Materiały większe lub mniejsze albo już publikowane wymagają osobnej zgody redakcji. Tekst należy zaopatrzyć w abstrakt w języku polskim, o objętości nie większej niż 500 znaków. Autor może zaproponować tłumaczenie na język angielski tytułu tekstu oraz abstraktu. Przypisy powinny być opracowane w tradycyjny sposób – na dole strony. Materiały wraz z danymi autora (stanowisko, adres, numer telefonu) i ewentualnym listem polecającym prosimy przysyłać pocztą elektroniczną lub zwykłą, z załączoną płytą CD. Alongside organizational and audit solutions, as well as financial liability, the preventive and stimulative function of personal liability – as the author emphasizes – is an important incentive for achieving this objective. BUDGET Edyta Rutkowska-Tomaszewska Depositing free funds by local authority units in banks ...........................................................................25 The study presents the principles of depositing free funds in banks by local authority units, compared with other forms of their investment permitted by the Public Finance Act. It encompasses the issue of depositing free budget funds on bank accounts, equally at the bank providing banking support to the budget and at other banks. The considerations especially encompass an analysis of Article 264 of the Public Finance Act regarding the banking support of the local authority unit, in connection with its Article 48, specifying the principle of the freedom to deposit free funds, its limitations and the notion of free funds. LOCAL TAXES AND CHARGES Dobrosława Antonów Jurisdiction of regional chambers of audit regarding municipal council resolutions on stamp duty..........33 RCA supervisory activities encompass decisions made by the governing bodies of local authority units on local taxes and charges, to which the provisions of the Tax Ordinance apply. The considerations of the study refer to the discussion of whether and to what extent the municipal councils can regulate the structure and principles of payment of stamp duty by resolution and whether such resolutions lie within the jurisdiction of the regional chambers of audit. PROPERTY AND PUBLIC PROCUREMENT Tomasz Turek A union of municipalities as the organizer of public transport services – general comments in the light of the Public Transport Act................................................................. 43 Public transport services are treated as a so-called “obligation to provide a public service”. A union of municipalities can also be the organizer of such services. These services, as the union’s task, may be provided by a municipal budget establishment, which, from the point of view of the Public Finance Act is an entity which makes settlements with the municipality budget using the net method. However, the imposition of the obligation to provide public services on a municipal company can arise from a concluded civil law contract or take place through an act having the nature of an order, provided that it clearly specifies that the objective of the municipal company’s activities is to perform the municipality’s own tasks regarding the satisfaction of the public transport needs of the residents. It has made the failure to fulfil obligations within the framework of this control a determinant of liability for violating public finance discipline. In practice, however, the enforcement of this liability on managers of public finance sector units encounters obstacles. According to the author’s assessment, the sources of the problems should be sought in the method of determining this liability in the Act on liability for a violation of public finance discipline and the institution itself of management control in the Public Finance Act. A local authority budget establishment performing the local authority’s own tasks of a public service nature in municipal management is an organizational unit without legal personality, conducting business on its own in this respect, as referred to in Article 15, para. 2 of the Act on VAT of 11 March 2004 (Journal of Laws No. 54, item 535 as amended), and therefore has the capacity to remit VAT, which is separate to that of the local authority which established it. 2. The performance by the local authority budget establishment of the municipal management public service tasks of the local authority unit establishing it does not constitute services (in the meaning of Article 8 of the Act) which are taxable with VAT between these entities, which does not preclude their taxation for their paid provision to external entities (consumers of the municipal management activities).
