Whereas:
A.
on 10th October 2016 the OWNER, PDH Polska S.A. having its registered office in Police, made
the letter of invitation to express one’s interest to bid for the HARBOUR EPC CONTRACT (the
“INVITATION”) public on the website http://grupaazoty.com;
B.
pursuant to Clause 2.4.1 of the INVITATION, having become acquainted with
the INVITATION, each interested prospective bidder that meets the prequalification
requirements was requested to submit its respective expression of interest to bid in the TENDER
in line with the rules set out in the INVITATION (the “EXPRESSION OF INTEREST”) by 21
October 2016, 12:00 (midday) CET;
C.
pursuant to Clause 2.9 of the INVITATION “the OWNER reserves the right to […] cancel,
suspend or recommence the TENDER at any time, and in any manner that the OWNER may
consider necessary or desirable, without giving any reasons”;
the OWNER hereby informs on the cancellation of the tender for the selection of the HARBOUR
EPC CONTRACTOR (i.e. the TENDER).
At the same time, the OWNER thanks for interest to bid in the TENDER and kindly informs that
EXPRESSION OF INTEREST, together with all appendices attached thereto, submitted in line with
the rules set out in the INVITATION will be promptly returned by the OWNER to their senders
unopened, in the condition in which they were received by the OWNER. Should information and data
indicated by a sender on an envelope, in which such a sender (a prospective bidder) provided the OWNER
with its EXPRESSION OF INTEREST together with appendices attached thereto, do not allow to identify
the sender, and – as a consequence – do not allow the OWNER to return the EXPRESSION OF
INTEREST together with appendices attached thereto without the necessity to open the envelope, the
OWNER will open the envelop in order to identify the sender and to return the EXPRESSION OF
INTEREST together with appendices attached thereto to such an identified sender.
