them come from developers in big agglomerations, we would say "and what do we need the rest of Poland for?". The government must conduct policy for benefit of a family. Thanks to the subsidy, we take a part of the burden of repayment of the loan by families which twe bought their own apartments and let them develop properly. We thought about the level of subsidy and we decided that if to a loan of 120 000 -150 000 zł, we shall add during 8 years from the state funds the equivalent of big building relief, we shall meet the expectations of less affluent social groups to whom this assistance is addressed. CEE27 What about making order with rental housing? We have such a form of rental housing that has not met our expectations with regard to its scalę, but perhaps there is a chance of success, particularly in the commons engaged in creation of foundations for rental housing. First, success of rental housing depends mostly on local self-govemments. Second, the law on public-piwate partnership will be amended. Third, the government entered the segment of rental housing with the law on social housing -100 000 social apartments arę to arise under this law. It seems to us that it is the most important to follow the example of Western countries, where developer does not think only and exdusively about ownership housing, but also about housing for
