Theoretical and methodological aspects ...................19 The objective of the article is to put order to the concepts and problems regarding the measurement of the effects and effectiveness of public sector activities, which are presented within the framework of the reflections on the subject in the literature. In the article, the authoress argues that the measurement of effectiveness in the public sector is subject to limitations, while effectiveness of the activities of public entities cannot be assured in all circumstances through the use of results-oriented management instruments. The author discusses the main methods of such planning and the measures of its assessment, simultaneously indicating the main causes of mistakes in planning the individual components of the local authority unit’s budget. As a result, he analyses the values of the errors in forecasting income, expenses, revenues and expenditures in local authority budgets and their main types in 2001–2012. The assessment of these measures enables the author to specify the main factors determining the quality of budget planning in local authority units during the period under review. LOCAL TAXES AND CHARGES Leszek Syguła Enforcement of tax arrears payable to local authority units by the heads of the tax offices in the Lower Silesian Voivodship in 2006–2012 – empirical analysis ................... 44 The article presents the shape of tax arrears due to local authority units in the Lower Silesian Voivodship and indicates whether the effectiveness of enforcement, understood as the proportion of the amounts recovered to the total amounts encompassed by fieri facias clauses, changes with the change in the level of arrears. The author also attempts to present changes intended to increase the effectiveness of the activities of the enforcement authorities. Even so, as the authoress emphasizes, the rules for excluding persons from conducting activities in the procedure of awarding public contracts have been a source of confusion and controversy from the start of application of this Act. SUPERVISION AND AUDIT Wojciech Bożek The obligation to conduct internal audits at public sector units and liability for delict under Article 18a of the Act on liability for breaching public finance discipline of 17 December 2004 ....62 In the article, the author discusses the institution of the internal audit in the public sector, as well as the matter of protecting public finances against disciplinary breaches which could take place in the area of the internal audit and its coordination at public sector units. The analysis of the subjective and objective scope of Article 18a of the Act on liability for breaching public finance discipline of 17 December 2004 suits the course of the discussion on both the desirability to introduce the obligation arising from this regulation and any possible consequences of its lack of performance of improper performance. DILEMMAS Tomasz Wołowiec, Dariusz Reśko Collection of the spa resort charge at spa resort hospitals .....................................................................70 A fundamental problem in interpretation applies the question of whether a spa resort hospital is a hospital in the meaning of Article 17, para. 2 item 2 of the Act on local taxes and charges. Therefore, the dispute between the collectors of spa resort taxes and the tax authorities applies to issues regarding the extent of the exemption from this tax provided for in this regulation, or more strictly speaking, whether it applies to people who are in a spa resort hospital in the meaning of the Act on spa resort treatment. The analysis of the provisions of both Acts leads the authors to the conclusion that this exemption does not encompass spa resort hospitals, which means the spa resort charge should be collected at facilities with the status of a spa resort hospital.
