Legal Alert Nowe zasady zawierania umów o pracę już od lutego 2016 New Rules for Conclusion of Employment Contracts as from February 2016 Neue Regelungen für den Abschluss von Arbeitsverträgen ab Februar 2016 Grudzień 2015 / December 2015 / Dezember 2015 KPMG.pl LEGAL ALERT | 2 Nowe zasady zawierania umów o pracę już od lutego 2016 W dniu 22 lutego 2016 r. wejdzie w życie znacząca nowelizacja ustawy z dnia 26 czerwca 1974 r.- Kodeks pracy. Poniżej przedstawiamy najważniejsze zmiany, które mogą mieć istotny wpływ na obowiązki pracodawców zarówno wobec obecnych pracowników, jak i w odniesieniu do umów, które będą zawierane po dniu wejścia w życie nowelizacji. Ograniczenie rodzajów umów o pracę W obecnym stanie prawnym istnieje możliwość zawarcia umowy o pracę na czas nieokreślony, czas określony lub na czas wykonania określonej pracy. Każda z tych umów może być poprzedzona umową o pracę na okres próbny. Ustawodawca zdecydował się na usunięcie z katalogu umów o pracę umowy na czas wykonania określonej pracy. W uzasadnieniu projektu ustawy wskazuje się, że ten rodzaj umowy jest rzadko stosowany w praktyce, a co więcej często budzi wątpliwości, czy dla danego rodzaju pracy dopuszczalne jest zawieranie umowy na czas wykonania określonej pracy czy też należałoby zawrzeć umowę na czas określony. W świetle powyższego uznano, że utrzymanie takiego rodzaju umowy nie wydaje się uzasadnione. Doprecyzowanie regulacji związanych z umową o pracę na okres próbny Nowelizacja precyzuje cel w jakim zawierana jest umowa o pracę na okres próbny (nieprzekraczający 3 miesięcy) – jest nim sprawdzenie kwalifikacji pracownika i możliwości jego zatrudnienia w celu wykonywania określonego rodzaju pracy. Zgodnie z nowymi przepisami, ponowne zawarcie umowy o pracę na okres próbny z tym samym pracownikiem będzie możliwe w następujących przypadkach: 1) jeżeli pracownik miałby być zatrudniony w celu wykonywania innego rodzaju pracy; 2) po upływie co najmniej 3 lat od dnia rozwiązania lub wygaśnięcia poprzedniej umowy o pracę, jeżeli pracownik miałby być zatrudniony w celu wykonywania tego samego rodzaju pracy (w tym przypadku dopuszczalne jest jednokrotne ponowne zawarcie umowy na okres próbny). Zmiany dotyczące zasad zawierania umów o pracę na czas określony oraz zmiany związane z długością okresu wypowiedzenia tych umów Nowe przepisy wprowadzają fundamentalne zmiany dotyczące zawierania umów o pracę na czas określony. Dotychczas ustawa nie precyzowała na jaki okres czasu możliwe jest zawarcie tego rodzaju umowy. Umowy te bardzo często zawierane były na wieloletnie okresy (bez obiektywnego uzasadnienia), podczas gdy uzasadnionym byłoby w takich sytuacjach zawieranie umów o pracę na czas nieokreślony. Nowelizacja wprowadza maksymalny limit czasu, na który będzie mogła zostać zawarta umowa o pracę na czas określony i jednocześnie wskazuje ona maksymalną dopuszczalną łączną liczbę tych umów w ramach wspomnianego limitu. Zgodnie ze znowelizowanym art. 251 § 1 Kodeksu pracy okres zatrudnienia na podstawie umowy o pracę na czas określony, a także łączny okres zatrudnienia na podstawie umów o pracę na czas określony zawieranych między tymi samymi stronami stosunku pracy, nie może przekraczać 33 miesięcy, a łączna liczba tych umów nie może przekraczać trzech. Jeśli limity te zostaną przekroczone, uważa się, że pracownik (odpowiednio od dnia następującego po upływie 33 miesięcy lub od dnia zawarcia czwartej umowy o pracę na czas określony) zatrudniony jest na podstawie umowy o pracę na czas nieokreślony. Nowelizacja przewiduje szereg odstępstw od opisanej wyżej zasady, np. gdy pracodawca wskaże obiektywne przyczyny leżące po jego stronie czy też w celu wykonywania pracy przez okres kadencji, jeżeli służy to zaspokojeniu rzeczywistego okresowego zapotrzebowania i jest niezbędne w tym zakresie w świetle wszystkich okoliczności zawarcia umowy. W określonych w Kodeksie pracy przypadkach pracodawca zobowiązany będzie zawiadomić właściwego okręgowego inspektora pracy o zawarciu umowy, która wykracza poza ustawowy limit czasowy, wraz ze wskazaniem przyczyn jej zawarcia, w terminie 5 dni roboczych od dnia jej zawarcia. Niedopełnienie tego obowiązku stanowić będzie wykroczenie pracodawcy, podlegające grzywnie do 30 000 zł. Co istotne, zawarcie umowy wykraczającej poza ustawowy limit czasowy będzie wymagało odzwierciedlenia w treści umowy okoliczności i obiektywnych przyczyn uzasadniających zawarcie takiej umowy. Ustawodawca znowelizował także przepisy dotyczące wypowiadania umów o pracę na czas określony. Dotychczas, zgodnie z art. 33 Kodeksu pracy, przy zawieraniu umowy o pracę na czas określony, dłuższy niż 6 miesięcy, strony mogły przewidzieć dopuszczalność wcześniejszego rozwiązania umowy za dwutygodniowym wypowiedzeniem. W praktyce doprowadzało to do sytuacji, w której do LEGAL ALERT | 3 pracowników będących de facto w porównywalnych sytuacjach (zatrudnieni na podstawie umowy o pracę na czas nieokreślony i zatrudnieni na podstawie wieloletnich umów o pracę na czas określony) zastosowanie miały odmienne zasady dotyczące okresu wypowiedzenia - w przypadku tych pierwszych okres wypowiedzenia uzależniony był od stażu pracy, a w przypadku tych drugich był to sztywny dwutygodniowy okres wypowiedzenia (o ile strony w ogóle przewidziały taką możliwość). Zgodnie ze znowelizowanymi przepisami, długość okresu wypowiedzenia w przypadku umowy na czas nieokreślony i na czas określony będzie taka sama i zależeć będzie od okresu zatrudnienia u danego pracodawcy. Uregulowanie w ustawie możliwości jednostronnego zwolnienia pracownika przez pracodawcę z obowiązku świadczenia pracy w okresie wypowiedzenia Obecnie przepisy Kodeksu pracy nie przewidują wprost możliwości jednostronnego zwolnienia pracownika przez pracodawcę z obowiązku świadczenia pracy w okresie wypowiedzenia, jednak w praktyce jest to bardzo często stosowane rozwiązanie. Ustawodawca, chcąc rozwiać wątpliwości w zakresie dopuszczalności stosowania takiego zwolnienia bez konieczności uzyskania zgody pracownika, postanowił uregulować tę kwestię wprost w przepisach. W okresie zwolnienia pracownik zachowa prawo do wynagrodzenia. Below we set out the most important changes which may have a significant influence on obligations of employers with regard to both current employees and contracts that will be concluded after the amendment enters into force. duration such a type of contract can be entered into. In practice, this has led to the abuse of fixed-term contracts by employers. These contracts have often been concluded for long-term periods (without any objective reasons) whereas in such cases it would be justified to enter into the employment contracts for an indefinite period of time. Reducing the types of employment contracts The amendment introduces the maximum time limit for which the employment contract for a definite period of time may be concluded and it indicates at the same time the total number of these contracts that may be concluded within the limit mentioned. According to Article 251 § 1 of the Labor Code, the employment period on the basis of the employment contract for a definite period of time, as well as the total employment period based on the employment contracts for a definite period of time concluded between the same parties to the employment relationship may not exceed 33 months, while the total number of these contracts is three. If these limits are exceeded, the employee is deemed to be employed on the basis of the employment contract for an indefinite period of time (from the day following the lapse of 33 months or from the day of concluding the fourth employment contract for a definite period of time, respectively). Under the legislation currently in force it is possible to conclude an employment contract for an indefinite period of time, for a definite period of time or for a specified task. Each of these contracts may be preceded by the employment contract for a trial period. The legislator has decided to remove the contract for a specified task from the catalogue of employment contracts. The explanatory note on the draft Act states that this type of contract is rarely used in practice, and what is more, doubts often exist as to whether in the case of a certain type of work, it is permissible to conclude the contract for a specified task or rather the contract for a definite period of time should be entered into. In the light of the above, maintaining this type of contract has been found unjustified. Clarifying regulations related to the employment contract for a trial period The amendment specifies the aim of entering into the employment contract for a trial period (not exceeding 3 months) – it is to check qualifications of the employee and the possibility of employing this employee to perform certain work. According to new provisions, re-entering into the employment contract for a trial period with the same employee will be possible in the following cases: 1) if the employee is employed to perform a different type of work; 2) after a period of at least 3 years from the date of termination or expiration of the previous employment contract, if the employee is employed to perform the same type of work (in this case it is permissible to re-enter once into the employment contract for a trial period). Changes related to the rules for entering into the employment contracts for a definite period of time and changes connected with the length of the period of notice The new provisions introduce fundamental changes related to the conclusion of the employment contracts for a definite period of time. The amendment foresees a number of derogations from the above rule, e.g. if the employer gives objective reasons attributable to the employer, or in order to perform work during one’s term of office if this serves to meet actual and existing needs and is necessary for that purpose in the light of all the circumstances surrounding the conclusion of the contract. In specific cases set out in the Labor Code, the employer is required to notify a competent district labor inspector of the conclusion of the contract which exceeds the statutory time limit and indicate the reasons for its conclusion within 5 working days from the date of its conclusion. Failure to do so will constitute a misdemeanor of the employer subject to a fine of up to PLN 30,000. Significantly, the conclusion of the contract exceeding the statutory time limit will require circumstances and objective reasons justifying the conclusion of such a contract to be reflected in its wording. The legislator has also revised provisions related to the termination of the employment contracts for a definite period of time. So far, according to Article 33 of the Labor Code when concluding the employment contract for a definite period of time longer than 6 months, the parties could provide for admissibility of an early termination with a two-week LEGAL ALERT | 5 notice. In practice, it has led to a situation in which different procedures connected with the period of notice have applied to employees who, de facto, have been in comparable situations (employed on the basis of the employment contracts for an indefinite period of time and employed on the basis of the long-term employment contracts for a definite period of time) in the case of the former, the period of notice has depended on seniority, when it comes to the latter, a fixed two-week period of notice has applied (if the parties have provided for such a possibility). According to the provisions amended, the length of the period of notice in the case of the contract for an indefinite and definite period of time will be the same and will depend on the period for which a person is employed by the same employer. Regulating the possibility of the employer to unilaterally exempt the employee from the obligation to perform work within the period of notice Currently, the provisions of the Labor Code do not explicitly provide for the possibility of the employer to unilaterally exempt the employee from the obligation to perform work within the period of notice; however, such a solution is commonly used in practice. In order to allay the doubts over the permissibility of such exemption without obtaining the consent of the employee, the legislator has decided to regulate this issue directly in legislation. During the period of termination, the employee will retain the right to remuneration. Februar 2016 tritt eine wesentliche Novellierung des Gesetzes vom 26. Juni 1974 – Arbeitsgesetzbuch – in Kraft. Nachstehend stellen wir wichtigste Änderungen dar, die Pflichten der Arbeitgeber gegenüber aktuellen Arbeitnehmern sowie die nach dem Inkrafttreten der Novelle abzuschließenden Verträge bedeutsam beeinflussen können. Einschränkung der Arten von Arbeitsverträgen In der aktuellen Rechtslage kann man einen unbefristeten, befristeten bzw. einen Arbeitsvertrag für die Zeit der Ausführung einer bestimmten Aufgabe schließen. Jedem dieser Verträge kann ein Probearbeitsvertrag vorangehen. Der Gesetzgeber hat sich entschlossen, vom Verzeichnis der Arbeitsverträge den Arbeitsvertrag für die Zeit der Ausführung einer bestimmten Aufgabe abzuschaffen. In der Begründung des Gesetzentwurfes wird darauf hingewiesen, dass diese Vertragsart in der Praxis selten verwendet wird, zumal häufig Zweifel weckt, ob es für bestimmte Arbeitsart zulässig ist, einen Arbeitsvertrag für die Zeit der Ausführung einer bestimmten Aufgabe abzuschließen oder eher anstatt dessen ein befristeter Vertrag angemessen ist. Vor diesem Hintergrund wurde festgestellt, dass Aufrechterhaltung solch einer Vertragsart unbegründet sei. Eindeutigere Regelung des Probearbeitsvertrags Die Novellierung legt näher fest, zu welchem Zweck der Probearbeitsvertrag (für eine Frist bis zu 3 Monaten) geschlossen wird – er dient der Überprüfung von Qualifikationen des Arbeitnehmers und der Möglichkeit seiner Einstellung für die Ausübung bestimmter Arbeitsart. Ein erneuter Abschluss des Probearbeitsvertrags mit demselben Arbeitnehmer ist den neuen Vorschriften zufolge in folgenden Fällen möglich: 1)soweit der Arbeitnehmer zur Abwicklung einer anderen Arbeit eingestellt werden sollte; 2)nach Ablauf von mindestens 3 Jahren ab Auflösung bzw. Änderungen der Regelungen zum Abschluss von befristeten Arbeitsverträgen und deren Kündigungsfristen Die neuen Vorschriften führen wesentliche Änderungen beim Abschluss von befristeten Arbeitsverträgen ein. Bisher war die Dauer dieser Vertragsart gesetzlich nicht geregelt. In der Praxis haben die Arbeitgeber von befristeten Arbeitsverträgen übermäßig Gebrauch gemacht. Derartige Verträge wurden häufig für mehrjährige Laufzeit geschlossen (ohne objektiven Grund), während in solchen Situationen der Abschluss eines unbefristeten Arbeitsvertrags begründet war. Die Novellierung führt die Höchstlaufzeit von befristeten Arbeitsverträgen ein und weist gleichzeitig auf zulässige Gesamtanzahl dieser Verträge im Rahmen des vorgenannten Limits hin. Dem geänderten Art. 251 § 1 des Arbeitsgesetzbuches zufolge darf die Beschäftigungszeit aufgrund eines befristeten Arbeitsvertrags und die Gesamtdauer der Beschäftigung aufgrund zwischen denselben Parteien des Arbeitsverhältnisses geschlossenen befristeten Arbeitsverträgen 33 Monate nicht überschreiten und insgesamt drei Verträge zulässig sind. Bei Überschreitung dieser Grenze wird angenommen, dass der Arbeitnehmer (entsprechend ab dem Tag nach Ablauf der Frist von 33 Monaten oder ab dem Abschluss des vierten befristeten Arbeitsvertrags) auf Grundlage eines unbefristeten Arbeitsvertrags eingestellt ist. Der Novelle sieht von dieser Regel mehrere Ausnahmen vor, z.B. wenn der Arbeitgeber objektive von ihm zu vertretende Gründe nachweist oder für Beschäftigung in der Amtszeit, soweit dies tatsächlichen vorübergehenden Bedarf an Arbeitsleistung zu befriedigen hat und im Lichte sämtlicher Umstände des Vertragsabschlusses unerlässlich ist. In den im Arbeitsgesetzbuch bestimmten Fällen ist der Arbeitgeber verpflichtet, dem zuständigen Bezirksarbeitsinspektor den Abschluss eines Vertrags, der die gesetzliche Zeitspane überschreitet, unter Angabe dessen Grundes innerhalb von 5 Werktagen ab seiner Unterzeichnung mitzuteilen. Nichterfüllung dieser Pflicht stellt einen Verstoß des Arbeitgebers dar und wird mit Bußgeld bis zu PLN 30 000 bestraft. LEGAL ALERT | 7 Wichtig ist auch, das beim Abschluss solch eines Vertrags, der das gesetzliche Zeitlimit überschreitet, in seinem Inhalt die Umstände sowie objektive Gründe für dessen Abschluss zu widerspiegeln sind. Der Gesetzgeber hat auch die Regelungen zur Kündigung befristeter Arbeitsverträge geändert. Bisher konnten die Parteien gemäß Art. 33 des Arbeitsgesetzbuchs beim Abschluss eines befristeten Arbeitsvertrags mit einer Laufzeit von mehr als 6 Monaten die Zulässigkeit einer früheren Auflösung dieses Vertrags unter Einhaltung einer Kündigungsfrist von zwei Wochen vorsehen. In der Praxis führte dies zu der Situation, in der für Arbeitnehmer, die de facto in vergleichbarer Lage waren (sie waren aufgrund eines unbefristeten Arbeitsvertrags und langjähriger befristeter Arbeitsverträge eingestellt) andere Kündigungsregeln galten– im ersten Fall hängte die Kündigungsfrist von der Beschäftigungszeit ab und im zweiten Fall war es eine feste Kündigungsfrist von zwei Wochen (soweit die Parteien überhaupt diese Möglichkeit vorgesehen haben). Den geänderten Regelungen zufolge wird die Kündigungsfrist des unbefristeten und befristeten Vertrags die gleiche sein und von der Beschäftigungszeit beim jeweiligen Arbeitgeber abhängen. Gesetzliche Regelung einseitiger Freistellung von der Arbeitspflicht des Arbeitnehmers in der Kündigungsfrist Aktuell besteht nach dem Arbeitsgesetzbuch direkt keine Möglichkeit für den Arbeitgeber, den Arbeitnehmer in der Kündigungsfrist einseitig von der Arbeitspflicht freizustellen, in der Praxis wird aber derartige Lösung sehr oft angewandt. Vor dem Hintergrund der Zweifel daran, ob solch eine Lösung ohne Zustimmung des Arbeitnehmers zulässig ist, hat der Gesetzgeber dieses Problem in den Vorschriften unmittelbar geregelt. Der Arbeitnehmer behält in der Freistellungsfrist den Anspruch auf seine Vergütung. Übergangsbestimmungen Das Änderungsgesetz zum Arbeitsgesetzbuch enthält eine Reihe von Übergangsbestimmungen, die sich auf die am Tage des Inkrafttretens des Gesetzes geltenden Arbeitsverträge beziehen.
