The new regulations of the Stability and Growth Pact are increasing the responsibility of States for applying uniform requirements regarding the rules and procedures specifying the budgetary framework in these States. The regulations introduced by the amendment to the Public Finance Act of 8 November 2013 satisfy the recommendations of EU law, especially through the change in the legal structure of long-term financial planning and the establishment of the stabilizing spending rule reducing an excessive increase in government and local authority sector spending. BUDGET Jan Czempas Changes in the significance of the mining fee to the budgets of the mining municipalities in the Silesian Voivodship ...............................................................................................................................16 The socio-economic turnaround in Poland from 1989 put mining enterprises in a difficult situation. Encountering the iron laws of the free market proved disastrous for many firms. Restructuring was considered their only chance for survival. The Polish Sejm passed a law on 28 November 2003 on the restructuring of bituminous coal mining in 2003–2006, which defined the principles of financial restructuring of mining enterprises, employment restructuring, the liquidation of mines and the financing of the restructuring of coal mining. The results of these changes are currently noticeable in the worsening income position of mining municipalities. In this article, the author focuses on the significance of the sudden decline in the mining fee on their functioning. LOCAL TAXES AND CHARGES Marek Szałkiewicz Limitation of the right to issue a decision on the planning gain supplement and the limitation of the liability from this charge ................................................................................... 31 Referring, in this article, to the Public Finance Act and the Tax Ordinance, the author draws attention to the possibility of the limitation of the liability from the planning gain supplement. He also presents the practical aspects related to the issue of limitation and the problems which can arise in connection with the respective application of the provisions of the Tax Ordinance in proceedings regarding the establishment of the planning gain supplement. Tomasz Wołowiec Taxing buildings and land entered into the register of historic monuments with property tax ......37 In accordance with Article 1a, para. 1, item 3 of the Act on local taxes and charges, the mere fact that an entrepreneur has a building or land constitutes the grounds for assessing the tax liability from property tax according to the rates for property related to business. However, Article 7, para. 1, item 6 of Act stipulates that land and buildings entered individually into the register of historic monuments are exempt from property tax, on condition that they are maintained and serviced in accordance with the regulations on the conservation of historical monuments, with the exception of the part used for business. Therefore, those parts of monumental buildings and land on which business is conducted – as the author emphasizes – are taxed at rates related to conducting business. One of these is the increase in the value of property caused by the enactment or change of the land use plan. This means that the setting of the planning gain supplement is determined by the establishment that there is direct correlation between the increase in the value of the property and the entry into force of or change in the land use plan. In this article, the authoress presents the rules that should be followed when defining the increase in the value of property arising from the enactment of or change in the land use plan. Dagmara Hajdys Public-private partnership and the investment policy of local authorities......................................... 49 The article specifies the magnitude of the investment potential of local authority units in the context of public-private partnerships in 2009-2011. The public finance crisis and the budgetary constraints of local authority units are resulting in the need to look for new methods of financing investments. According to the authoress, public-private partnership is one of these methods. The involvement of private capital could be one of the important factors increasing the level of investment potential, simultaneously encouraging growth in the investment projects undertaken. SUPERVISION AND AUDIT Urszula Wycisk Spending on the salaries of local authority employees of local authority units and audit findings of the regional chambers of audit ...............................................................................57 Expenditure on salaries is an obligatory financial charge of every local authority unit. In this article, the authoress analyses the provisions of the law and discusses the irregularities found by the regional chambers of audit in the process of auditing local authority spending on employee salaries in 2011–2012. DILEMMAS Barbara Wołczak Corrections to tax declarations and the level of the balancing subsidy for municipalities ............. 64 The basis for calculating the amount of the general subsidy is the tax revenue disclosed in the accounts of local authority units (statement of general taxation income – Rb-PDP) for the year preceding the base year, taking into account the corrections submitted to the regional chamber of audit by 30 June of the base year. The submission by the taxable person of a correction to the tax return for prior years, which affects the level of the balancing part of the general subsidy already received by the municipality gives rise to a dilemma as to which year’s tax return should disclose the consequences of these corrections. The authoress emphasizes that, until the provisions of the law regulating this issue are amended, the guidelines of the Ministry of Finance need to be followed.
