Streszczenie Administracja celna jest częścią administracji rządowej, a tym samym publicznej. Organem centralnym sprawującym nadzór nad administracją celną jest minister właściwy do spraw finansów publicznych. Podporządkowanie administracji celnej ministrowi właściwemu do spraw finansów publicznych wynika z podstawowej funkcji tejże administracji, a mianowicie funkcji fiskalnej. Obecnie funkcjonuje trójszczeblowa struktura administracji celnej. Pierwszy szczebel – podstawowy, tworzą urzędy celne wraz z naczelnikami urzędów celnych jako organami, z kolei drugi szczebel tworzą izby celne z dyrektorami izb celnych jako organami na czele. Trzeci szczebel – najwyższy, funkcjonuje na poziomie Ministerstwa Finansów – tu występuje dwa organy – minister właściwy do spraw finansów publicznych oraz Szef Służby Celnej. Administracja celna odgrywa ogromną rolę i to zarówno w funkcjonowaniu przedsiębiorców, jak i budżetu państwa oraz budżetu Unii Europejskiej. Skutecznie realizuje funkcję ochronną i kontrolną, co ma szczególne znaczenie dla funkcjonowania gospodarki krajowej, jak dla rynku wspólnego. Istotne znaczenie ma również funkcja fiskalna. Realizując tą funkcję administracja dostarcza znaczących dochodów do budżetu państwa – wpływy z podatku akcyzowego oraz z podatku VAT z tytułu importu stanowią istotne wpływy budżetowe. Po przystąpieniu Polski do Unii Europejskiej administracja celna jest ona odpowiedzialna za prawidłowe funkcjonowanie polskiej granicy wschodniej (z Białorusią i Ukrainą), która stanowi zewnętrzną granicę Unii Europejskiej. Dotyczy to przede wszystkim obrotu towarowego z państwami trzecimi na tym odcinku. Celem analizy podjętej w monografii jest określenie miejsca i roli administracji celnej w systemie administracji publicznej. Wskazano najważniejsze funkcje i zadania tej administracji w obecnym czasie. Zaznaczyć należy, że administracja celna po przystąpieniu Polski do Unii Europejskiej odgrywa coraz istotniejszą rolę. Związane jest to z faktem, że polska granica wschodnia stanowi zewnętrzną granicę Unii Europejskiej. Monografia skierowana jest głównie do studentów kierunku administracja oraz innych kierunków prawniczych i ekonomicznych, które poruszają problem obrotu towarowego z zagranicą i administracji obsługującej ten obrót, a także pracowników instytucji zajmujących się obrotem towarowym z zagranicą. Książka ma przede wszystkim wymiar dydaktyczny. Summary Customs administration is a part of government administration, thus public one too. Central organ supervising customs administration is the appropriate minister of public finance matters. Subordination of customs administration to the appropriate minister of public finances stems from basic function of the administration, namely fiscal function. Currently there is a three-tier customs administration structure. The first level - basic one, is constituted by customs offices together with the customs offices’ managers as organs; then, the second level comprises customs chambers with directors of customs chambers as organs on top. The third level the highest one, functions on the level of the Ministry of Finances - and here two branches occur - the appropriate minister of financial public matters and Customs Service Chief. Customs administration performs a tremendous role in enterprises’ functions, as well as a state budget and the budget of the European Union.It effectively fulfills protective and controlling role, which has a specific significance for the state economy, and for the common market. Fiscal functions have an essential meaning too. By realizing this function the administration provides considerable profit to the state budget - the profit from the excise tax and from VAT on the grounds of import which accounts for vital budget income. After joining the European Union, customs administration is responsible for correct functioning of the Polish Easter border (with Belarus and Ukraine), which composes the outer border of the European Union. Most of all, it concerns trade with third countries on this section. The objective of this monograph is placing the location and role of customs administration in public administration system. The most important, present functions and tasks of the administration were pointed. It is important to mark that the customs administration’s role has been increasing gradually after joining the European Union. It is closely related to the fact that Polish Easter border is the external border of the European Union. The monograph is mainly aimed at students studying administration, and other law and economy related disciplines, which raise issues of the abroad trade and the administration operating the trade, together with workers of the institutions of abroad trade. This book has above all the didactic dimension.
